PURPOSE: DISALLOWANCE OF CLAIM FOR EXCESSIVE ASSESSMENT/
JAMES H. LANG PROPERTIES, INC.
INITIATED BY: LEGAL DEPARTMENT
WHEREAS, pursuant to §74.37 Wis. Stats., Dempsey, Williamson, Kelly & Hertel,
LLP on behalf of James H. Lang Properties, Inc. filed a claim for excessive assessment on
real estate that it owns at 834 N. Main Street, Oshkosh; and
WHEREAS, upon further review of the documentation filed with the Claim, the
Assessor believes that the original assessment affirmed by the 2007 Board of Review is
correct and recommends that this claim be denied.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are hereby authorized and directed to disallow the
following claim against the City of Oshkosh:

On behalf of James H. Lang Properties, Inc.
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to inform the
claimant by certified mail of the disallowance, which shall include this statement:
The claimant may commence an action in Winnebago County Circuit Court
to recover the amount of the claim not allowed. This action shall be
commenced within 90 days after the claimant receives notice by registered
or certified mail that the claim is disallowed, pursuant to §74.37(3)(d).
