The following is a summary of the Code Violations that must be addressed: 1. Provide the required Make Up Air for the Kitchen Exhaust Hood System. As the enclosed plan requires, which was submitted for review and approval when the Exhaust Hood System was installed, an additional Make Up Air Unit must be provided to offset the amount of air being exhausted by the Exhaust Hood. This unit must be interlocked with the Kitchen Exhaust Hood to operate in conjunction with the Exhaust Hood. This item was addressed several years ago when the Exhaust Hood was first installed. A compliance extension was granted because you were in the process of expanding the restaurant and a request was made to incorporate compliance with construction of the addition. As the addition has not materialized, compliance must now be provided. 2. The Gravel Parking Lot expansion to the south of the paved parking lot must be removed and replaced with top soil and established with a lawn in compliance with the Approved Parking Lot Plan. 3. The remaining materials, junk, debris and unlicensed/inoperable vehicle being stored around the storage building must be removed or stored within the shed. 4. The tractor cannot be stored on this site, unless stored within a storage garage. 5. If you choose to install another Dumpster Enclosure, be advised it must be installed to meet Zoning District Setback requirements and a Building Permit must be obtained prior to construction. In the meantime, dumpsters and refuse containers must continue to be stored on the paved surfaces versus in lawn areas. This office has previously given notice about these code violations. Compliance must be provided so this office may give approval to renew both your Liquor License and Restaurant License. On February 1, 2007, I met with Mr. Martinez to review the outstanding violations and explain that compliance must be provided by June 15th to allow the Liquor and Restaurant Licenses to be renewed. An Inspection on Wednesday, June 27th revealed he has made substantial progress on the parking lot and exterior storage issues (although not completely compliant). However there has been no progress made with making his Kitchen Exhaust System compliant. The Kitchen Exhaust System is the larger issue remaining to be resolved. The Code issue at hand involves their failure to instalUprovide the required Make Up Air to offset the air being exhausted by the new Kitchen Exhaust Hood that was installed in 2000 (initially without the required HVAC Permit.) The following is a chronology on this issue to better explain how this case has transpired. June 2000 Owners obtain a building permit to convert agarage/storage room into a Kitchen Expansion. November 2000 Inspection reveals a Kitchen Exhaust Hood had been installed without submitting plans for review and approval and without securing the required HVAC Permit. Correction Notice sent to owner and HVAC contractor. Owner explains they put their trust in the contractor to properly abide by the rules in the performance of this work. As a result of this discussion, compliance efforts are focused on the contractor. March 2001 Citations issued to HVAC Contractor for failure to submit plans and failure to secure permit (Permit cannot be issued until plans are approved. August 2001 Additional citations issued to HVAC Contractor for continued failure to submit HVAC Plans and secure the required HVAC Permit. October 2001 HVAC Plans are submitted, reviewed and approved and HVAC Permit is issued. Plans show that a Make Up Air Unit is to be installed to balance the HVAC System (meaning that the amount of air exhausted is being balanced by incoming air (make up air.)) The issued HVAC Permit does not include the Make Up Air unit, as that was not included in the contract with the HVAC Contractor. Parts of this chronology are undated, as there are no specific dates associated with the events. A subsequent inspection and discussion with the owners reveals they did not anticipate and were not properly educated by their HVAC Contractor about the need for the Make Up Air unit. They requested an extension for compliance to make arrangements (primarily financial) to comply. This was granted. A follow up to determine efforts toward compliance reveals the owners are actively working on plans to expand their restaurant and a request is made (and granted) to allow them to incorporate compliance with the Make Up Air requirement with this expansion as the expansion will involve alterations to the Kitchen. Recognizing it does not make sense to require compliance with an element that could be removed in the near future as a result of the proposed addition, this request was approved. December 2003 The owners apply and secure Zoning Variances for their proposed addition/expansion. (Indicating that movement is being made toward compliance.) June 2004 A local contractor secures a Building Permit for the expansion. The addition does not materialize. January 2007 While performing a review of several older project files to ascertain status, this file was reviewed. The review reveals that while the plan approval and permit for the addition had expired, there was still the Make Up Air issue to be addressed. February 1, 2007 I met on site with Mr. Martinez to review the outstanding code issues and to explain that they must be corrected by the end of June to allow renewal of the Liquor and Restaurant Licenses. February 5, 2007 Follow up correspondence was sent to Mr. Martinez summarizing our previous meeting. This letter itemizes what has to be corrected as well as providing him with a copy of the previously approved HVAC plan so he may better communicate with HVAC contractors about compliance. Apri13, 2007 A reminder letter is sent as no contact had been made by the owners or any HVAC contractors about the Make Up Air issue. May 2007 A local contractor inquires about what is required for compliance. The plan is reviewed with this contractor. June 27, 2007 An onsite visit reveals significant progress on all items except the Make Up Air. Owners were not onsite. Business card is left with a request to have the owners call to discuss status of compliance efforts. June 28, 2007 A call the HVAC Contractor that inquired in May, reveals he has not yet submitted a bid to the owner. Contractor indicates he thought owner was getting other bids. Says he will visit the owner to give him his bid and inquire of status and get back to me with this information. Mr. Tucker introduced the item and noted that the variance request is similar to variances approved at the Board of Appeals meeting on Apri124, 2002, however because the applicant did not secure a building permit within six months of variance approval it was no longer valid. Architect Steve Clark, 1437 Ceape Avenue, and Mauro Martinez, owner of 2505 Oregon Street, identified themselves. Mr. Clark distributed an updated site plan of the subject property. He said that the reason for positioning the cooler, as indicated on the new site plan, is to allow for convenient accessibility to the restaurant and to make it appear less visible to the street. He added that they intend to put a solid decorative wood fence around the unit. .Chairman Schorse noted that the 3' setback for the cooler would be the same as the 3' setback for the building from Oregon Street. Mr. Wilusz questioned if there was a way to minimize the variance requests and questioned specific hardships that would result due to minimum code compliant setbacks for the parking lot and for moving the cooler further away from the street. He said his intent is to minimize the variance requests and to manage to accommodate the needs of the applicant, which in his opinion are reasonable. Mr. Clark said that the cooler could be moved to a 10' setback without any difficulties, but mentioned the owner's concern that the cooler would be visible to the restaurant patrons. Mr. Clark stated that by reducing the parking space depths from 20' to 18' it would affect the setback by 10' and the proposed addition would lose 5'. There was further discussion on the position and location of the cooler and it was suggested that the footprint of the parking lot be reduced to minimize the variance needed, with the building remaining at 5' from Hughes Street. The applicant and owner indicated that they would be agreeable to a reduced size of the parking spaces and access aisles. ``#beceriilier 23, 2003 .. Mr. Martinez answered that the present cooler is located in the basement and it would be more convenient for kitchen staff and for the delivery of supplies for it to be located at the proposed site. Ms. Hentz asked if the present request, except for the addition of the cooler, was the same as previously requested. Mr. Martinez responded that it was similar. During board discussion the possibility of shifting the cooler closer to the building was mentioned. Mr. Clark noted that City Inspectors would have an issue with the cooler if it was to be closer than 10' to the building, because it would then be considered part of the building, which would require the cooler to comply with all the building codes of an addition to the principal structure. He added that it would be complicated if a firewall was required because of its proximity to the building. There was further discussion on the location of the cooler and the possibility of the cooler being fully screened from the building with fencing. Mr. Tucker noted that there would be a 6' restriction on the height of the proposed fencing in the front yard setback area of Oregon Street, and suggested that the Board consider varying the height restriction for fences to fully screen the cooler. Chairman Schorse stated that the fence would address both the screening issue and provide security for the cooler. Motion by Wilusz to approve a variance to reduce the size of the parking lot to a 10' setback to Hughes Street and an 8' setback to Oregon Street, to approve a variance to allow a 10' setback from Oregon Street to the accessory structure, and to require the accessory structure to have fencing on the east side and the south side to extend to the building and a requirement that the fencing be sufficient to fully screen the unit. OTHER BUSINESS Mr. Tucker noted that the request made at the meeting of December 10, 2003 for a generalized chart regarding parliamentary procedure has been delayed due to the schedule of City Attorney, Warren Kraft, but it will be forth coming. Ms. Hentz asked for her opinions to be on record in regard to Item I, 1000-1240 Cumberland Trail. She said that an applicant is allowed to bring back an issue three times and because there were two previous hearings on the item already it does not mean that there should not be a full third hearing. She added that Mr. Masterson did have additional information to present, and that is why she believes it was necessary to conduct a full third hearing. STAFF REPORT BOARD OF APPEALS DECEMBER 23, 2003 ITEM II: 2505 OREGON STREET GENERAL DESCRIPTION AND BACKGROUND Mauro & Cynthia Martinez, applicants and owners, are requesting a variance to construct anoff-street parking area with a 3 foot setback from Oregon Street and a 5 foot setback from Hughes Street, a variance to permit a principal structure with a 3 foot setback from Oregon Street, a 5 foot setback from Hughes Street, and a variance for an accessory structure to be placed with a 20 foot front yard setback to Oregon Street, whereas Section 30-35(B)(1)(c) of the City of Oshkosh Zoning Ordinance requires a 25' transitional yard setback. along Oregon Street for off-street parking areas , a principal structure, and accessory structures and Section 30-24(B)(3)(c) requires a 20'setback along Hughes Street for a parking lot and principal structure. The general area is characterized by industrial, commercial, and residential land uses. The subject site is zoned C-1, Neighborhood Business District. The subject site is the location of Mario's Mexican Restaurant and Tavern, and an upper floor dwelling unit. A variance for a similar parking lot expansion was previously reviewed and approved, on July 14, 1999, and at its April 24, 2002 meeting, the Board of Appeals approved a similar request for an addition and parking lot expansion. Since the petitioner did not secure a building permit within six months of variance approval, the previous variance approval is no longer valid. ANALYSIS. AND RECOMMENDATION In reviewing a variance request, the following questions should be addressed: Are there any unnecessary hardships present, where in the absence of a variance, no reasonable use can be made of the property? Are there any unusual or unique physical limitations of the property which creates a hardship? Will granting of a variance result in harm to the public interest? As part of a building expansion project, the applicants are requesting variances to expand the existing off-street parking area on the southern portion of the subject site, and what appears to be a detached walk-in cooler south of the building. The petitioners also request reducing the setback requirement for the principal structure, per the attached plan. Since the current building is nonconforming in terms of setback (25 feet is required from Oregon Street and 20 feet is required from Hughes Street), this variance will change the required front yard setback for the building, to make the building compliant. For the new parking area, the applicants are requesting a 5' setback from Hughes Street and a 3' setback from Oregon Street. The site plan also shows the accessory structure (shed) and a new refuse disposal area will be relocated on the site. The property is a unique triangular shaped parcel, with a commercial building located to the north, which pre-dates current setback requirements. The property also serves as a buffer between the manufacturing facility on Hughes Street and the residential land uses east of Oregon Street. ~,' O C1 C IT -2- BOARD OF APPEALS DECEMBER 23, 2003 `'T'he building has a 3' setback along Oregon Street so a 3' setback for the parking would be compatible with the current setback of the building, and consistent with the existing off-street parking lot. Since this parking area is proposed to be angled to Oregon Street, only a small portion of the easternmost part of the parking lot is located in a designated setback. Additionally there are some large trees, which ,;when combined with new landscaping will help mitigate the affect of the parking lot to the neighbors fo the east. In regard to the new portion of the parking lot along Hughes Street, this proposed parking ``~~ lot is across the street from zoned M-2, which requires a 5 foot setback for a parking lot abutting a w~:public street, similar to what is being requested. The parking lot will replace an existing ~` `:nonconforming parking condition along the west side of the property, where any vehicles parked ~~; currently must back out onto Hughes street to exit the property. Providing. the requested off street ~~: parking would appear to be an overall benefit to the general area and would not appear to have an adverse impact on neighboring properties. The implementation of landscaping and screening required by the Ordinance will also help to mitigate any potential adverse impact. It should be noted, however, the parking lot is designed with parking space depths of 20 feet and aisle widths of 25 feet, greater than required (90° parking spaces must be a minimum of 18 feet deep and aisles must be a minimum of 24 feet wide). The petitioners could obtain an additional 10 feet of setback for the lot by meeting the minimum requirements, but rather are choosing to construct a parking. area that is more functional though exceeding the minimum requirements. By requesting the variance for building setback, the applicants are proposing a substandard setback for the principal structure, which would remove the nonconforming structure restrictions outlined in Section 30-4(B)(1)(c), which requires alterations, additions, and expansions to nonconforming structures may not exceed 50% of the current total assessed value of the structure for the lifetime of the structure. The proposed building addition would eliminate the above mentioned vehicle conflicts created by the existing parking next to the building on the west side, which has been in place for many years. Backing onto the street, as is the current condition, is not a desirable condition from a safety standpoint, and would be eliminated by approval of the variance. Additionally, the proposed expansion is on the west side of the lot, fronting towards the industrial use to the west, rather than towards the residential properties on Oregon Street. Locating the addition to the west side of the existing building would be the most reasonable alternative, both to mitigate the impact of the proposed addition on the surrounding properties, and to provide this viable business the opportunity to expand to meet its customer base. In regard to the proposed walk-in cooler on the south side, the petitioner has not demonstrated a reason for support of a setback variance for this structure. The application does not include any information in regard to justification for a setback reduction to permit the placement of this structure. Per a conversation with the petitioner's architect, the walk-in cooler is a freestanding unit, which will be enclosed by a 6' tall fence. It is not known if this cooler is proposed to be screened or simply secured by the fence. If the petitioner can demonstrate the need for a variance for the walk-in cooler, approval of a variance could be justified, however, proper screening should be required for the cooler and associated mechanical equipment. The proposed pipe is shown to have a slope of 0.5%, but the invert elevations for the inlet and outlet of the pipe aze shown as the same (95.25). 11. Please re-check the calculations for the outlet pipes for the ponds in areas 1 &2. • Pond 1: The peak outflow (Existing 10 year) is calculated as 0.48 cfs, and the 100 year pond elevation is calculated as 96.50. According to the culvert design, the headwater depth is 0.57 ft. By adding the headwater depth to the invert elevation of 95.25, the water level in the pond w8uld be 95.82. If the pond reaches the 100 year elevation of 96.50, the outlet pipe will release more flow than what it should be designed for based on the 10 year existing flow (0.48cfs). Pond 2: The peak outflow (Ex l OYR) is calculated as 3.27 cfs, and the 100YR pond elevation is calculated as 96.19. According to the culvert design, the headwater depth is 1.36 ft. By adding the headwater depth to the invert elevation of 95.1, the water level in the pond would be 96.46, which exceeds the designed 100YR pond elevation. Please make the necessary design adjustments so as to meet the flow requirements of the Storm Drainage Ordinance. 12. Identify the overflow elevation for the proposed ponds.
