HomeMy WebLinkAbout08-250JULY 22, 2008 08-250 ORDINANCE FIRST READING (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: AUTHORIZE USE OF NEIGHBORHOOD ELECTRIC VEHICLES INITIATED BY: COUNCIL MEMBER MCHUGH A GENERAL ORDINANCE OF THE CITY OF OSHKOSH CREATING SECTION 27-8.2 PERTAINING TO THE USE OF NEIGHBORHOOD ELECTRIC VEHICLES WHEREAS, under §349.26 of the Wisconsin Statutes, the State of Wisconsin has given municipalities the authority to allow the use of neighborhood electric vehicles on roadways with speed limits of 35 miles per hour or less within the municipality's jurisdiction. NOW, THEREFORE, the Common Council of the City of Oshkosh does ordain as follows: SECTION 1. That Section 27-8.2 of the Oshkosh Municipal Code pertaining to the use of Neighborhood Electric Vehicles is hereby created to read as follows: 27-8.2.1 NEIGHBORHOOD ELECTRIC VEHICLES (A) "Neighborhood Electric Vehicle" ("NEV") means Neighborhood Electric Vehicle as defined in section 340.01(36r) of the Wisconsin Statutes and currently registered and licensed by the Wisconsin Department of Transportation. (B) Individuals may operate an NEV on any street within the jurisdictional limits of the City of Oshkosh that has a posted speed limits of 35 miles per hour or less including connecting highways and state trunk highways within the City of Oshkosh. (C) The operation of NEV's shall comply with all traffic statutes and ordinances applicable to vehicles travelling upon streets and highways in the City of Oshkosh. (D) Any person operating an NEV within the jurisdictional limits of City of Oshkosh shall hold a valid Wisconsin Driver's license. SECTION 2. This ordinance shall be in full force and effect from and after its passage and publication, except those provisions applicable to connecting highways or state trunk highways shall be in full force and effect from and after passage and publication and approval by the Department of Transportation as provided in §349.26 Wis. Stats.
