HomeMy WebLinkAbout08-429NOVEMBER 25, 2008 08 -429 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVAL OF DISPOSITION OF PORTION OF HIGH AVENUE PARKING LOT TO OWNERS OF 250 PEARL AVENUE INITIATED BY: COMMUNITY CREDIT UNION PLAN COMMISSION RECOMMENDATION: Approved WHEREAS, Community Credit Union approached the City regarding the acquisition of a piece of the High Avenue Parking Lot along Pearl Avenue to square off its property at 250 Pearl Avenue for additional parking and landscaping. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the piece of land on Pearl Avenue that is part of the High Avenue Parking Lot, adjacent to 250 Pearl Avenue, per the attached, is hereby declared surplus and the proper City officials are hereby authorized and directed to execute any and all documents necessary to sell the property to the owners of 250 Pearl Avenue. 0 .IHKOf H ON THE WATER TO: Honorable Mayor and Members of the Common Council FROM: Jackson Kinn .,�'L�' Director of Com ity Development DATE: November 20, 2008 RE: Approval of Disposition of Portion of High Avenue Parking Lot to Owners of 250 Pearl Avenue (Plan Commission Recommends Approval) BACKGROUND The Community Credit Union (CCU) is located at the corner of Division Street and Pearl Avenue in a predominantly commercial area. CCU has a need for additional parking and would also like to improve their lot by adding greenspace and landscaping. They approached City Administration to inquire about acquiring a 3,400 square foot undeveloped city -owned property adjacent to the High Avenue Parking Lot. ANALYSIS City Administration reviewed the request and felt the proposed disposition wouldn't negatively impact on the City or the High Avenue Parking Lot and forwarded the request to the Parking Utility Board which subsequently approved the disposition. There is currently a light located on the property that will either need to be removed, incorporated into the disposed property, or an easement to be retained by the City for the light. Staff is currently reviewing these options. The property in question was acquired by the City in 1993, when the City acquired the old Wisconsin Central mainline running through the downtown/central city area. This particular property was not integrated into the construction of the High Avenue parking lot. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its November 4, 2008 meeting. Approved, �Mana C y ITEM: LAND DISPOSITION — PORTION OF HIGH AVENUE PARKING LOT Plan Commission meeting of November 4, 2008 GENERAL INFORMATION Applicant: Community Credit Union Property Owner: City of Oshkosh Action(s) Requested: Disposition of an approximate 3,400 square foot undeveloped portion of the High Avenue Parking Lot. The applicant intends on incorporating the property into a reconfigured parking lot for the Community Credit Union at 250 Pearl Avenue. RECOMMENDATION /CONDITIONS The Department of Community Development recommends approval of the disposition with the following conditions: 1) Approval of a drainage plan by the Department of Public Works for the parking and greenspace area. The Plan Commission approved of the land disposition with conditions noted. The following is the Plan Commission's discussion on this item. Ms. Mattox voiced her concern regarding adequate parking for the downtown area and questioned how many parking spaces would be lost due to this disposition to a private owner. Mr. Burich responded that the land disposition would have no impact on downtown parking as this is an undeveloped portion of the High Avenue parking lot so there were no parking spaces located in this area. Bob Freid, 708 Nicolet Avenue, commented that he was present for any questions that commission members may have. Board members discussed the need for the fencing shown on the site plan. It was determined that the fencing was necessary to the credit union to serve as a way to buffer the site from the view of the back of the buildings on High Avenue that currently face the site. Motion by Lowry to approve the land disposition of a portion of the High Avenue Parking Lot as requested with the following conditions: 1) Approval of a drainage plan by the Department of Public Works for the parking and greenspace area. 2) Provision of a 5-foot easement along the east property line.
