19 -4 (R) PERTAINING TO PROHIBITING THE USE OF BIKES, SCOOTERS,
MOTORIZED VEHICLES OR OTHER WHEELED DEVICES (EXCEPT FOR
SKATEBOARDS OR IN -LINE SKATES) AT THE RED ARROW SKATE PARK
WHEREAS, the Red Arrow Skate Park was originally designed for skate
board and in -line skating; and
WHEREAS, the City of Oshkosh recently completed the reconstruction of
the Red Arrow Skate Park; and
WHEREAS, the skate park was constructed entirely with concrete
material; and
WHEREAS, the use of "freestyle" BMX bikes at concrete -base skate parks
causes destruction of the concrete and creates an unsafe situation;
The Common Council of the City of Oshkosh does ordain as follows:
SECTION 1. That Section 19 -4(R) of the Oshkosh municipal code
pertaining to the regulation of park uses is hereby created to read as follows:
(R) The use of bikes, scooters, motorized vehicles, or other wheeled
devices, except for skateboards or in -line skates, is prohibited at the Red Arrow
Skate Park.
SECTION 2. This ordinance shall be in full force and effect from and after
its passage and publication.

ordinance will prohibit the use of bikes, scooters, motorized vehicles or other
wheeled devices, except for skateboards or in -line skates, at the Red Arrow Skate
Park.

RE: Approval of an Ordinance Stating That "Bikes, Scooters, Motorized Vehicles, or
Other Wheeled Devices (Excluding Skateboards or In -Line Skates) Are Not
Allowed at The Red Arrow Skatepark"
BACKGROUND
The reconstruction of the Red Arrow Skatepark began mid -July 2008, and the re- opening of the park occurred on
October 10th, 2008. The cost to do the project was $220,042.
The initial purpose of the project was to replace the facility's floor, which was originally done with asphalt (as asphalt
has a normal life of fifteen to twenty years, deterioration started occurring within the first ten years). Along with the
new floor, a plan was developed to upgrade and improve skating opportunities with the addition of new components.
The skatepark was reconstructed entirely with concrete, which is the normal material used for skatepark construction.
For the most part, skateparks are designed for skateboard and in -line skaters. Even though, there is a desire by free-
style BMX bikers to use the same facility in most cities. Unfortunately, there are problems and issues when it comes to
that group doing their rides and tricks at such facilities.
There have been requests during past years by local skateboarders to keep bikers off of the Red Arrow Skatepark.
Those skaters informed the Parks Advisory Board as to the reasons for the request (see Park Board minutes dated 9 -10-
07). Their position was that the bikers, through grinding the edges of the concrete components with their bikes, which
are heavier than skateboards, tear -up the concrete. Anthony Schneider stated that "an extra 60 — 70 pounds of bicycles
crashing down on the concrete and amenities at skateparks causes chipping, which is a detriment to,the skatepark ".
Up to the re- opening of the Red Arrow Skatepark, keeping bikes out of the park was not strongly monitored because of
the condition of the park. The belief was that the old skatepark was in bad condition and that bikes couldn't do much
more damage. Now, with all of the new concrete, and the expense of pouring that concrete, it is imperative that bikes
are kept off of, and away from the upgraded park.
ANALYSIS
Please find an email (dated August 19, 2008) from Anthony Schneider that provides comments about bikes being
"banned" from skateparks. The email also lists public park systems throughout the nation where bikes are banned.
I have communicated with parks personnel from Green Bay and Fond du Lac. Those communities do not allow bikes
because they have concrete -based skateparks, similar to the one that now exists in Oshkosh. Green Bay has a rule
posted, and in Fond du Lac, the regulation is in ordinance form. The Police Departments in those cities are active in
keeping bikes out of their skateparks.

For examples, please find copies of three signs that state that "bikes are not allowed" — one is from Green Bay, the two
others from Chandler and Mesa, Arizona. I have included a sheet that shows what the sign in front of the Red Arrow
Skatepark will look like with rules and regulations, including the "no bikes" ordinance, if approved.
Also find an article from the Concrete Disciples group. On page two, the article notes "two inarguable reasons for
concerns with sharing bikes in skateparks. Foremost, shared simultaneous use of the skatepark is unsafe." On page
three, it is stated that "bikes inflict a degree of damage on park infrastructure never matched by skaters." Page four of
the article suggests that "nearly every town has a city attorney and most have properly concluded that the evidence
(user safety and park maintenance) leads one to direct skaters and BMX'ers to separate facilities. Indeed, creation of
separate facilities is the solution ".
Recently, a meeting was held with fifteen to twenty freestyle BMX bikers, two skateboard skaters, and the Parks
Director. There were two primary topic items. The first item had to do with getting the bikers to understand the need
to keep their bikes off of the Red Arrow Skatepark, which they accepted. The second item was to start a movement to
focus on getting a place that could be developed for freestyle BMX bikers to call their own. Discussion about such a
facility is scheduled for the November 2008 Parks Board meeting.
RECOMMENDATION
The Parks Director recommends that an ordinance is approved that states that "Bikes, Scooters, Motorized Vehicles, or
Other Wheeled Devices (Excluding Skateboards or In -Line Skates) are not allowed at the Red Arrow Skatepark".
The Parks Advisory Board discussed the ordinance recommendation at their October 13, 2008 monthly meeting. The
Board unanimously approved the ordinance language and recommends that the Common Council consider the same.

CALL TO ORDER & ROLL CALL
Chairman Akan called the meeting to order at 6:00 P.M. A quorum was determined to be present.
APPROVAL OF MINUTES
Motion by Bowen for approval of the August 13, 2007 minutes, as distributed. Seconded by Gogolewski. Motion
carried 5-0.
1) 2008 CIP
PARK BUSINESS
Mr. Stephany reiterated his Memorandum addressed to the Board dated September 7, 2007 (said Memorandum on file at the
City Parks office and made a part of these minutes). He noted the importance of making the South Park pavilion work the #1
priority for the 2008 CIP. He stated that Mr. Maas suggested upgrading the electrical infrastructure and noted that costs for
that work was included in the Memorandum.
Discussion ensued as to the possibility of installing a steel/metal roof and Mr. Stephany stated that estimates for same had not
been received to date. Mr. Maas stated that a steel/metal roof can still be investigated for a price and if said price is within the
budget guidelines, then it could be added in.
Mr. Bowen inquired if the asphalt parking lot work would be contracted out or if the City's Public Works Department would
be doing the work. He also inquired as to how the cost for the parking lot work was determined.
Mr. Stephany stated the parking lot work would most likely be contracted out. He stated that he had worked with someone
from the City's Public Works Department to determine the cost.
Mr. McHugh arrived at this time (6:08 PM), making a 6- member Board.
Mr. McHugh concurred that the South Park pavilion should be the #1 priority, but was of the opinion the parking. lot work
could be put on hold for another year.
Mr. Stephany introduced Anthony Schneider, one of the fundraiser organizers for the Red Arrow Skatepark. Mr. Schneider
discussed the organization's website (www.oshkoshskatepark.com) and the efforts of the organizer's to raise funds for
improvements to the skatepark. Mr. Schneider distributed copies of the fundraising form letter (said letter on file at the City
Parks office and made a part of these minute) that he has sent to various local businesses and prominent City residents. He
noted that while their fundraising results to date have been minimal, they are still working on grants, similar to the Tony Hawk
Foundation. He noted that the Oshkosh Community Foundation has offered a 50% matching grant up to $30,000 and has
extended their deadline for grant submittal. He explained that the Tony Hawk grant work is tedious and requires a lot of
information (i.e., design plans, demographics, etc.), which his group has been working on. Once received, the Tony Hawk
grant would be processed within six (6) months, if approved.

Mr. McHugh inquired if the proposed skatepark work could be piece - mealed.
Mr. Stephany stated it would be best to do the work at one time as once the concrete floor was poured, it would be too hard to
add amenities without causing cracks or gaps. Best case scenario would be to pour the floor around the proposed
features /amenities.
Mr. McHugh agreed that the skatepark is used quite a bit, however, he questioned if the skatepark was a valuable asset to the
City. How did the crack down the middle occur? How would we prevent that from happening again in the future?
Mr. Stephany stated one way to avoid cracking would be to have the surface made out of concrete instead of asphalt. He
stressed that fundraising is a challenge in itself and noted that the skatepark committee has been making a concerted effort to
raise matching funds.
Mr. Schneider stated that he realizes his fundraising committee is small and to do the skatepark improvements is a big project,
but they are working hard to raise dollars. He stated if the amenities were added piece - mealed, then the skatepark would end
up with cracks and gaps again which would decrease the life of the skatepark as a whole.
Mr. Michelson stated he is a big supporter of the skateboarders and inquired as to the worse case scenario. He stated he would
like to include the $100,000 in the 2008 CIP for skatepark improvements because if the skatepark is planned correctly from the
start, then it would be a better skatepark in the long run.
Mr. Stephany stated that the worse case scenario would be to take out the existing asphalt and replace it with concrete without
the additional features /amenities.
Chairman Akan concurred with Mr. Michelson and added that the skatepark improvements need to be done and he would like
to help support the fundraising committee.
Discussion ensued relative to the possibility of simply overlaying the flooring to make it last another year to allow time for
fundraising or to do the work fully as stated in the Park Director's Memorandum dated September 7, 2007.
Mr. Stephany stated the cracks are too severe and the gaps would just open up again with an overlay.
Mr. Bowen stated the City has an opportunity not to allow a facility to deteriorate — the longer the project is put off, the more
expensive it will become.
Ms. Hansen concurred with Mr. Bowen and stated it is time that the City shows the youth that we have belief in them when
those youths work so hard on a project that they use daily.
Mr. Michelson stated that skateboarding is a relatively new sport and doesn't have the history as other sports. He is in support
of proposing that $100,000 for skatepark improvements be included in the 2008 CIP list.
Discussion ensued relative to allowing bicycles in the skatepark and Mr. Stephany stated that upon completion of the
improvements to the skatepark, the rules would be re- visited as to keeping bicycles out of the skatepark. Mr. Schneider stated
that the extra 60 -70 lbs. of bicycles crashing down on the concrete and amenities causes chipping, which is a detriment to the
skatepark.
Discussion ensued as to the Spanbauer Field parking area. Mr. Stephany stated he obtained the cost of asphalt repair work of
$25,000 from the City's Public Works Department. He stated that the $50,000 for the Westhaven Circle Park would be used
for the upgrading of the tennis courts at that park.
Mr. Bowen suggested reversing the priority list — making Westhaven Circle Park tennis courts #3 and Spanbauer Field parking
area #4. He is of the opinion that resurfacing the tennis courts is more important.
Mr. McHugh inquired why the Miller's Bay weed chemical spraying is not included on the proposed 2008 CIP list?

Tom,
This is the information I have gathered, as you can see, there are a lot of park all over the country that have banned bikes in
their parks.
There are two concerns that lead us to recommend the ban; the safety of the users and damage to the facility (not to be
confused with normal wear and tear).
Authorities on the subject from the two most widely recognized, Skaters for Public Skateparks (SPS) and Concrete Disciples.
Here's what SPS has to say on safety:
"Mixing bicyclists and non - bicyclists within the same facility introduces a potentially fatal safety conflict on par with
mountain bikers and pedestrians sharing city park trails."
Concrete Disciples describes the problem this way:
"Shared simultaneous bike and skateboard use of a skatepark is like cars and trucks sharing roads with different sets of
driving rules. The accident is just around the corner."
And on the issue of damage, Concrete Disciples sums it up succinctly:
"...bikes inflict a degree of damage on park infrastructure never matched by skaters."
It is worth pointing out that at no time during the 3 -year fundraising effort and several well - publicized skatepark design
meetings did anyone show up to suggest the park admit or be designed for bikes. Further, not once did a bicycle rider ever
lend a hand with fund raising. While skateboarders went to city meetings, Fundraised, sold tee shirts and manned brat sale
booths in the dog days of summer, bike riders were nowhere to be found.

MINUTES
OCTOBER 13, 2008

INTRODUCTIONS
Mr. Stephany introduced new Board member, Colin Walsh. Mr. Walsh stated he is a Wisconsin native, that he attended
college in Stevens Point and noted that he had spent two summers working for the parks department in the past.
Mr. Stephany introduced the new City Manager, Mark Rohloff, to the Board members. Mr. Rohloff stated it was his pleasure
to greet the Board and members of the public. He stated he was looking forward to meeting each Board member personally
and invited them to contact him if they had any questions or concerns.
CALL TO ORDER & ROLL CALL
Chairman Gogolewski called the meeting to order at 6:00 P.M. A quorum was determined to be present.
APPROVAL OF MINUTES
Motion by Bowen for approval of the September 10, 2008 minutes, as distributed. Seconded by Wohler. Motion
carried 8 -0.
PARK BUSINESS
I) Bowen Street Fishine Deck
Mr. Stephany reiterated his Memorandum addressed to the Board dated October 10, 2008 (said Memorandum on file at the
City Parks office and made a part of these minutes). He stated that there is a 1962 Ordinance that was discovered (said
Ordinance on file at the City Parks office and made a part of these minutes) which stated, "It shall be unlawful to fish or loiter
on the Bowen Street dock from 10:00 o'clock P.M. to sunrise ". The City Attorney's office is doing research with respect to
said Ordinance — to make a determination if said Ordinance had been repealed or if the Ordinance is still in effect.
Mark Raedl, 14 Bowen Street, stated he has lived at his residence for the past 35 +/- years. He then read two (2) letters
received (said letters on file at the City Parks office and made a part of these minutes) from Virginia Disch and Dorothy M.
Laabs. Both ladies gave their versions of the history surrounding the deck and hours posted. The both also requested that the
deck remain status quo and be closed at 10 PM.
Steve Lindo, 2 Bowen Street, stated he has lived at his residence for the past 12 -13 years and noted that their situation is
"unique" in that their house is only 30 ft. from a public fishing deck, which is also at the end of dead -end street. He stated the
adjacent neighbors just want their quality of life. He also presented to the Board a photograph (said photograph not on file) of
the sign that was posted at the end of the roadway which stated that the deck closed at 10 PM.
Mr. Stephany stated the City had a similar unique situation at Westhaven Circle Park wherein a basketball court was in close
proximity of a residence. Kids were coming to the court and playing basketball after 11 PM and affecting the quality of life of
those residents. Mr. Stephany stated he had suggested that those neighbors contact the Oshkosh Police Department when the
basketball players were in the park after 11 PM, but they were reluctant to do that. Parks crew ended up pulling fuses from the
lights at the basketball court in order to keep players off the court after 11 PM.

Vice Chairman Wohler stated, "You are singling out one dock. If you put it in a pile, then put it in a pile." He stated he
concurs with Mr. Lindo's comments. If the 1962 Ordinance was repealed, then it needs to be corrected. If the 1962 Ordinance
is still in effect, then leave it that way and put the sign back up.
Mr. Raedl stated he is a former police officer and pointed out that if the City allows for fishing docks to be open 24 -hours a
day, then it's like opening a can of worms. Some docks are located in City Parks that, by Ordinance, close at 11 PM. Who is
to say that someone that is out on a fishing dock is there for fishing or other activity? It would be hard to enforce the closing
of a park and yet allow fishing on a fishing dock within the perimeters of a park. The Mill Street fishing deck is close to a
nursing home and making that dock open to fishing 24 hours a day would be a detriment to those residents at that nursing
home.
2) Red Arrow Skate Park
W. Stephany reiterated his Memorandum addressed to the Board dated October 10, 2008 (said Memorandum on file at the
City Parks office and made a part of these minutes). He stated that the matter of allowing bikes in the skatepark had been
presented to the Board in the past. He stated the Red Arrow skatepark opened last Friday (October 10, 2008) and it is time to
get an Ordinance approved to keep bikes off the skatepark. He stated that he held a meeting with the freestyle BMX bikers at
the Streets of Fire skateboard shop last Wednesday (October 8, 2008) and the bikers are in agreement with keeping bikes off
the skatepark.
Mr. Michelson inquired if the bikers are not allowed on the skatepark, where would they go?
Mr. Stephany stated that there are temporary ramps that James Baker (from Streets of Fire) used at Life Fest, which are now at
the hockey rink at Rainbow Park for bikers to use.
Mr. Michelson inquired if the skatepark was built for the purpose of both skaters and bikers?
Mr. Stephany stated that the skatepark was build solely for the purpose of skaters. In recent years bikers were allowed because
the skatepark was already in disrepair and they couldn't do much more damage, but now that the skatepark has been redone, it
would be unwise to allow bikers to use it. The bikers are excited about the possibility of utilizing the hockey rink at Rainbow.
Mr. Bowen stated that by placing, in effect, an ordinance that would alleviate maintenance issues is a good proposal and he is
in favor of it.
Chairman Gogolewski stated that although he is not in favor of another ordinance, he concurs with Mr. Bowen.
Mr. McHugh stated one of the problems he has noticed since he's been on this Board, is that signs do not work — kids rip them
down as fast as our parks crew put them up. For instance, the Frankfort Street signs are gone (No overnight parking in Stevens
Park) that crews just recently put up, as well as the signage that was placed at the Little Oshkosh playground.
Mr. Stephany stated the skaters are not afraid to call the police when bikers are in the skatepark. The police can then follow
through if signage and an Ordinance is in place. He also noted that parks crew were not aware that the Frankfort Street signs
were down and noted that they would be replaced as soon as possible.
Motion by Bowen that Mr. Stephany confer with the City Attorney to develop ordinance language to-keep bikers
off the Red Arrow Skatepark. Seconded by Hansen. NO VOTE WAS TAKEN.
Mr. Stephany stated that the proposed Ordinance language was included in the Board's packet.
Motion by Bowen to accept the Red Arrow Skate Park Ordinance language as submitted. Seconded by Hansen.
Motion carried 8 -0.
