HomeMy WebLinkAbout0133684-Building (sign) STAFF REPORT BOARD OF APPEALS SEPTEMBER 10, 2008 ITEM III: 605 MERRITT AVENUE GENERAL DESCRIPTION AND BACKGROUND Beck Signs Inc. applicant, St. Mary's Congregation owner, request a variance to permit the placement of an identification sign with a 0' front yard setback. Section 30 -19 (B)(2)(c) of the Oshkosh Municipal Code: Two Family Residence District requires a 25' front yard setback. The subject 2.51 acre (approx. 109,186 sq. ft.) property is zoned R -2 Two Family Residence District and is a campus- setting for Most Blessed Sacrament Parish St. Mary's Site. The irregularly- shaped lot fronts three public streets (i.e. Merritt Avenue to the north, Monroe Street to the west, and Boyd Street to the east) and the general area can be characterized as low to medium density residential neighborhood. ANALYSIS In reviewing a variance request, the following questions should be addressed: When considering an area variance, the question of whether unnecessary hardship or practical difficulty exists is best explained as "whether compliance with the strict letter of the restrictions governing area, set backs, frontage, height, bulk or density would unreasonably prevent the owner from using the property for a permitted purpose or would render conformity with such restrictions unnecessarily burdensome." Are there any unusual or unique physical limitations of the property which create a hardship? Will granting of a variance result in harm to the public interest? The applicant is requesting a variance to construct a new single -sided illuminated ground sign with a 0' front yard setback at the intersection of Merritt Avenue and Monroe Street (see attached site plan). The proposed sign will feature a triangular- shaped identification section as well as a changeable copy section (see attached rendering). According to the petitioner, the sign will be 4' tall and 6' wide overall. The application states an existing identification wall sign will be removed on the north side of the church that is currently only visible from Merritt Avenue. The proposed new sign ground sign would be placed at an angle on the corner of Merritt Avenue and Monroe Street and is needed for better visibility. According to the applicant, the variance would not have an adverse effect on surrounding properties because the proposed sign would not face any residential properties and is not big or bright enough to cause any issues. The applicant has stated that the site is unique and unusual because of the location of pre existing built church structure which limits placement options. The petitioner feels a hardship will ensue if the variance is not granted because the church will be difficult to identify appropriately. Staff concurs with the applicant and feels a unique hardship exists on the property due to the existing built structures limiting the available area to locate a new sign to meet code 1 STAFF REPORT BOARD OF APPEALS ITEM III -2- SEPTEMBER 10, 2008 standards. Staff recognizes the importance of sign identification for institutional uses and feels the proposed location is the least amount of variance needed to functionally place the sign on -site. In terms of alternatives, a single identification wall sign could be placed on a church facade but visibility would be limited (similar to the current arrangement). If the petitioner wanted to place a second identification sign on a separate facade, a variance would be required due to the zoning ordinance restricting institutions to one identification sign. It should also be noted that vision problems are not anticipated with the placement of the sign at its proposed location. Specifically, the sign will be located on an angle near the intersection and the existing church structure is built with a 0' setback as well. Additionally, the sidewalk width on Merritt Avenue is approximately 9' and the sidewalk/terrace width on Monroe Street is approximately 20'. In general, staff does not believe any adverse impact or harm to the public interest would take place by granting the variance request.
