BE IT RESOLVED by the Common Council of the City of Oshkosh that a
conditional use permit for a planned development with base standard modifications for
installation of a 32 sq. ft. wall mounted cabinet sign and 18± sq. ft. electronic message
center sign, per the attached, is hereby approved.

BACKGROUND
Creative Sign Co., on behalf of Sun Seekers by Rosie, proposed tenant, is requesting a conditional use
permit in a planned development area to install a 32 sq. ft. wall mounted cabinet sign and an 18 sq. ft.
electronic message center sign. The Zoning Ordinance permits only one message center sign per
premises which already has been installed at the UW- Oshkosh Credit Union and a Zoning Ordinance
modification is required to permit installation of more than one message center sign on the premises.
The applicant is also requesting that a proposed wall cabinet sign be permitted.
ANALYSIS
The applicant has provided no compelling reason for the City to alter its code requirements relative to
the installation of additional message center signage at this site. During the review of the prior
message center sign, staff had recommended that a single sign be utilized for the site to allow all
businesses in the center to benefit from the signage.
The applicant is also requesting to install a cabinet style sign on the wall fagade facing Wisconsin
Street. The other two wall signs on this fagade are primarily block or channel style signage and
located in the space above the storefront windows. The proposed signage is not consistent in style,
type, or placement of the wall signage at the site.
Given the City's investment in this area and goal of creating or preserving higher quality development
of which signage is an important aspect, staff has recommended denial of both requests.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission denied this request at its October 7, 2008 meeting.
ITEM: CONDITIONAL USE PERMIT /DEVELOPMENT PLAN MODIFICATION
FOR INSTALLATION OF WALL MOUNTED CABINET SIGN AND
ELECTRONIC MESSAGE CENTER AT 50 WISCONSIN STREET
(RADFORD SQUARE)

GENERAL INFORMATION
Applicant: Todd Thomas, Creative Sign Co., Inc. for Sun Seekers by Rosie
Property Owner: D &F Investments of Oshkosh, LLC (condo unit owner)
Action(s) Requested:
CUP/PD approval: Sun Seekers by Rosie is requesting to install a 32.00 square foot wall
mounted cabinet sign and an 18.64 square foot electronic message center sign at their unit at 50
Wisconsin Street in the Radford Square commercial development. The property is zoned with a
planned development overlay for which a CUP was granted in 2001 for the development of
Radford Square.
Under the CUP/PD review, the applicant is requesting approval of two actions related to the
proposed signage.
1) Installation of a message center sign on premises where one is already located for the
credit union. Section 30- 37(2)(f) permits only one message center sign per premises,
thus a base standard modification is requested under the Planned Development.
2) Applicant is requesting that the proposed signage be found consistent with the approved
development which in this case a finding that the signage is consistent with other wall
signage at the site. The original CUP/PD approval for this site included a condition that
all signage be approved by the Department of Community Development. In this case,
staff has made the determination that the proposed signage is not consistent with the
other signage at the site.
Applicable Ordinance Provisions:
Criteria used for Conditional Use Permits are located in Section 30 -11 (D) of the Zoning
Ordinance. Planned Development Overlay District standards are located in Section 30 -33 (E) of
the Zoning Ordinance.
Property Location and Background Information:
The 2.9 -acre subject property is located in the Marion Road/Pearl Avenue Redevelopment Area
and was the first commercial redevelopment to occur in the district. The subject property contains
two structures, a 20,000 square foot commercial strip center structure with six units and a separate
restaurant building. Sun Seekers will occupy two units, both 40 & 50 Wisconsin Street. In 2006,
the University of Wisconsin Credit Union received approval for the installation of a 36 foot
electronic message center located in the west elevation of the strip center.

ANALYSIS
Relative to the installation of a message center sign, the applicant is requesting the addition of
another such sign at the site where the ordinance prohibits more than one sign per premises due to
the existing message center sign at the site for the UW Oshkosh Credit Union. Staff was
previously concerned that the addition of one such sign at the site would lead to other similar
requests, which is now occurring and could potentially lead to three more such requests at this site.
At the time of the previous review, staff had recommended a common center sign for the entire
development thus eliminating the potential for numerous requests.
The following is excerpted from the previous 2006 staff report for the credit union message center
sign request, which staff feels is still relevant.
In terms of adding message center signage at this site, staff is concerned about the overall
impact that a message center sign will have on the aesthetic quality of the development and
the precedence it may create for others to request additional message center signage for
their storefronts. From a site development perspective, staff would be more comfortable
with permitting one message center sign for the site and possibly incorporating that into
one of the main ground signs so all tenants may utilize the message center.
When the ordinance was written, there was a concern in part that the proliferation of such signage
would have a negative aesthetic impact thus a compromise was instituted in the ordinance by
permitting one such sign per premises. More importantly, permitting more than one message
center sign at this site may set the precedence for all other commercial strip centers to request
message center signs for each of their tenants as well.
Relative to the consistency of the request with signage at the development, the applicant is
requesting to install a cabinet wall sign on the building facade between two windows. Staff's

interpretation is that the proposed signage is not consistent and would not be permitted without
Plan Commission and Council approval.
Included with this staff report are pictures of the other wall signage at the site. The pictures show
that the credit union sign is a combination cabinet /message center sign which is located in an
architectural feature (dormer) and is at or above the level of the other signage. The other flat sign
is a cut sign for Big Apple Bagels and again is located in the dormer. The other two wall signs for
Bangkok Thai Cuisine and Jimmy John's are predominantly channel letters that does include
cabinet elements so they are consistent in appearance with one another. Additionally, both signs
are located in the area above the windows for the storefronts.
The proposed Sun Seekers sign is entirely a cabinet sign and is not located above the windows as
the other wall signage. It is located on the wall fagade between the two storefront windows. Aside
from the message center sign, staff could support a channel letter sign for Sun Seekers with a
smaller cabinet element for the "by Rosie" and located above a window like the other two wall
signs.
RECOMMENDATION /CONDITION S
The Department of Community Development recommends the CUP/PD request be denied for both
the message center sign and the cabinet type wall sign.
The Plan Commission denied the conditional use permit/planned development modification as
requested. The following is the Plan Commission's discussion on this item.
Mr. Burich presented photos of the site and reviewed the various other signage on the building.
He commented that when the message center sign was approved for the credit union, it was
suggested at that time that a central message center sign would be more beneficial as it could be
utilized by all the tenants in the development as only one is allowed on the premises.
Todd Thomas, Creative Sign Company, 505 Lawrence Drive, DePere, discussed some of the other
locations of Sun Seekers and their related signage. He felt the sign would be distorted in channel
letter format and stated that it would be identical to the signage on the credit union. They would
be opening for business soon and would like wall signage of some sort approved. He commented
that the sign could be dimmed in evening hours and it would be used for other community
purposes and not just for self promotion. As they occupy two units, they would prefer to have the
sign in between the units rather than over the door like the other tenants in the strip center.
Dan Nesbitt, 500 E. Vine Court, Sturgeon Bay, stated that they liked the credit union sign and
needed to get the message out to the community that they were in the area. They are leasing two
spaces so they did not feel that the wall signage in between the units was inappropriate.
Dennis Schwab stated that he was in support of this request.
Commission members discussed the signage options for the site and concluded that although the
sign was attractive, that substantial funds have been invested in the development and the message
board sign was objectionable. All the other signs on the structure are over the doors and this
would be the first full wall cabinet sign as well. Commission members determined that variations

to the sign would be acceptable and the signage on the strip center should be consistent. Allowing
this change would delude the standards of the planned development and signage over the doors
like the other businesses had would be preferred.
Motion by Borsuk to approve the conditional use permit /development plan modification for
installation of wall mounted cabinet sign and electronic message center at 50 Wisconsin
Street.
Seconded by Propp. Motion denied 0 -6.

RE: Sunseekers Tanning Salon
On behalf of Sunseekers Tanning Salon I have applied for a conditional use permit for
new signage. I would like to present the following comments from the owners,
management of Sunseekers & Creative Sign Company for your review regarding the
proposed signage.
Our intention is to use this electronic message center in a variety of way to promote our
business as well as providing the community w/ announcements of upcoming events,
Amber alerts. We have realized that the electronic board will enable us to offer specials
to customers who pass by our area. Effective advertising is what will make us a success
& long time member of the Oshkosh community.
Electronic message centers have been around along time, they can be manually adjusted
for brightness. They are also equipped w/ a photo eye which dims the sign down during
dusk & night time. They also have the capability to schedule our marketing a year in
advance if we choose.
For businesses that choose to enhance their signage w/ a electronic message center can
see a significant increase in sales of 15% to 150 %. Having a successful business adds tax
dollars to the community.
