HomeMy WebLinkAboutResolution 08-157BMAY 13, 2008 08 -157B RESOLUTION (CARRIED 6 -1 LOST LAID OVER WITHDRAWN ) PURPOSE: GRANT CONDITIONAL USE PERMITS; APPROVE PLANNED DEVELOPMENT: B) WOODLAND AVENUE AREA INITIATED BY: B) UNIVERSITY OF WISCONSIN - OSHKOSH PLAN COMMISSION RECOMMENDATION: Approved with conditions as noted BE IT RESOLVED by the Common Council of the City of Oshkosh that conditional use permits are hereby granted for the following properties under Section 30 -11 of the Oshkosh Zoning Ordinance, and that said permits are granted with conditions, if any, as noted for each respective property, and the Planned District Overlay and development plans, per the attached exhibits, are hereby approved. B) Woodland Avenue Area; UW- Oshkosh A conditional use permit for the planned development of a parking lot along vacated Woodland Avenue between Algoma Boulevard. and Elmwood Avenue, per the attached "Exhibit B ", is hereby approved with the following conditions: 1) The University shall combine the two subject properties to create one contiguous parcel. 2) Include an internal landscape island within the 31 stall section located adjacent to Elmwood Avenue and an island within the 22 stall section located adjacent to Algoma Boulevard. EXHIBIT B CONDITIONAL USE PERMIT APPLICATION University of Wisconsin. Oshkosh 4/7/2008 Woodland Avenue Parking Lot Development 1. Health safety, and general welfare of occupants of surround lands. There should be no adverse effect to occupants in the surrounding area. 2. Pedestrian and vehicular circulation and safety. The proposed lot expansion /development will improve the safety for our students and staff as there will no longer be thru - traffic allowed down the vacated street. The foot traffic across former Woodland is extensive as students with majors in the arts come and go from the Arts & Communication Center on the north side of former Woodland Avenue. This was• always a significant safety concern when this portion of Woodland was an operating city street. While the traffic flow. has decreased since it became a university parking lot, the elimination of thru traffic will provide the safest situation. 3. Noise, air, water, or other forms of environmental pollution. This vacated street has been used as a parking lot for the past 2 years with no detrimental effect to the environment. Changing the area to a parking lot actually reduced the number of cars traveling through the area, reducing the amount of noise and air pollution. The majority of the cars will enter the larger lot from Algoma Blvd, which is interior to the campus, thus further reducing the noise impact to the surround residential neighborhood to the east. 4. The demand for and availability of public services and facilities. This is a private university parking lot and therefore does not place any additional demand on the city and other entities for public services and facilities. The lot is maintained by the university for upkeep and snow removal etc. 5. Character and future development of the area. The extension of the pedestrian mall to Arts & Communication, across former Woodland, will be an inviting and attractive feature. The continuation of the campus mall, new style lighting, paving brick etc. will make this area finally feel like it is part of the campus. It has always felt segregated from the main campus. We do not anticipate any new buildings in this area as it is fully developed. Our hope is, in the near future, to develop the north terminus of the campus mall, at Arts & Communication, into a more attractive and useable gathering space for classes or small social gatherings associated with the music hall, art gallery or theatre. That development would only enhance the area. Page 1 of 2 EXHIBIT B coned Woodland Avenue Parkine Lot - Narrative of proposed c onditional use and project. The University of Wisconsin Oshkosh proposes to create two adjoining parking lots totaling eighty -three (83) spaces from what is currently a one block section of vacated Woodland Avenue, between Algoma Boulevard and Elmwood Avenue. The subject section of Woodland Avenue was vacated to the University by the City of Oshkosh in 2006 and is currently used for campus parking (total of twenty -eight parking spaces). The project will develop the area into two separate parking lots with an extension of the main campus pedestrian mall, running north/south through the middle of the property. The project will create seventy -eight regular spaces and five handicapped parking spaces for a total of eighty -three spaces. The project encompasses a total of 51,730 square feet, or 1.19 acres of development. The proposed project is surrounded by university owned lands on the north, south and west. A residential neighborhood of rental and owner - occupied properties is located to the east. The lots will accommodate commuter vehicles during the hours of approximately 7:00 am. to 10:00 p.m. It is not anticipated that the creation of the parking lots will subject the adjoining property to any negative change in noise, glare, odor or fumes. The proposed land use is compatible with the surrounding properties in the area and it addresses much needed parking for the university. While the proposed use of the property will create fifty -five additional parking spaces over that which currently exist, the area will be split into two separate parking lots that will mitigate much of the effect of additional traffic to the area. Creation of the additional parking spaces will also reduce the demand for on- street commuter parking in the adjoining residential neighborhood. Currently, vehicles can pass through from Elmwood Avenue to access Algoma Boulevard. After completion of the proposed project, this pass through capability will be eliminated, except for emergency vehicles.
