Chairman Ruppenthal stated the owners are just dividing the property at this time and noted they
would be required to abide by the rules pertaining to wetlands during any construction.
Motion by Pressley for approval of the land division as requested. Seconded by
Gehling, Motion carried 8-0.
111: LAND DIVISION/1325 GEORGIA STREET A 83,Q.QSBORN AVEN~~~' -Plymouth
Congregational Church of Oshkosh; owner; Dennis Trembly, petitioner
Dennis Trembly, petitioner, on behalf of Plymouth Congregational Church of Oshkosh, owner, request
the Plan Commission review and approve a lot division for properties commonly known as 1325
Georgia Street and 839 Osborn Avenue.
Mr. Gehling inquired if there was a time restriction as to when the shed and barn/carriage house
would have to be removed/razed.
Mr. Roskom stated the proposed condition of approval states that they must be removed or relocated
to a code compliant location, or variances obtained, prior to placement of approval signatures on the
Certified Survey Map.
Mrs. Jack Baldridge, 848 Osborn Avenue, expressed concern with possible flooding. She inquired if
the City or the property owner would be responsible for storm drainage. She felt the drainage issue
should be resolved before approval of this land division.
Mr. Roskom stated if there is a City easement, then the City is responsible to take care of storm
drainage.
Chairman Ruppenthal assured Mrs. Baldridge that her comments would be included in the minutes of
this meeting and that the City Engineering Department would receive a copy of same which reflects
her concerns.
Mr. Roskom stated this request is just for a land division. As to construction on the property, the
property owners would need to go through the permit process which would include a grading and
drainage plan, if required, being approved by the Department of Public Works.
Mrs. Baldridge inquired if permits are required, would the structures have to stay within the setbacks
of the other homes in the area.
Mr. Roskom stated they will need to meet the minimum setback requirements of the Zoning
Ordinance.
Mrs. Baldridge stated there are no sidewalks at present because of the buildings, but inquired once
the buildings are removed, are sidewalks being proposed.
Chairman Ruppenthal stated the Plan Commission has no control over that issue, but her concern will
be included in the minutes and the Engineering Department will receive a copy of the minutes.
Sharon Weisheipl, 820 Concordia Avenue, expressed concern as the houses on Osborn Avenue are
situated lower than Concordia Avenue and the property owners on Osborn Avenue will be flooded
out.

Chairman Ruppenthal reiterated Mr. Roskom's statement that if there is a City easement, then the
City is responsible to take care of storm drainage. If it is just a catch basin, then it is the property
owner's responsibility. He added he did not know what recourse the City has in that respect. Mr.
Roskom stated he would investigate the matter with the Department of Public Works.
Dawn Wilfahrt, 830 Concordia Avenue, stated drainage in this area has been an issue since 1988.
She is upset because things are being done after she has been told by the Church that they are not
going to be done. She also inquired as to the zoning and stated she would like it to be maintained at
R-1 Single Family Residence.
Mr. Roskom stated that any agreement between the neighbors and the Church is not a City issue.
This request is simply a land division. He also stated there is no proposal to change the zoning.
James Wilfahrt, 830 Concordia Avenue, expressed the same concerns as his wife. He stated
everything the Church said they were not going to do, they have done. The Church has been
housing a school for a year without a permit and they have been in violation of the Zoning Ordinance.
He wants to be informed of where the houses will be located.
Chairman Ruppenthal stated a lot of these issues are outside of what can be addressed by the Plan
Commission. Legally they can ask for repositioning of lot lines and the Plan Commission is not able
to make a decision on those other issues.
Mr. Pressley concurred with Mr. Ruppenthal and added that it is not that the Plan Commission
doesn't care about those concerns, it is simply that the Plan Commission cannot deny the land
division because of those concems.
Motion by Pressley for approval of the lot division with the condition that the existing
shed and barn/carriage house be removed or relocated to a code compliant location, or
variances obtained, prior to placement of approval signatures on the CSM. Seconded
by Gehling. Motion carried 8-0.
IV: PRELIMINARY PLOT -BRISTOL SQUARE SUBDIVIS~nN _ Thomas Rusch and Richard
Gabert, owners; Reinhard Roehlig, petitioner
Reinhard Roehlig, petitioner, on behalf of Thomas Rusch and Richard Gabert, owners, requests the
Plan Commission review and approve a Preliminary Plat known as Bristol Square for property located
north of Norton Avenue, west of Jackson Street, and south of CTH "Y".
Mr. Smith inquired if there was a provision for anorth/south street along the west side of this plat.
Mr. Kinney stated there is not as the prison is located there.
Nancy Daniels, 680 Norton Avenue, inquired if Westem Drive would be running through Lots 6 and 7
of Jackson Height's plat. She inquired what happens to the pine tress and the well that she shares
with the house west of her property.
Mr. Roskom stated Westem Drive has already been dedicated as aright-of--way. He stated although
there is not actually a road constructed there, it is a dedicated right-of--way. As to the shared well
issue, she should check with the Township, as it is a Town road. He further stated the 60 ft. right-of-
way was there when Mrs. Daniels purchased her property and noted a road can be installed by the
Town. at any time on that portion of Westem Drive.
