Koeller Street; Appleton Sign Co., Petitioner; Landmark Limited Partnership, Owner (Plan Commission Recommendation: Approved) BACKGROUND On June 13, 1995, Council approved Res. 95 -200 approving a conditional use permit for the existing commercial structure (Landmark Plaza) within a planned development area to permit the owners to reposition the existing outside display /planting area of Stein's Garden and create a lot for a filling station. One of the conditions of that approval was that all signs and sign structures comply with the Zoning Ordinance. Appleton Sign Co., on behalf of Landmark Limited Partnership, owner, is requesting an amendment to a previously approved Planned Development at 300 S. Koeller St., known as Landmark Plaza, to allow additional signage on an existing off - premise ground sign and to exceed permitted sign square footage. The applicant is proposing to add 80 sq. ft. of sign area to an existing 1,728 sq. ft. ground sign, for a total of 1,808 sq. ft. of signage whereas 800 sq. ft. is permitted. ANALYSIS Staff feels the request is reasonable given the fact that an additional ground sign could be installed as an alternative and the City has promoted the use of multi- tenant signage whenever possible to reduce the clutter of numerous signs along the Highway 41 corridor. FISCAL IMPACT None anticipated. RECOMMENDATION The Plan Commission approved of this request at its October 7, 2008 meeting. ITEM: CONDITIONAL USE PERMIT /DEVELOPMENT PLAN AMENDMENT FOR ADDITIONAL GROUND SIGNAGE AT THE RETAIL /COMMERCIAL CENTER LOCATED AT 300 SOUTH KOELLER STREET (LANDMARK PLAZA) Plan Commission meeting of October 7, 2008 GENERAL INFORMATION Applicant: Kelli Steffens — Appleton Sign Co. Property Owners: Landmark Limited Partnership III & IV Action(s) Requested: The applicant is requesting an amendment to a previously issued conditional use permit /development plan to allow additional signage on an existing off - premise two -pole pylon sign. The addition will further surpass the area allowed by code so the applicant is also requesting a base standard modification to allow more signage than what is permitted. Applicable Ordinance Provisions: The Zoning Ordinance establishes criteria and guidelines for the establishment and/or amendment of a PD overlay district in Section 30 -33 (A)(1) and Conditional Use Permit in Section 30 -11 (D). Property Location and Background Information: The site is located at the southeast corner of North Koeller Street and Witzel Avenue within the Highway 41 Corridor. The area involves two parcels: a 13.8 acre parcel containing Landmark Plaza Shopping Center, and 1.5 acre parcel containing an office building and the subject communal ground sign utilized by the whole center. Subiect Site Commercial Retail & Service Business C- 2PD/HWY 41 Adiacent Land Use and Zonin North Commercial C -2PD /HWY 41 South Single - Family Residential & Commercial R -2 & C -2/HWY 41 East Two - Family Residential R - 2 West Koeller Street and Hwy 41 C -2 /HWY 41 ANALYSIS The petitioner is requesting an amendment to the existing CUP/PD to receive a base standard modification allowing the installation of additional signage exceeding the maximum allowed on an existing 60 -foot tall off - premise two -pole ground sign. The existing sign located on the office parcel contains 1,728 square feet of signage where 800 square feet is allowed by code. The applicant is proposing to add another 80 square foot cabinet increasing the total size to 1,808 square feet. The additional cabinet space will reduce ground clearance from 16 feet to 12 feet. This reduction is acceptable as the location of the sign does not interfere with traffic vision. The shopping center parcel also contains a single 85 square foot ground sign located by the driveway entrance /exit north of the theater. With the parcel being greater than two acres, this site is allowed a total of 1,600 square feet of ground signage. Staff feels the proposed increase in signage is a reasonable request. Between the two sites, there is a total of 1,813 square feet of signage where 2,400 could be constructed between the two sites independent of each other. Additionally, the owner does have the option of constructing an additional ground sign on the shopping center parcel as the code does not limit the number of ground signs per site as long as size limitations are met. Historically, the City has promoted the use of multi- tenant signage as they reduce the "clutter" of numerous signs along corridors. Also, when looking at the commercial nature of the area, especially the intensity of uses along the highway commercial corridor, staff believes permitting the additional signage will not impact the commercial neighbors and will have a minimal impact on the surrounding properties. RE COMMENDATION /CONDITIONS The Department of Community Development requests a finding that the proposed signage is in keeping with the Planned Development Standards identified in Section 30 -33 (E)(b) and the CUP criteria identified in 30 -11 (D) of the Zoning Ordinance and be approved as requested. The Plan Commission approved of the conditional use permit/development plan amendment as requested. The following is the Plan Commission's discussion on this item. Dennis Schwab, 601 Oregon Street, stated that the height of the sign was not being increased nor were they erecting additional signage, but that they were just requesting to add an additional cabinet to the existing pylon sign. Commission members discussed when the ordinance for signage would be updated and determined that the revisions to it were still in progress. Motion by Propp to approve the conditional use permit /development plan amendment for additional ground signage at 300 South Koeller Street as requested. Seconded by Bowen. Motion carried 6 -0.
