The property continues to be a blight on the neighborhood and the owner has not made sufficient progress over the years (photos included.) Brief history review: A recent inspection conducted 9/21/06 revealed that this property is in need of significant repairs. Several Correction Notices and citations have been issued over the past 6 years for the property but few corrections have been made. Currently the property is in foreclosure and it is undetermined how long it will take to gain compliance. This property has been a problem and an eyesore for the surrounding neighborhood for years. A review ofthe building exterior reveals the following areas/items to be repaired as the enclosed photos illustrate: Soffit/fascia, roof, siding, and painting. Copies of the Correction Notices and court appearances for property maintenance issues are enclosed as well as letters from Mr. Whyte and his family members stating when the violations were to be corrected. Also enclosed are pictures showing the conditions of some of the surrounding residences. As you will see, those properties are well maintained. The property at 45 Lake St. is a blighting influence on this neighborhood and the source of continuing complaints. Weare requesting an abatement order that would require the following: 1) Roof replacement 2) Repair or replace the siding on the north side ofthe building. 3) Effectively seal all openings or areas where rodents, pigeons and insects might enter the building (soffit and fascia). 4) Repair all areas where paint is chipping/peeling by scraping and painting or covering with a weather resistant material. The content of this letter has been reviewed with my brother. Recently, notices were sent to his home indicating that payment of fines for code violations totaling $43,460.00 and $212.00 must be paid by 12/13/2004 to avoid enforcement actions. Due to extenuating circumstances, we are requesting that these cases be reopened and the fines be dismissed. My brother has been battling alcoholism for numerous years to the point that it has negatively affected his family situation, finances, employment, and ability to deal with normal household responsibilities. He is currently unemployed, having just lost his job with Hoffmasters. He has tried short-term treatment programs, with limited success. However, he is currently involved in an extended treatment program for the next several months and is making a concerted effort to get his life back on track. In addition, our family has been dealing with the declining health of our aged parents over the past several years and has recently gone through several difficult and tragic months, with the death of both of our parents (in August and November), and the unexpected death of our older brother while he was visiting our dying father (in November). As you can imagine, this has placed an additional emotional burden on my brother, Dallas. Per my discussion last week with Brian Noe, following is an update on what has already been done to address the house and property code violations and a plan for addressing remaining issues. I have included several pictures taken on December 5, 2004 to document progress to-date. · Grass, weeds, and vegetative growth have all been mowed or removed to an acceptable level. · All exterior debris and clutter have been removed. · A license has been obtained for the van and a current 2005 sticker appears on the license plate. A scanned copy of the Certificate of Vehicle Registration is enclosed. · Siding on the right side of the house has temporarily been reattached, until a complete residing of this section can be completed during warmer weather. · While no work has yet been completed on replacing the roof, fascia, soffit, gutters and downspouts, a quote was obtained on 7/16/2004 from Dan Bogan of Impressive Roofing & Siding (copies of the quotes can be provided if required). There is no sign of interior leakage. Work on the~e areas is projected to commence once my brother is out of the treatment program and has secured employment (within the next 5-6 months). In addition, we will be exploring potential low-income options to assist with funding or completing the required repairs. · In response to previous requests from the Housing Inspector's office, my brother noted that he did tear down the old garage, however, he was not able to replace it due to financial constraints. The code violation fines along with the mortgage indebtedness far surpass the current assessed value of the house and would make it nearly impossible for my brother to recover financially. We respectfully ask for your leniency in this matter and appreciate whatever you can do to dismiss or significantly reduce the fines. Plan for Addressing Outstanding Property Issues at 45 Lake Street Upon release from the alcoholic treatment program at Metro Hope Ministries in Minneapolis, Minn~sota, following is my plan for addressing remaining property issues at my 45 Lake Street residence: Tasks: · Secure employment · Determine if any low-income assistance programs are available to assist with repairs or financial aid (i.e. Advocap) · Remove and reinstall existing siding on right side of house so it is properly aligned and secured · Arrange for resources to assist with roof removal and replacement · Obtain building permits as required · Obtain financing for materials; purchase required materials · Remove current shingles; replace decking; install drip edge, roofing felt, flashing around chimney, roof shingles, ridge vent · Dispose of waste materials · Replace fascia and soffit · Replace gutters and downspouts · Continue to ensure grass and weeds are maintained to an acceptable level · Continue to maintain property free of excess debris and clutter Timeframe: · Completion of siding reinstall on right side of house will be done as soon as weather permits (April/May timeframe) · Completion of roof removal/replacement, fascia/soffit replacement, and. gutter/downspout replacement is somewhat contingent on available funding.
