The current project scope involves pl;lvement repair, milling, and resurfacing of STH 76 from Murdock Avenue to Indian Point Road. The City of Oshkosh has also inquired about including a raised median on STH 76 from Murdock Avenue to Smith Avenue as part of the proj ect. City of Oshkosh costs onthis project if they decide to include the raised median are as follows: . - 25% of the design costs for the milling/resurfacing project scope on the segment of STH 76 from Murdock Avenue to Smith Avenue since this is a connecting highway . 100% of the design and construction costs to include a raised median on STH 76 from Murdock Avenue to Smith Avenue WisDOT plans to let this project for 2009 construction. In order to meet our project schedule, w~ need a final decision from the City of Oshkosh about the raised median from Murdock Avenue to Smith Avenue by the end of this month. Therefore, we request the City to approye the agreement by signing andreturning two copies to our office by November 30, 2007 if you decide to include the raised median. You may keep the third copy for your fIles. If the City decides against the raised median, there is no need to return the agreement, but we would still like to be notified ofthis decision by November 30, 2007. The signatory, City of Oshkosh, hereinafter called the Municipality, through its undersigned duly authorized officers or officials, hereby requests the State ofWlsconsin Department of Transportation, hereinafter called the . State, to initiate and effect the highway or street improvement hereinafter described. The authority for the Municipality to enter into this agreement with the State is provided by Section 86.25(1), (2), and (3) of the Statutes. NEEDS AND ESTIMATE SUMMARY: Existing Facility (describe and give reason for request): STH 76 (Jackson Street) is a 5-lane minor arterial with an urban cross- section from Murdock Avenue - Snell Road and a rural cross-section from Snell Road - Indian Point Road. Pavement deterioration warrants pavement repair and resurfacing for the entire section. City of Oshkosh wants to pursue a raised median for the portion of STH 76 from Murdock Avenue - Smith Avenue. Proposed Improvement (nature of work): Proposed improvement on STH 76 from Murdock Avenue - Indian Point Road is ,pavement repair, mill, and resurface. City of Oshkosh wants to include a raised median within the urban section from Murdock Avenue - Smith Avenue. Describe non-participating work included in the project contract: Work involved with the raised median is non-participating. The initiation and accomplishment of the improvement will be subject to the applicable Federal and State regulations. 2. The Municipality will pay to the State all costs incurred by the State in connection with the improvement which exceed Federal/State financing commitments or are ineligible for Federal/State financing. 3. Funding of each project phase (preliminary engineering, real estate, construction, and other) is subject to inclusion in an approved program. Federal aid and/or State transportation fund financing will be limited to participation in the costs of the following items as specified in the estimate summary: a) The grading, base, pavement, and curb and gutter. b) Catch basins and inlets for surface water drainage of the improvement with connections to the storm sewer mam. c) Construction engineering incidental to inspection and supervision of actual construction work. d) Signing and pavement marking including detour routes. e) Railroad and compensable utility adjustment. f) Surfacing of private driveways. g) New installations of or alteration traffic signals or devices. h) Preliminary engineering and State review services. 4. Work necessary to complete the improvement to be financed entirely by the Municipality or other utility or facility owner includes the following items: a) New installations of or alteration of sanitary sewers and connections, water, gas, electric, telephone telegraph, fire or police alarm facilities, parking meters, and similar utilities. b) Damages to abutting property due to change in street or sidewalk widths, grades, or drainage. c) Conditioning, if required, and maintenance of detour routes. d) Repair damages to roads or streets cause by reason of their use in hauling materials incidental to the improvement. 5. As the work progresses; the Municipality will be billed for work completed which is not chargeable to Federal/State funds. Upon completion of the project, a final audit will be made to determim~ the final division of costs. 6. If the Municipality should withdraw the project, it will reimburse the State for any costs incurred by the State in behalf of the project. 2 'If' '" 7. The work will be administered by the State and may include items not eligible for Federal l State participation. 8. The Municipality will at its own cost and expense: a) Maintain all portions of the project that lie within its jurisdiction for such maintenance through statutory requirements' in a manner satisfactory to the State and will make ample provision for such maintenance each year. . b) Prohibit angle parking. c) Regulate or prohibit all parking at locations where and when the pavement area usually occupied by parking vehicles will be needed to carry active traffic in the street. d) In cooperation with WisDOT - Northeast Region office, assist with public information and public relations for the project and announcements to the press and such outlets as would generally alert the affected property owners and the community of the nature, extent, and timing of the project and arrangements for handling traffic within and around the project. e) Coordinate, cleanup, and fund any hazardous materials encountered during roadway construction that is deemed necessary to be cleaned and removed within the existing right-of-way from Murdock Avenue - Smith Avenue. All hazardous material cleanup work shall be performed in accordance with s.tate and federal regulations. This shall include, but not be limited to, any costs for the removal, stockpile, treatment, and backfilling of any contaminated materials encountered including assuming future responsibility and liabilities for filling over any previously identified hazardous material sourc~: and for securing an environmental consultant if required, for management of the contaminated soil. f) Use the WisDOT Utility Accommodation Policy unless it adopts a policy which has equal or more restrictive controls. 9. Basis for Local Participation: Preliminary Engineering - The segment of STH 76 (Jackson Street) from Murdock Avenue to Smith Avenue is a connecting highway which requires 25% local share for the design engineering services associated with the original project scope of pavement repair, milling, and resurfacing. The method to compute this local share is: . step 1 _ determine the design cost required for the current project scope of pavement repair, milling, and resurfacing for the entire length; . step 2 _ determine ratio of the segment from Murdock Avenue to Smith Avenue to the overall project length; . step 3 ~ multiply total design cost in step 1 by the ratio determined in step 2; . step 4 -apply the 25% local cost share to the cost amount from step 3. The local cost share amount is included within the agreement as a lump sum to simplify the agreement. 3 I <;1 'f.." ... Preliminary Engineering - The City of Oshkosh is requesting a raised median on STH 76 (Jackson Street) from MurdockAvenue to Smith Avenue. This is beyond necessary improvement scope so this additional design cost is 100% the responsibility of the City of Oshkosh. This local cost share for design is also included within the agreement as a lump sum to simplify the agreement. Construction _ Category 020 _ This category represents construction estimate for the raised median on STH 76 (Jackson Street) from Murdock Avenue to Smith Avenue. The raised median is requested by the City of Oshkosh and beyond the needed scope for this improvement project so thesecostsart:~ 100% the responsibility of the City of Oshkosh. 4
