HomeMy WebLinkAbout08-177MAY 27, 2008 08 -177 RESOLUTION (CARRIED 7 -0 LOST LAID OVER WITHDRAWN ) PURPOSE: GRANT CONDITIONAL USE PERMITS; APPROVE PLANNED DEVELOPMENT: A) 1585 SOUTH OAKWOOD ROAD B) 1735 BOWEN STREET INITIATED BY: A) LIVING WATER LUTHERAN CHURCH, OWNER B) BARRY HAESE, PETITIONER PLAN COMMISSION RECOMMENDATION: Approved with conditions as noted BE IT RESOLVED by the Common Council of the City of Oshkosh that conditional use permits are hereby granted for the following properties under Section 30 -11 of the Oshkosh Zoning Ordinance, and that said permits are granted with conditions, if any, as noted for each respective property, and the Planned District Overlay and development plans, per the attached exhibits, are hereby approved. A) 1585 S. Oakwood Road; Living Water Lutheran Church A conditional use permit to construct a church and associated site improvements, including but not limited to, an after school daycare, per the attached "Exhibit A ", with the following conditions: 1) Detention basin to be designed without rip rap above the water line and native plants to be plated on the side slopes of the basin and emergent plants on the safety shelf with final design to be approved by the Dept. of Community Development and Dept. of Public Works. 2) Attachment to the City of the Town of Algoma portion of the development. B) 1735 Bowen Street; Barry Haese, petitioner A conditional use permit for the planned development of an automobile sales facility, per the attached "Exhibit B ", with the following conditions: 1) No outside storage of junked or inoperable vehicles or parts. 2) Repair and maintenance of automobiles is limited to vehicles being made ready for sale on the site. 3) Approval of a landscape plan by the Dept. of Community Development. );iiBIf .A: LM ENGINEERING INC.. Barry Haese of Alliance Motors is proposing to occupy and utilize an existing property at the comer of Bowen and Murdock Streets that has remained vacant for several years. While the property has been marketed for a larger retail development, we feel that the highest and best use today is that of a small automobile dealership. Alliance Motors will be relocating from Sawyer Street and the site of the new Morton's Pharmacy. They have demonstrated the ability and experience to operate such a facility in a quality manner and have proven to be good neighbors. The company plans to employ 2 -4 employees and plan to be open from 9:00am to 6:00pm M -F and from 10:00am to 100pm on Saturdays and closed Sundays. The use is compatible with the surrounding uses and the existing building, formerly a 3 -bay service center / gas station, is ideal for an auto sales lot with light service. The existing structure will require some minor maintenance, but for the most part will remain the same. The existing asphalt lot will be patched and repaired and the existing gravel areas (from removal of gas tanks) will be paved with new asphalt paving. The two access drives closest to the corner have already been closed and the asphalt pavement in those areas will be replaced with landscaped areas. A formal landscape plan will be provided consistent with zoning ordinances.
