New York Ave. Oshkosh, WI 54901 RE: Tenancy at 514 High Ave. of Tracie Pflum and cotenants. Dear Mr. Tritt: I'm writing in regard to the above referenced apartment, and on behalf of Ms. Tracie Pflum and her cotenants. As you are well aware there has been a continuing problem with infestation of cockroaches at our clients apartment. This infestation was known to you at the time our clients took occupancy on or about September 1, 1995. This infestation was not disclosed to them at that time. I feel that a problem with cockroaches, is much more significant than, "a bug problem, "as you referred to the situation after being confronted by our client. It is my understanding that you have now been served with a violation and correction notice regarding the cockroach problem. It is further my understanding that you have 30 days from the date of the notice to eliminate the cock roach infestation. Our clients expectations as to your success are at best limited. This is based on the fact that you have apparently sprayed this apartment on several occasions in the past and the cockroach infestation continues. I have been authorized by Ms. Pflum and her cotenants to give you the following notice. That notice is that in the event after the expiration of the 30 day period as indicated by the housing inspector, cockroaches once again appear on their premises, they will notify you of this fact and vacate the premises. ~~l: . ....~l -.. ~ '\;-< /v~::: ,/i"::\jSlf\; .C:.dG(~;1 ~L ~ If this step is necessary, it is our position that it is due to the uninhabitable of the premises. Our clients will in fact have been constructively evicted due to your failure to maintain the premises in a healthy and sanitary condition. I trust I do not need to give you a litany as to the characteristics of a cockroach including their reputation for carrying diseases. I don't believe that their is another type of vermin that inhabits an apartment, which so readily equates itself with disease and filth as does the cockroach! Please understand that if our clients are constructively evicted, their position will be that they are responsible for no further rent payments to you, and they will expect full refund of their security deposits.
