KINNEY Director Re: Motor Vehicle Salvage Dealer License Application @ 4438 State Road 91 Dear Mr. Donner: You recently dropped a copy of your Motor Vehicle Salvage Dealer Two Year License Application off for zoning review and approval. Please be advised that zoning approval cannot be granted at this time. Specifically, this is due to the subject property currently being zoned M-3 ETZ General Industrial Extraterritorial District and the proposed junk yard use must be conditionally approved by the City of Oshkosh Common Council. The Conditional Use Permitting Process commences with the property owner filing an application for review by the Joint Extraterritorial Zoning Committee. Included with this letter is a copy of the required application form, which outlines specific requirements for review. The Joint Extraterritorial Zoning Committee will hold a hearing on the application and make a recommendation of denial, approval, or approval with conditions to the Common Council. The Common Council will then officially act to deny, approve, or approve with conditions the conditional use permit. If/when the Common Council approves the use at this location, zoning approval for the Motor Vehicle Salvage Dealer Two Year License Application can be granted. City staff will sign the appropriate form needed for your licensure through the Department of Transportation at that time. Also, please be advised that if the conditional use is approved by the Common Council, it will lapse and become void after one year unless substantial construction has been undertaken or the activity has commenced in accordance with the permit. This may or may not affect your development timeline.
