HomeMy WebLinkAbout08-06JANUARY 8, 2008 08-06 RESOLUTION (CARRIED~ '(~ LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE MEMORANDUM OF UNDERSTANDING WITFi EAST CENTRAL WISCONSIN REGIONAL PLANNING COMMISSION INITIATED BY: DEPARTMENT ~F PUBLIC WORKS BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached Memorandum of Understanding between the City of Oshkosh and East Central Wisconsin Regional Planning Commission regarding the Commission's application for a grant in the amount of $106,000 from the Wisconsin Department of Natural Resources for an Urban Non-point Source and Stormwater Planning Grant that will help the City comply with the "Public Education and Outreach" WDNR Municipal Stormwater Permit (MS4) requirement is hereby approved and the proper City officials are hereby authorized to execute and deliver the agreement in substantially the same form as attached hereto, any changes in the execution copy being deemed approved by their respective signatures, and said City officials are authorized and directed to take those steps necessary to implement the terms and conditions of the Agreement. MEMORANDUM OF UNDERSTANDING between the CITY OF OSHKOSH and EAST CENTRAL WISCONSIN REGIONAL PLANNING COMMISSION This agreement is entered into the 8th day of January, 2008, befi-veen East Central Wisconsi~ Regiona! Planning Commission, hereafter referred to as the "Commission", and ~the City of Oshkosh, hereafter referred fo as the "CityA. WHEREAS, the Commission has applied for an Urban Non-point Source and Stormwater Planning Grant (the ~GranY') in the amount of $106,000 from the Wiscansin Department Qf Natural Resources ("WDNR°) on behalf of the Northeast Wisconsin Stormwater Consortium (~NEVVSC"y, whose fiscal agent is the Fox-Wolf Watershed Alliance (FWWA); and WHEREAS, the City is a member af NEWSC; and WHEREAS, the Grant will be used to fund NEWSC's Education, Outreach and Marketing Program that wifl he(p the City comply with the °Public Education and Outreach" WDNR Municipal Stormwater Permit (MS4} requirement; and VItHEREAS, the Grant cycle will terminate on December 31, 2009. NOW, THEREFORE, the parties agree as follows: 1. The City endorses the use of NEWSC membership dues and Urban Non Point Source and Stormwater Planning Grant Funds for Public Education and Outreach. 2. The City agrees to permit NEWSC to spend current and future NEWSC funds to support the implementafion of the NEWSC Education, Outreach and Marketing Program as outlined in the afarementioned grant. If NEWSC should disband prior to resolution of the Gran~ project, the City agrees to allow for current NEWSC funds to be paid to the Commission for expenditures incurred to date on the project. . 3. The Commission will: • Hire FWWA/NEWSC as an imptementing contractor. As such, NEWSC will 6e responsible for development of grant products, for seeking WDNR approval of thos~ products, and for developing appropriate grant reports. • Sign the Runoff Management Grant Agreement with the WDNR. • Establish the Grant account. • Negotiate, sign, and oversee any professional services. contracts, with input and dir.ection provided by NEWSC. • Estabiish bill payment and grant fund tracking procedures for the management of the Grant account. 4. All projects listed in the grant appfication are to be completed by December 31, 2009.
