CITY ADMINISTRATION
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH REPEALING SECTION 2-39 OF
THE CITY OF OSHKOSH MUNICIPAL CODE PERTAINING TO THE CABLE TV
ADVISORY COMMISSION
WHEREAS, the State of Wisconsin passed legislation effective January 9, 2008
which makes the State Department of Financial Institutions the exclusive franchising
authority for video service providers in the State of Wisconsin; and
WHEREAS, the City of Oshkosh had an existing franchise agreement with Time
Warner Entertainment Company, LP and operated under a Cable Communications
Regulatory Ordinance (Chapter 31 of the City of Oshkosh Municipal Code); and
WHEREAS, the legislation phases out existing municipal franchising agreements by
providing for their termination upon grant of a state franchise; and
WHEREAS, Time Warner has been granted an interim certificate from the
Department of Financial Institutions for a statewide franchise including the City of Oshkosh
within its service area; and
WHEREAS, the function of the Cable TV Advisory Commission was to oversee the
Cable Franchise Ordinance and its implementation.
The Common Council of the City of Oshkosh does ordain as follows:
SECTION 1. That Section 2-39 of the Oshkosh Municipal Code pertaining to the
Cable TV Advisory Commission is hereby repealed .
SECTION 2. This ordinance shall be in full force and effect from and after its
passage and publication.

SECTION 3. Publication Notice.
Please take notice that the City of Oshkosh enacted ordinance #08-376 REPEAL
CABLE TV ADVISORY COMMISSION, on September 23, 2008. The ordinance repeals
the ordinance related to the Cable TV Advisory Commission.
