HomeMy WebLinkAboutMinutes - 6/2/1993 BOARD OF ZONING APPEALS MINUTES PAGE TWO JUNE 2, 1993 J., Mr. Dennis Reso, 920 Eastman St., indicated he was originally opposed to the request because there were no guarantees that Mr. Koss would maintain the property. However, he has indicated the property would be owner occupied. This is a single family neighborhood and there are enough duplexes. He inquired, as a property owner, what guarantees does he have that the property would revert to single family if Mr. Koss moves? If there is some guarantee that the property would revert back to single family, he did not have a problem with the request. -\ Ms. Dorene Salvinski, 927 Grand St., stated she has the same concerns. Mr. Nerenhausen does not keep up the property on Grand St. Mr. Schorse inquired if there are any guarantees on converting back? Mr. Roskom replied none. Atty. Williams believed a variance could be granted with this condition. Mr. Roskom stated who would enforce it? The means would probably be there to enforce it, but whether its feasible or not is the question. The Board is not in the position to make such conditions that would be difficult to enforce. This appears to be a single family neighborhood and should remain so. Alternatives exist in that Mr. Koss' son could live on the second floor as the house exists. Mr. Roehlig inquired what constitutes dividing units? Mr. Roskom replied unpierced walls. Mr. Husman inquired if it were possible that work was started without a permit and that is why this item is here today? Mr. Roskom stated it's possible. Motion by Roehlig to move approval of the variance as requested. Seconded by Husman. Motion denied 3-1 (AYE: Schorse. NAY: Herricks, Husman, Roehlig) Regarding the findings of fact, Mr. Roehlig did not feel a hardship existed and the building can be used as originally intended. II. 1700W~SOUTHPARKI\VE.-:-M~lIt.z I'~.in:t 1:9.., owner; Joseph Nemecek, applicant The applicant is requesting a variance to construct a ground sign with a 12 ft. front yard setback; whereas Section 30-22(B) Standards of the Zoning Ordinance requires a 25 ft. minimum front yard setback. Mr. Joseph Nemecek stated they had originally looked at two signs for Mautz Paint and Carpetland, but due to the airport overlay/glide path, they have decided to go with one sign for both businesses. Mr. Schorse inquired as to the height of the sign? Mr. Nemecek replied 29 ft. Motion by Husman to move approval of the variance as requested. Seconded by Herricks. Motion carried 4-0. Regarding the findings of fact, Mr. Roehlig felt the minimum setback was being requested and a business needs access to signage. Mr. Schorse stated they are restricted because of the airport overlay/glide path and the irregular lot.
