BILLS It is recommended that the bills, as audited and presented by the Director of Finance, be approved for payment. 2. DECLARE END TO EMERGENCY It is requested that the Council declare an end to the emergency declared for repairs to Final Clarifier #2 at the Wastewater Treatment Plant, originally dated September 14, 2007, pursuant to Section 62.15(lb) of the Wisconsin Statutes, and Section 12 -10 of the City of Oshkosh Municipal Code, as explained in the attached memorandum from Assistant City Attorney Lynn Lorenson. 3. 2 ND ANNUAL HALF MARATHON & 5K RUN Request permission to grant approval to Midwest Sports Events to utilize Opera House Square, city streets and facilities, on Friday, April 11, 2008, from 6:00 p.m. to 8:00 p.m., and on Saturday, April 12, 2008, from 8:00 a.m. to 10:30 a.m., for the 2nd Annual Oshkosh Half Marathon & 5K Run, in accordance with the attached letter of request. 4. 5K RUN /WALK/ROLL Request permission to grant approval to Zeta Tau Alpha at UW- Oshkosh to utilize Opera House Square, city streets and facilities, and to close Market Street, from High Avenue to Algoma Boulevard, on Saturday, May 3, 2008, from 8:30 a.m. to 10:00 a.m., for their Breast Cancer Education & Awareness 5K Run/Walk/Roll, in accordance with the attached letter of request. 5. SENIOR TRIATHLON BIKE EVENT Request permission to grant approval to the Oshkosh Recreation Department and Oshkosh Seniors Center to utilize Menominee Park and facilities on Wednesday, May 7, 2008, from 8:00 a.m. to 12:00 noon, for their annual Senior Triathlon Bike Event, in accordance with the attached letter of request. 6. 3RD ANNUAL FOX VALLEY MOTORCYCLE SHOW Request permission to grant approval to the Fox Valley Motorcycle Committee to utilize South Park and facilities on Sunday, June 1, 2008, from 7:00 a.m. to 8:00 p.m., for their 3 rd Annual Fox Valley Motorcycle Show, in accordance with the attached letter of request. 7. 2008 FARMERS' MARKET Request permission to grant approval to the Saturday Farmers' Market Committee to utilize the City Hall parking lot every Saturday, from June 7 through October 18, 2008, from 6:00 a.m. until 1:00 p.m., for their Farmers' Market, in accordance with the attached letter of request. 8. 51 ST WINNEBAGOLAND ART FAIR Request permission to grant approval to the Oshkosh Fine Arts Association to utilize South Park and facilities on Sunday, June 8, 2008, from 6:00 a.m. to 6:00 p.m., for their 51 Winnebagoland Art Fair, in accordance with the attached letter of request. 9. SAWDUST DAYS Request permission to grant approval to the Sawdust Days Committee to utilize Menominee Park and facilities from Saturday, June 28, through Tuesday, July 8, 2008, from 6:00 a.m. to 11:45 p.m., for their Sawdust Days Festival, in accordance with the attached letter of request. MEMORANDUM 0 OlHKOlH ON THE WATER Date: December 17, 2007 To: John M. Fitzpatrick, Acting City Manager From: Lynn A. Lorenson, Assistant City Attorney Subject: End of Emergency — Final Clarifier #2 Wastewater Treatment Plant On September 14, 2007, City Manager Richard Wollangk declared an Emergency under §62.15(1 b) of the Wisconsin Statutes and section 12 -10(D) of the City of Oshkosh Municipal Code to waive bids and authorize emergency repairs to Final Clarifier #2 at the City of Oshkosh Wastewater Treatment Plant. During the annual inspection of the Wastewater Treatment Plant this fall, it was determined that there were problems with Final Clarifier #2. The Final Clarifier represents a vital link in the Plant's ability to properly treat wastewater according to the State of Wisconsin requirements and due to the threat of damage to the facilities and the need to expedite the repair process, the City Manager acting as the Board of Public Works declared an emergency and authorized the waiving of bids and repair of the clarifier. The emergency repairs are now completed and there is no longer a need for the emergency declaration. Therefore, it is necessary for the Council to declare an end to the emergency. This may be accomplished through the City Manager's Report. MIDWEST S Sou �e and exciting event September 18, 2007 Richard Wollangk City Manager 215 Church Ave. Oshkosh, WI 54903 Dear Mr. Wollangk, We are pleased to have begun planning for the 2 ° d Annual Oshkosh Half Marathon & 5K scheduled for Saturday, April 12, 2008 at 8 am. and the Kids' Run being held on Friday, April 11 at 6 p.m. We are writing for permission to use the city streets, indicated on the enclosed course map, for the event. The half marathon & 5K will start at Opera House Square in downtown Oshkosh and finish at the Leach Amphitheater. The start of the event is at 8 a.m. and all participants will be off of the city streets by 10:30 a.m. In 2007 a course was secured by working with the Oshkosh Police Departments Enclosed you will find the course map and our strategy to secure the route using police, volunteers, barricades and cones.. We are also looking for support from the city officials to work with the railroad company to make sure the route will be safe for participants, i.e. holding off the trains until a specific time that the majority of runners have passed. In addition, we have the predicted times the participants will be at the various intersections. This information is helpful in determining when to relieve the police and volunteers from their intersections and reopen the streets the course impacts. I have already spoke with the Parks Department for use of the Opera House Square as the starting point of the race, which was approved. This letter is to request your approval of use of the Opera House Square and city streets on Saturday, May 3, 2008. The race route will begin at Opera House Square, north on Algoma Boulevard to Vine Street, Vine Street to High Avenue and High Avenue back to Opera House Square. We would like Market Street between High Avenue and Algoma Boulevard to be closed. The race will begin at 8:30 a.m. and will be a total distance of 3.2 miles or 5 kilometers. The above mentioned streets on our route will only be in use for the race for approximately 45 minutes to one hour after the race begins. Following the race we will be providing entertainment for the community and our participants. Being titled "Zeta Tau Alpha Think Pink 5K Run/Walk/Roll ", our goal is to raise $8,000 to be donated toward our national foundation for Breast Cancer Education and Awareness. We would like to continue this annual event in the future to proceed to raise awareness and money for such a worthy cause. I look forward to working with the City of Oshkosh and hosting a meaningful event that will increase the awareness of breast cancer and how it effects the millions of people who have been touched by it in one way or another. The event will take place from approximately 8:00am until 12:00pm. The shelter will be used as the main event location. The shelter has been reserved with Trish Wendorf at the City Parks Department office. The area of the park that we will be using is Pratt Trail around the zoo and Kiwanis Shelter. We will be in contact with the Oshkosh Police Department regarding this event and any traffic concerns they may have once we know the number of participants registered. At this time of the day in the middle of the week, hopefully this would not be inconveniencing many people if the need arises to barricade parts of that road. As usual we will apply for any necessary permits needed to put on the show as we have done in the past. Although mother nature didn't work with us last year we are ready to put on another show for BEJA Shriners Escort Patrol. They in turn send the money onto the Shriners Hospitals for Children. The Oshkosh Rotary Club- Southwest continues their insurance coverage /sponsorship as well. ( Verification will be sent early 2008 ) We have over seventy vendors filling ninety one spaces and now report a waiting list. A wide variety of produce, plants, crafts and other items are offered for sale. Special events and live music take place most Saturdays. Free recipes and gardening hints are also available. The customer feed. -back is outstanding! This is now a "community event." At this time we ask permission to use the City Hall parking lot, Saturdays, June 7th through October 18th, from 6:00 a.m. until 1:00 p.m. for the 2008 season.
