PLAN COMMISSION RECOMMENDATION: Approved with conditions as noted
BE IT RESOLVED by the Common Council of the City of Oshkosh that
conditional use permits are hereby granted for the following properties under Section
30-11 of the Oshkosh Zoning Ordinance, and that said permits are granted with
conditions, if any, as noted for each respective property, and the Planned District
Overlay and development plans, per the attached exhibits, are hereby approved.
A) 2005 Oregon Street; Convenience Store Investments
A conditional use permit for expansion of an existing Kwik Trip automobile service and
retail establishment, and construction of a car wash and associated site improvements,
per the attached "Exhibit A", with the following conditions:
1) Properties are combined into a single parcel.
2) Cross access easements/agreements between the subject lot and lot to the west
is provided.
3) Driveway sizes on the W. 20th Avenue and Oregon Street drives be designed
with one 12 foot ingress and two 10 foot egresses with a 4 foot "rumble
strip"/textured mountable median, as proposed.
4) A 5 foot sidewalk easement be provided at the angle in the northeast corner of
the subject site for potential ramp construction.
5) Pedestrian connections are established from the retail building to the public walk.
6) Install landscaped island in the parking lot at the northwest corner of the main
retail building.
7) Detention basin, if required by the Department of Public Works, is designed
without rip rap above the water line and native plants be planted on the side
slopes of the basin and emergent plants on the safety shelf.

8) Sidewalks be completed along the north property line.
9) Car wash operation hours be limited from 7:00 am to 10:00 pm.
B) 2231 Westowne Avenue; Oshkosh Westowne, LLC
A conditional use permit for the planned development of a retail and restaurant building
with a drive thru, per the attached "Exhibit B", with the following conditions:
1 ) Base standard modification to allow a 24 stall parking lot.
2) Access to the site is adjusted to either a single full access drive or the two one-
way drives be reduced to 12 ft. in width and appropriately identified as one-way.
3) Whole panel replacement for any right-of-way pavement removal.
4) Cross access easements are established prior to construction of internal drives
to the west or east.
C) 3596 Stearns Drive; Dan Dowling
A conditional use permit to amend a previously approved planned development for base
standard modifications to the rear (south) and side (west) yard setbacks on Lot 1 of a
proposed certified survey map, per the attached "Exhibit C", with the following
conditions:
1) Depiction of all existing utility easements on the certified survey map (CSM).
2) Drainage easement identified on the proposed CSM includes the word
"detention" .
3) Clarification and possible correction on the location of detention and drainage
easement as they relate to property lines, as approved by the Department of
Public Works.
4) Maintenance agreements between the two lots are established for the detention
and drainage easement.
5) A building permit be obtained for the parking lot previously constructed on
proposed Lot 1.
6) Base standard modification to allow a 0 foot west side yard setback and to allow
a 20 foot south side rear yard setback.
7) A new stormwater, drainage and grading plan be reviewed and approved by the
Department of Public Works.
D) 3911 S. Washburn Street; Oshvegas Palm Resort
A conditional use permit for the planned development of a recreational vehicle (RV)
park and camp store, per the attached "Exhibit D", with the following conditions:

1) Maximum length of stay is 14 days.
2) Remove additional asphalt at the northeast corner of the site to meet the 25 ft.
setback along West Ripple Avenue and the greatest setback along South
Washburn Street.
3) Increase setback along South Washburn Street to 5 ft. and provide a base
standard modification to allow said 5 ft. setback.
4) Remove asphalt on southern drive aisle that encroaches into setback.
5) Eliminate the sanitary waste dump station or receive approval from the
Department of Public Works.
6) Reduce western drive on West Ripple Avenue to a standard Class II Drive.
7) Adjust placement of the eastern drive on West Ripple Avenue to line up with the
western drive aisle. Reduce eastern drive to a standard Class II driveway width
and permit the driveway 140 ft. from the intersection.
8) Eliminate the northern drive on South Washburn Street.
9) Adjust southern drive on South Washburn Street to have one 12-foot ingress
lane, a 4-foot painted median and two 10-foot egress lanes and provide a base
standard modification to allow the drive to be 36 ft. wide.
10) Provide an internal access drive from the parking lot on the east of the store to
the parking lot on the west of the store.
11) The center RV parking drive aisle must be designed to support fire apparatus.
12) Add a drive lane to the north of the RV parking area and south of the camper/tent
area unless camper use is eliminated
13) Intensify landscaping (trees and shrubs) along the two street right-of-ways.
14) Building remodeling must meet design standards of the Highway 41 Corridor
Overlay District
15) Grading, drainage and stormwater plan must be reviewed and approved by the
Department of Public Works.

Proposed Rebuild ofK wik Trip Store # 741 and addition of single bay carwash
This letter is intended to accompany our application to the City of Oshkosh for the requested Conditional Use
Permit.
K wik Trip Inc. is requesting a conditional use permit to rebuild our current location at 2005 Oregon Street. The
proposed site plan would include a new brick convenience store, flat gas canopy with 10 fueling positions, including a
position providing E85, fuel, and to a single bay block carwash to the east.

The proposed store is projected to have between 15-20 full andpart time employees, with between 2-6 on staff at any
given time. We anticipate there will be no adverse affects to surrounding properties due to glare, odor or fumes since
this property is currently operated as a convenience store. During the construction, updated lighting will be: installed,
all fully recessed or with 90 degree cut off fixtures. .
The site is anticipated to generate approximately 4280 passenger vehicle trips per day when using the ITE Code 946
found in ITE'sTrip Generation ih Edition to complete the analysis.

Please allow this letter to accompany our CUP request and PD review for the proposed
project at 2231 Westowne Avenue in Oshkosh, the former Racette Suzuki property. It is
our intention to remove the current structure' on this site and rebuild, in it's approximate
place, a two tenant multi-use retail facility. The current 'structure, which is poorly suited
to an adaptive reuse, does not allow for the space necessary for our two tenants, a quick
service sandwich restaurant and a cellular products retailer, to effectively operate, The
buIlding which we intend to construct will be approxhnately 3600 square feet and
positioned similarly on the parcel, which will allow us to accommodate both users as well
as a drive through facility, with alane on the west side of the building, an order box on
the south side, and a service window along the east elevation. We have redesigned the
access to the property in concert with Mr, David Buck in your office to remove the
existing single full access point and replace this with an "in only" point located on the
west edge of the parcel and an "out only" on the east edge of the parcel. We have also
allowed for future potential cross-access' easements with both adjacent properties to
facilitate ease of access and reduce any possible burdenonWestowne Avenue. Both uses
are typical to retail centers of this type and would not have any hours, customer activity
patterns or styles of operations different than that oftheWestowne Shops, located to the
west adjacent to Menards, The area is predominantly retail or commercial and the project
we are proposing would have no negative effects on the adjacent properties or businesses,
and would more likely have positive effects including decreased impervious surface due
to the addition of green space and improved traffic flow due to the reconfiguration of
access points along Westowne., Please feel free to contact me with any questions you may .

SUBJECT: Conditional Use for Oshvegas Recreational Vehicle Park
The existing parcel to be redeveloped is 3.88 acres in area and was used as a place to race
radio controlled cars. Currently the site is vacant. The proposed use for this site is a
camp store and RV Park. The existing 1, 065 S.F. building will stay as is and be used as
a camp store. The store will have one employee. The pavement surrounding the existing
building will be milled and repaved. ' Vehicle parking striping will be provided to
maximize the use of the existing pavement area. The west portion of the site will be
redeveloped into a recreational vehicle parking area. Seventeen RV parking areas will be
provided as well asan area set aside for small campers and tents. The proposed site will
be utilized between the months of April and October. The proposed development will
not have any negative effects on adjacent properties. All adjacent properties are currently
agricultural lands. The land use break down can be seen on sheet C 1.1.
