HomeMy WebLinkAbout08-214ORIGINAL RESOLUTION PRESENTED TO COUNCIL-SEE 08-214A / 08-2146 FOR ACTIONS JUNE 24, 2008 08-214 RESOLUTION (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: GRANT CONDITIONAL USE PERMITS; APPROVE PLANNED DEVELOPMENT: A) 126 WEST 6TH AVENUE, 102 WEST 5TH AVENUE AND 501 SOUTH MAIN STREET B) 2127 JACKSON STREET INITIATED BY: A) RIVERFRONT DEVELOPMENT LLC B) KWIK TRIP INC PLAN COMMISSION RECOMMENDATION: Approved with conditions as noted BE IT RESOLVED by the Common Council of the City of Oshkosh that conditional use permits are hereby granted for the following properties under Section 30-11 of the Oshkosh Zoning Ordinance, and that said permits are granted with conditions, if any, as noted for each respective property, and the Planned District Overlay and development plans, per the attached exhibits, are hereby approved. A) 126 W. 6th Ave., 102 W. 5th Ave. and 501 S. Main St.; Riverfront Development A conditional use permit approving the overall development plan for Sweetwater Performance Center for expansion of an existing marina use, to include but not limited to, construction of a yacht club and associated amenities, and the continued use of the property for boat maintenance, boat storage, boat sales, and general offices, per the attached "Exhibit A", with the following conditions: 1) The setback of the new surface parking area along the west property line be a minimum of 5 ft. with landscaping per the landscaping perimeter requirements. 2) Internal and aisle end landscape islands be installed in all new parking lot areas. 3) The four parking spaces adjacent to the yacht club and in the right-of-way be eliminated. 4) Approval of a landscape plan by the Department of Community Development. 5) Approval of a grading and drainage plan by the Department of Public Works for all new imperious surface areas. 6) Provision of easement for public riverwalk per the guidelines of the adopted Fox River Corridor Riverwalk Plan and Design Guidelines. B) 2127 Jackson St.; Kwik Trip Inc A conditional use permit for development of a Kwik Trip automobile service and retail establishment, car wash and associated site improvements, per the attached "Exhibit B", with the following conditions: 1) Properties are divided/combined into a single parcel. 2) Cross access easements/agreements between the subject lot and future lot to the north are provided. 3) Driveway sizes and design are adjusted to meet code standards. 4) Access control variance is received for driveway locations. 5) Pedestrian connections are established from the retail building to the public walk. 6) Car wash hours of operation be limited to 7 am to 10 pm.
