PURPOSE: AFFIRM DECLARATION OF EMERGENCY
INITIATED BY: CITY ADMINISTRATION
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AFFIRMING THE
DECLARATION OF A STATE OF EMERGENCY FOR THE CITY OF OSHKOSH
FROM THE PERIOD BEGINNING ON JUNE 6, 2008
Whereas, heavy rains occurring in the City of Oshkosh during the period from
June 6, 2008 through June 13, 2008 have caused damage and pose a continuing and
substantial threat to public order, and a threat to the life, health and safety of the
citizens of the City of Oshkosh; and
Whereas, the Common Council was unable to meet with promptness to address
the effects of the storm immediately; and
Whereas, pursuant to the authority granted under the provisions of the Oshkosh
Municipal Code, Chapter 9, Emergency and Disaster Planning and Response, the
Acting City Manager for the City of Oshkosh declared an emergency covering the entire
City of Oshkosh; and
Whereas, the Common Council for the City of Oshkosh, pursuant to the authority
granted under the provisions of the Oshkosh Municipal Code, Chapter 9, Emergency
and Disaster Planning and Response, hereby affirms this declaration of a State of
Emergency covering the entire City of Oshkosh and directs as follows:
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that:
Pursuant to the authority provided in Chapter 9 of the Oshkosh Municipal Code,
the City Manager and Emergency Management Coordinator are hereby authorized and
directed to issue all such orders necessary to protect public life, health and safety
including, but not limited to, the following duties:

1. Utilize all available resources of City government as reasonably necessary to
cope with the emergency.
2. Transfer the direction, personnel or functions of City Departments or units thereof
for purposes of facilitating or performing emergency services as necessary or
desirable;
3. Compel performance by elected and appointed City government officials and
employees of the duties and functions assigned in the City of Oshkosh
Emergency Operations Plan;
4. Contract, requisition and compensate for goods and services from private
sources;
5. Direct and compel evacuation under order of the governor for the State, of all or
part of the population from any stricken or threatened area within the City if such
action is deemed necessary for preservation of life or other disaster mitigation,
response or recovery;
6. Prescribe routes, modes of transportation and destinations in connection with
evacuation;
7. Control ingress and egress to and from a disaster area, the movement of
persons within the area and the occupancy of premises therein.
8. Make provisions for the availability and use of temporary housing;
9. Suspend or limit non - emergency activities and prohibit public assemblies.
THIS AFFIRMATION OF THE DECLARATION OF A STATE OF EMERGENCY,
attached hereto is enacted this 24th day of June, 2008 and shall continue until the end
of the incident period as determined by FEMA.

ORDINANCE DECLARING A STATE OF EMERGENCY FOR THE CITY OF
OSHKOSH
Whereas, heavy rains occurring in the City during the period from June 6, 2008 through June
13 2008 and projected to continue through the next several days have caused damage and
interfered with the use of roadways, and pose a continuing and substantial threat to public order,
and a threat to the life, health and safety of the citizens of the City of Oshkosh; and
Whereas, the Common Council is unable to meet with promptness to address the effects of the
storms immediately; and
Now, therefore, pursuant to the authority granted to the City Manager under the provisions of the
Oshkosh Municipal Code, Chapter 9, Emergency and Disaster Planning and Response, the
Acting City Manager for the City of Oshkosh, John M. Fitzpatrick, hereby declares a State of
Emergency and directs as follows:
Pursuant to the authority provided in Chapter 9 of the Oshkosh Municipal Code, the City
Manager and Emergency Management Coordinator, in addition to all general and executive
emergency powers, shall issue all such orders as they deem necessary to protect public life,
health and safety including, but not limited to, carrying out the following duties:

the area and the occupancy of premises therein, to bar, restrict, or remove all unnecessary
traffic, both vehicular and pedestrian from all local highways;
8. Make provisions for the availability and use of temporary housing;
9. Suspend or limit non - emergency activities and prohibit public assemblies.

This period of emergency shall be limited to the time during which the emergency conditions
exist or are likely to exist.
THIS DECLARATION OF A STATE OF EMERGENCY enacted this 12th day of June,
2008.
