OSHKOSH (� pARA MDIC AMBULANCE STANDBY 2008 World Wresting Event � A b TIES AGREEMENT made and entered into thus day of Fes, 2 009, Y an8 between, Allan Ackerman, UWO herreinafter called "UW O ", and the Qty of Oshkosh, a corporation, hereit►a#ter called " CITyll. WSEREAS, U'w0 has requested tho CITY provide a dedicated paramedic ambulance for standby, during s =lffed hours for the World Wrestling Event to be bald at the Kolf Sport Center and WEEREAS, the Common Council for the City of Oshkosh has audlorized the appropriate City officials to enter into such an agreement. NOW, TBEREFORE, it is agreed by and between the parties to this W%ne% thatthe CITY shall provide one (1) two - person paramedic ambulance to be presgot at the Kolt Sport CauW during the World Wrestling Event on Saturday, March S from 6:00 p.m. to 10:00 p.m. The paramedic unit shall be primarily responsible for providing first aid and response to medical emergencies. IT IS FURTHER AGREED that UWO shall pay $70 per hour forthe ambulance. Billed time will commence 30 minutes prior to the start of stand -by and end 30 rninutas after the termination of stand -by. Any additional hours requested or required to provide adequate service in the sole opinion ofthd D* Chieffor the Ciry of Oshkosh Fire Department, shall be added to the preschoduled stand- by hours and billed at the same hourly rate, If'for any reason the event is cancelled, a throo (3) hour minimum will be charged if the event is not cancelled at least twelve (12) hours before the scheduled Start time. ft -event cancolletions shall be made by calling (920) 236 -5240 between 8:00 a.m. and 4:30 p.m. Monday through Friday or (920) 236 -5271 at other tunes. The CITY shall Invoice UWO Stadium Budget, c/o Susic Gustke, 800 Algoma F3lvd., Oshkosh, WI 54901 following each event, with payment to be made within 30 days of receipt of Invoice. Failure to timely pay at invoice shall be a breach of this agreement. All patients requiring Iramsport by the Oshkosh FireDepartment ambit wwc will be billed for services rendered according to the CITY's usual and cumtomary procedures and rates for service. Consistent with the Statutes of the State of Wisco:asb i, each party to This contract agrees to assume liability for the wrongful acts or omissions of its employees or agents whild they are ffinctioning within the scope of th& employment or agency, and hold the other harmless for such liability. The Board of Regents for tho Uhivorsity of Wisconsin System agrees to provide liability protection for its officers, employees and agents while acting within the scope oftheir employment. Stats. Similarly, the City of Oshkosh agrees to hold harmless the University, and all its officers, employees And agOts from any arid all liability, inalu&gclaims, demands, losses, costa, damages and axpensea of every kind and description or damages to persons or property a JoW out of or in connection with or occurring durinS the course of this agreement, where ouch liability is founded upon or grows oat of the acts or omissions of employees, officers, or agents ofthe City of Oshkosh while acting within the scope of their employment where protection is afforded by ss. 893,80 and 895A6(1) Wis, Stats, UWO and the CITY shall have the right to terminate this agreement without cause upon 10 days prior written notice to the other party.
