Mrs. Hintz moved that this variance request be approved, based on
the circumstances surrounding the appeal; in particular, Mr. Houge's
disability and the fact that this work he is doing is his livelihood
and therefore it should not set a precedent.
Mr. LaLond seconded the motion. The roll call was taken 3 (Yes) and
1 (no). The variance request was automatically laidover until the
next meeting.
V. Appeal of Tom Luedeke, owner of 1826 Harrison, (M-3 zone)
proposes to construct a commercial building on an existing
retaining wall, which is located 4' 6" from the south side
property line at the closest point, whereas in an M-3 District
there is no side yard setgack. However, if one is provided,
it must be at least 6'.
Mr. Luedeke explained when the retaining wall was built by Ray
Pierson, it was 5' from the property line. Then later when Harrison
Street was done, it was put in a few inches off as a result of an
inaccurate survey. Mr. Pierson was told that a 5' side yard setback
was required. However, this only applies when the property is
adjacent to a residentially zoned district. He stated that there
would be no overhang on this side of the building and the building
itself will not go any close~ to the property line than the existing
wall is now. He also hopes to purchase the adjacent property on
that side.
Mr. LaLond moved to approve this variance request.
Mrs. Hintz seconded the motion. Motion carried 4-0.
VI. Appeal of Louis Thoma, owner of the property at 823 East Murdock,
(C-2 Zone) proposes to construct an addition to the building
(Piggly Wiggly) and are requesting the following variances
as explained by Attorney Fintan Flanagan:
Mr. Flanagam explained that both the owner, Louis Thoma, and the
Manager, Richard Seborah, were present with him. He stated that
this property was recently rezoned to C-2 Light Commercial District
in order to accomodate the new proposed addition to the building.
They wish to upgrade the store to keep in line with modern trends
and good business practices. The old filling station on the corner
of Murdock and Bowen has been removed and is now part of the parking
for the store.
