PLAN COMMISSION STAFF REPORT MAY 20, 2008 ITEM III: CONDITIONAL USE PERMIT/PLANNED DEVELOPMENT REVIEW 126 WEST 6 AVENUE, 102 WEST 5 AVENUE, AND 501 S. MAIN STREET (Sweetwater Performance Center) GENERAL INFORMATION Applicant: Ganther Construction and Architecture Property Owners: Riverfront Development LLC Action(s) Requested: Conditional Use Permit/Planned Development review for uses at the "Sweetwater Performance Center" that will include the development of a yacht club. Sweetwater Performance Center is a general marina operation that is being expanded to include the proposed yacht club. A finding will be requested that the proposed use and marina are consistent with the South Shore Redevelopment Plan. Applicable Ordinance Provisions: Conditional Use Permit standards are found in Section 30-11 (D) of the Zoning Ordinance. Planned Development standards are found in Section 30-33 (E)(3)(b). Property Location and Background Information: The subject property is comprised of three properties encompassing approximately 5.6 acres. The development contains 5 buildings housing a variety of uses including boat maintenance, boat storage, boat sales, and general offices. Com rehensive Plan Land .Use Recommendation -- --- Land Use 10 Year Land Use Recommendation Mixed Downtown 20 Year Land Use Recommendation Mixed Downtown ANAi.Y~i~ The applicant is proposing to expand the marina use at the site to include a yacht club and will include a bar, restaurant, and locker room facility. The yacht club will be developed in the existing 16,345 square foot former T & J office/factory at 102 W. 5th Avenue. The yacht club will be 8,821 square feet in area and created through demolition of approximately 50% of the existing structure, which is constructed of a combination of brick, concrete blocks, and metal siding. Additionally, a large outdoor patio will be created on an existing foundation and slab where the structure has been removed. Surface areas where the building was razed to create the yacht club will be surface parking stalls. The site plan shows a parking stall layout for approximately 168 spaces to be used for both cars and boats. From a use standpoint, a marina with a yacht club in this area is appropriate and in keeping with the South Shore Redevelopment Plan as well as the Comprehensive Plan. All of the buildings on the site are existing and other than the adaptive reuse of the former T&J office building and surface parking no other substantial site improvements have been proposed other than landscaping throughout the site. The site plan has been developed to account for future construction of the riverwalk with no encroachments into that area. Sweetwater has cooperated with the City's surveying of the area for the riverwalk and as such a condition is recommended requiring Sweetwater's cooperation in providing the riverwalk easement (see attached map illustrating riverwalk from adopted Plan). Staff has no significant concerns with the proposed use or site plan other than a few minor modifications that are intended to bring the new parking areas into conformance with the new parking regulations concerning landscaping. 1. The proposed new parking area along the west property line should be setback a minimum of 5 feet with landscaping to be installed per parking lot perimeter requirements. This will help to soften the impact of the new parking on what will be a future redevelopment of the JeldWen property. 2. No internal landscape or aisle end landscape islands are shown in the new parking areas. Installing landscape islands in these areas per the new parking regulations will help to soften the impact of the surface parking lot and is also consistent with the new parking regulations. 3. There are 4 surface parking stalls adjacent to the yacht club that are partially within the City right-of--way (partially vacated Nebraska Street) that need to be removed until that area is vacated. RECOMMENDATION/CONDITIONS Staff is requesting a finding that the proposed marina use is consistent with the South Shore Redevelopment Project Plan and the Conditional Use Permit/Planned Development be approved as proposed with the following conditions: Item III - Sweetwater CUP 1. The setback of the new surface parking area along the west property line be a minimum of 5 feet with landscaping per the landscaping perimeter requirements. 2. Internal and aisle end landscape islands be installed in all new parking lot areas. 3. The four parking spaces adjacent to the yacht club and in the right-of--way be eliminated. 4. Approval of a landscape plan by the Department of Community Development. 5. Approval of a grading and drainage plan by the Department of Public Works for all new imperious surface areas. 6. Provision of easement for public riverwalk per the guidelines of the adopted Fox River Corridor Riverwalk Plan and Design Guidelines.
