PRESENT: David Nitkowski, Terry Slover, Don Krueger, Scott McDonald, Kevin McGee STAFF: Susan K. Moore, Principal Planner; Diane witzke, Recording Secretary Chairperson McGee called the meeting to order at 3:40 PM. Roll call was taken and a quorum declared present. Due to a four member Board present, Mr. McGee informed the applicants that four affirmative votes would be required to approve a request. A 3-1 vote for approval would be an automatic layover. The minutes of July 19, 1989 were approved as distributed. ~ 1535 HARRISON STREET - He1en G~e, app1icant/owner The applicant is requesting a modification to existing zoning district boundary lines, pursuant to Section 30-6(D) (3). The property is zoned R-2 Two Family Residence and M-3 Heavy Industrial. Mrs. Gruse's daughters, Helen Holmes, 3210 Jackson Street, and Wendy Gruse, 183 Everett, Fond du Lac, were present to answer questions from the Board, and they explained the following: Their mother has glaucoma and her eyesight is getting very bad. They would like to build a bathroom for her downstairs so sJ;l4a does.n' t ha,v4a t.e>. climb any steps. They were unable to obtain a permit because of the split zoning on this lot. Discussion ensued by the Board relative to a mistake being made when the zoning map was drawn up. (Mr. Krueger arrived at this time to make a 5 member Board.) Mr. Delton Kriegel, 1531 Harrison, expressed concern that his adjacent lot to the south may also be split with two zonin~ districts. He has no ob~ ection to thi$.. variance request. Staff adv1sed him to call the Plann1ng Office to discuss his lot. Motion by McDonald to approve a modification to the existing zoning district boundary line so that the subject property is entirely zoned R-2 Two Family Residence. Seconded by Slover. Motion carried 4-0 with 1 abstention (Krueger). Regarding the findings of fact, Mr. McDonald stated we are rectifying an error on the zoning map and there doesn't seem to be any negative ramifications. II. 28 W. MELVIN AVENUE - Debora M~ Resop, applicant/owner The applicant is requesting a variance to construct a deck attached to the dwelling with a 19' rear yard setback; whereas section 30-16(B) (1) (d) of the City of Oshkosh Zoning Ordinance requires a 25' minimum rear yard setback.
