Home Remodeling Agreement
This Home Remodeling Agreement (the "A ~eemen ") is made and effective

Owner is the owner of a House located at (the "House").

Builder is in the business of providing construction and remodeling services using
employees and/or sub-contractors.
Owner desires to retain Builder to provide construction and remodeling services at the
House, and Builder desires to provide such services, all according to this Agreement.
NOW, THEREFORE, it is agreed:
1. Services Agreement.
A. Builder agrees to provide and perform certain construction, remodeling and/or repair
work at the House according to the terms of this Agreement. Builder shall perform, and
make sure any ,all of the work in a good, sound, workmanlike
manner.
B. The work to be performed and the services to be provided by Builder at the House are

B. Unless otherwise agreed in advance by Owner, all materials used will be new and of
good quality.
3, ComAliance with Law.
Builder represents that it complies with all federal, state and local laws and regulations
applicable to providing construction services in the state where the House is located and
where Builder does business including, but not limited to, any license or proficiency
requirements. Builder will comply with all applicable federal, state, and local laws and
regulations related to the Agreement and the work to be performed including, but not
limited to building codes, disposal of waste and the safety of persons and property.
4. Changes.
owner may, from time to time, without invalidating this Agreement, request changes,
additions, alterations, or other modifications in the work to be performed. Upon receipt

of Owner's written request, Builder shall within two (2) business days respond in writing
to Owner with any increase in cost or delay in completion of the work based upon the
request. Owner shall then have two (2) business days to decide whether to order the
requested changes to be implemented or to withdraw the request. Owner agrees to pay
any increased charge owed according to Builder's response if Owner elects to order the
changes.
5. Time for Completion.
Builder will commence work on or about ~ .While Builder does
not guazante a completion date, Builder will u e Builder's best efforts to complete the
work by aoO~ Builder shall not be responsible for any delays caused
by weather, labor disputes, failures of material suppliers, unforeseen pre-existing
structural problems or delays caused by Owner for changes or otherwise. All work shall
be performed in a prompt and diligent manner, as rapidly as conditions shall permit.
Builder shall utilize sufficient labor, materials, tools equipment and supplies necessary to
insure uniform and efficient progress so as to complete the work by the scheduled
completion date.
6. Charges and Payment.
A. Owner shall pay Builder ~~~, o® for successful completion of the
work called for in this Agreement. Owner also agrees to pay amounts due resulting from
changes made pursuant to Section 4 above and for expenditures by Builder in excess of
allowance items, provided such expenditures were at the request of Owner.

C. No installment payment shall be conclusive evidence of Owner's acceptance of any
work or of any defective or improper materials.
D. If at any time any of Builder's subcontractors or materials suppliers files a notice of
lien or other claim against Owner or the House, or if damage is caused by Builder or any
of Builder's subcontractors, then Owner may withhold from any payment or payment
owed to Builder an amount sufficient to indemnify Owner against any such lien, claim or
damages. If there shall prove to be any lien, notice of lien or claim after all payments are
made, Builder shall promptly refund to Owner any amount that that Owner may be
compelled to pay to dischazge the lien or compensate the claimant for the damages

Builder shall keep the area in and around the House reasonably clean and clear of rubbish
and building debris. Builder shall use reasonable efforts to contain the spread of dust and
