HomeMy WebLinkAboutMinutes BOARD OF APPEALS MINUTES FEBRUARY 13, 2008 PRESENT: Dan Carpenter, Robert Cornell, Edward Wilusz, Cheryl Hentz EXCUSED: Dennis Penney, Mark Nielsen, Moss Ruedinger STAFF: Todd Muehrer, Associate Planner/Zoning Administrator; Karin Gehrke, Recording Secretary Chairperson Hentz called the meeting to order at 3:30 p.m. Roll call was taken and a quorum declared present. The minutes of January 9, 2008 were approved as distributed. Cornell/Wilusz 4-0. ITEM I: 400 N. SAWYER ST. Joan Mueller-applicant, Zion Evangelical Lutheran Church-owner, request a variance to permit an off-street parking area with a 0’transitional yard setback. Section 30-35 (B)(1)(c) of the Oshkosh Municipal Code: Additional Standards and Exceptions requires a 25’ transitional yard setback. Mr. Muehrer presented the item. Ms. Joan Mueller, 1139 Cherry St., Oshkosh, was present to provide information and answer questions. Ms. Mueller reiterated that it is important for the four apartment buildings to maintain parking for the senior citizens to have easy access. She stated the parking on the surrounding streets is not good and mentioned that a parishioner had her car hit when it was parked on Sawyer St. during church services. Mr. Cornell asked staff if the lots were not divided yet and was the variance needed first. Mr. Muehrer confirmed that the variance needs to be approved first before the item can go to the Planning Commission for the lot to be split. If the board does not grant the variance it cannot go to the Planning Commission for the next step in the process. Mr. Cornell stated he did not feel there was any discussion required. Motion by Mr. Cornell to approve the item as submitted. Seconded by Mr. Carpenter. Motion carried 4-0. Ayes-Wilusz/Carpenter/Cornell/Hentz. Nays-None. Finding of Facts : There is no harm to the public. There would be an unnecessary hardship if it were not granted. ITEM II: 410-440 N SAYWER ST. Board of Appeals Minutes 1 February 13, 2008 Bill Schlichting-applicant, Zion Evangelical Lutheran Church-owner, request a variance to permit a building with an 18’ rear yard setback. Section 30-22 (B)(5)(d) of the Oshkosh Municipal Code: Multiple Dwelling District requires a 25’ rear yard setback. . Mr. Muehrer presented the item Reverend G. Nerenhausen, 2881 Omro Rd., Oshkosh, was present to provide information and answer questions. Reverend Nerenhausen commented that he hoped the 18’ setback would be granted. Board members had no questions and required no discussion. Motion by Mr. Carpenter to approve the request. Seconded by Mr. Wilusz. Motion carried 4-0. Ayes-Wilusz/Carpenter/Cornell/Hentz. Nays-None. Finding of Facts: There is no harm to the general public. There would be an unnecessary hardship if it were denied. ITEM III: 920 W. 6TH AVE. Luanne Pupeter-applicant, Phyllis M. Putzer-owner, request a variance to permit the creation of a detached rear yard garage with a 0’ side yard setback. Section 30-19 (B)(4)(b)(v) of the Oshkosh Municipal Code: Two Family Residence District requires a 2’6” side yard setback. Mr. Muehrer presented the item. Ms. Luanne Pupeter, 610 W. 4th Ave., Oshkosh, was present to provide information and answer questions. She said she has found a place to move the current garage to and the owner of the property, her aunt, wants to replace the garage on the existing slab. She said if they find out the current slab is not suitable they would have a new slab poured in the same location. Mr. Carpenter asked staff how much time the applicant has to do something if the request is approved. Mr. Muehrer said they will have six months to pull the building permit from the date of approval. Mr. Carpenter commented that by then we will have warm weather. Motion by Mr. Cornell to approve the item as requested. Seconded by Mr. Wilusz. Motion carried 4-0. Ayes-Wilusz/Carpenter/Cornell/Hentz. Nays-none. Finding of Facts: The size of the lot creates a hardship. There would be no disruption to the neighborhood.
