08 -83 RESOLUTION
(APPROVED 7 -0 LOST LAID OVER WITHDRAWN )
PURPOSE: GRANT CONDITIONAL USE PERMITS; APPROVE PLANNED
DEVELOPMENT:
A) 230 OHIO STREET
B) WEST SOUTH PARK AVENUE, BETWEEN
1477 AND 1495 WEST SOUTH PARK AVENUE
INITIATED BY: A) BROS LLC, OWNER
B) RENEW E85 LLC, PETITIONER
PLAN COMMISSION RECOMMENDATION: Approved with conditions as noted
BE IT RESOLVED by the Common Council of the City of Oshkosh that
conditional use permits are hereby granted for the following properties under Section
30 -11 of the Oshkosh Zoning Ordinance, and that said permits are granted with
conditions, if any, as noted for each respective property, and the Planned District
Overlay and development plans, per the attached exhibits, are hereby approved.
A) 230 Ohio Street, Bros LLC, owner
A conditional use permit for the planned development of a 2 story 5,287 sq. ft. office
building within the Bridgeview Center complex, per the attached "Exhibit A ".
B) West South Park Avenue, Between 1477 & 1495 West South Park Avenue;
Renew E85 LLC, petitioner
A conditional use permit for an unmanned self- service automobile fueling station and
associated site improvements, per the attached "Exhibit B ", with the condition that two
parking stalls be provided.

Project Description for
Renew E85 Fueling Station .
South Park Ave.

Overview:
The proposed project is to construct a 3 pump, 6 dispenser fueling station with canopy,
underground storage tanks, asphalt drives, and concrete pad within the fuel dispensing
area. The proposed project will be constructed on 1.13 acres of newly created lot within
the C -2 General Commercial Zoning district. The proposed use of fuel station will
require a conditional use permit which is being applied for. The proposed use will meet
the dimensional requirements set forth in section 30 -25 of the City of Oshkosh Municipal
code.
The proposed lot will include stormwater management facilities designed to meet the
requirements of the Engineering department. On average, during the peak hour 28
customers will use the fueling station.
HCS 2000 computer program was utilized to determine the impact of the additional 28
trips during the peak hour of usage of South Park Avenue. Traffic on South Park Avenue
will experience no decrease in level of service due to the proposed fuel station (see
attached calculations).
The proposed site will include landscaping designed per municipal code. The
landscaping and screening to be provided will eliminate any negative effects on the
adjoining properties. The lighting will also be designed to protect the neighboring
properties from undue glare.
Plan of Operations:
This station will be operated as an unattended self service facility. It will accept credit cards and
cash 24 hours per day as a "prepay at the pump" mode (no drive off s requiring police
investigations). An attendant will be at the site at a minimum of once per day to empty waste
containers, replenish supplies, and perform maintenance. An emergency phone, fire extinguisher,
and emergency ,pump .c+or xvilto. preset -
t as required by the state nde- A phone number and
information will be available to the public 24 hours per aay for questions or concerns they might
have.
All tanks and piping carrying fuels are double, wall with interstitial monitoring and remote alarm
thus exceeding state requirements. Remote alarm will notify operating personnel any time should
a serious malfunction occur.
Renew E85 LLC operates 10 of these sites currently- none have had any incidences to date
involving releases of product, fire, or need for police intervention
