Greetings Bill.
I need your help with a situation at the above address, which is one lot north at the confluence of Main Street, Harrison
Street, and New York Avenue . This lot has double-frontage on N. Main Street and Harrison Street and private property
shrubbery/trees are growing into the sidewalks and obstructing clearance. Attached are photos from yesterday.
A neighbor sent a letter addressed to the City Manager looking for a remedy to the situation. The letter was then
forwarded to me. I checked the property file and both my predecessor (Matt Tucker) and myself have sent correction
notices (10/04 & 07/07) to the property owner citing the violation using provisions from Chapter 25. The owner has
complied with cutting the shrubs back in the past but obviously isn't getting the message that he needs to continually
maintain them. Since this violation isn't falling under Section 30/Zoning I don't have the authority to issue actual fines or
penalties, I can only send notices.
Therefore, since this is the 3rd time we've needed to address this issue, I think it's time for some teeth with enforcement
measures. In my opinion this situation is falling under Section 26-10 Public Nuisance at this point and appropriate
measures need to be taken regarding the abatement process.

I really don't like to complain, but this is dangerous. I Bing this to your
attention for appropriate action. Last summer I tivrote the City Manager about
the same incident aric~; if I remember correctly, I had to write three letters before
any action tivas taken. .~.nd it wasn't even corrected alCthat muc~otivth
tivasn't cut back to a proper distance. It is a danger to the public tivho use the
sidetivaCk; someone couldfaCl into the projecting branches and incur an injury,
even to the eyes, tivhich really could'be dangerous!
the sidetivalks of the property at 1216 forth Main Street, along both Main Street
and 3-Garrison Street, but mostly on ~-fa~°i-ison (along tivhich I and others walk
regularly) are badly overgrown with trees andshrubs. On 3~Garrison Street,
tivaCkers almost literally have to tivalk in the grass on the terrace, tivhich shouldn't
be necessary. Everyone else has to keep their sidetivaCks clear; this should 6e no
exception. I respectfully ask that the grotivth 6e required to 6e cleared dark to a
reasonable distance clear of the sidewalks, especially along 3-Garrison Street,.
north of the detective business on the corner, at the very least to a reasonable
distance into the property and away from the edge of the sidetivalk, not just a
tittle bit like they cfid last time.
If I ma 6e facetious, .the growth there is a great place to learn horticulture,
since there is an amazing variety of tree and shrub species grotiving there alongg
the sidetivalk. It's a terrible nuisance!!! ?'he City ,forester and his cretin should 6e
