EASEMENT FOR INGRESS AND EGRESS
WHEREAS, Charles H. Green II is the owner of the property known as 140 W. 9th Street, Oshkosh, Wisconsin, and
said property has a legal description as follows:
Lot 12, in Block 9, being a part of the ORIGINAL THIRD WARD, in the Ninth Ward, City of Oshkosh, pet Leach's
Map of 1894, and now in the Third Ward of said City, except the N18 feet , of the W13 feet thereof.
WHEREAS, Richard L. Christi, is the owner of the property known as 148 W. 9th Street, Oshkosh, Wisconsin, and
said property has a legal description as follows:
Lot 11 of Block 9, in the ORIGINAL THIRD WARD, per Leach's Map of 1894, except the N18 feet of said Lot.
WHEREAS, Charles H. Green II has agreed to give to Richard L. Christi, an easement far ingress and egress
purposes over a portion of the property that he owns as legally described above;
WHEREAS, This easement for ingress/egress is a condition for approval of a variance approved by the City of
Oshkosh Board of Appeals on March 8, 2000, said variance to become effective only upon the recording of this document in the
Office of the Winnebago County Registry and/or fulfillment of any other conditions for approval, whichever occurs later.
NOW THEREFORE, it is hereby agreed by and between the parties as follows:
1. That Richard L. Christi shall have an easement for purposes of ingress and egress, over the property owned by
Charles H. Green II, more particularly described as follows:
The Southerly 27 feet of the Westerly 20 feet of Lot 12, except the Northerly 18 feet of the Westerly 13 feet of Block
9, in the ORIGINAL THIRD WARD, per Leach's Map of 1894.
2. That this grant of easement shall be for purposes of ingress and egress only and shall run to Richard L. Christi, or
the owner of the following described property, or his heirs, successors, or assigns forever:
Lot 12 of Block 9, except the N18 feet thereof, located in the ORIGINAL THIRD WARD, per Leach's Map of 1894.
3. That all maintenance to the easement area shall be done at the sole expense of Richard L. Christi.
4. That Richard L. Christi agrees to permit Charles H. Green II or his heirs or assigns forever to park one car on the
land that this easement is benefiting.
5. The parties agree that there shall be no obstructions, parking or other impediment placed upon the easement area
that would in any way interfere with the orderly ingress and egress from 9th Street to the parking lot area of the property now
owned by Richard L. Christi.
6. This easement shall not terminate unless prior written notice is provided by first class mail to the City of Oshkosh
Department of Community Development, or successor agency, at its then current business address, thereupon the above
described variance shall become null and void as a condition recedent for its approval will no longer be in effect.
