GRANT PRIVILEGE IN STREET I 800 BLOCK ALGOMA
BOULEVARD AND 800 BLOCK ELMWOOD AVENUE
INITIATED BY:
UW-OSHKOSH
PLAN COMMISSION RECOMMENDATION: Approved w/conditions
WHEREAS, UW-Oshkosh requests the Common Council to grant a privilege in
street to UW-Oshkosh and its contractors as may be required for the installation of
private fiber optic conduits and signal conduits within the right-of-way of Elmwood
Avenue near West Irving Avenue and West Lincoln Avenue and within the right-of-way
of Algoma Boulevard, per the attached maps; and
WHEREAS, upon final installation of fiber optic conduits and signal conduits,
UW-Oshkosh will assume liability for said facilities; and
WHEREAS, Section 66.0425, Wis. Stats., provides for the granting of a privilege
in a right-of-way; and
WHEREAS, the Plan Commission has approved of this request with conditions.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are hereby authorized and directed to grant UW-
Oshkosh and other contractors as may be required to complete said project, the
privilege of installing private fiber optic conduits and signal conduits within the right-of-
way of Elmwood Avenue near West Irving Avenue and West Lincoln Avenue, and within
the right-of-way of Algoma Boulevard, per the attached maps, contingent upon the
following:
1) The private fiber optic and signal conduits be installed in a manner that is
approved by the Department of Public Works with no modifications or changes in
construction procedure without prior approval by the Department of Public
Works.
2) If no longer needed, the private fiber optic and signal conduits be properly
abandoned and removed in accordance with City standards and under the
direction of the Department of Public Works.
3) Any problem which may arise as a result of the placement of the private fiber
optic and signal conduits be the responsibility of the contractors and owner to
correct in coordination with the Department of Public Works.
4) All appropriate permits be obtained prior to the start of placement of the private
fiber optic and signal conduits.

5) The private fiber optic and signal conduits be modified or removed immediately
upon the request of the City.
6) The private fiber optic and signal conduits be part of and documented with
Digger's Hotline system.
7) The petitioner and contractors secure and submit to the City Clerk a separate
insurance policy which names the City as an additional insured with a minimum
coverage of $200,000 per person and $500,000 in general aggregate.
8) It is the responsibility of the petitioner to file in a timely manner a new insurance
certificate with the City Clerk upon expiration of an existing certificate. Failure to
do so will result in the revocation of the privilege in street upon 10 days notice.
9) The petitioner and contractors execute hold harmless agreements with the City.

Request of the City of Oshkosh for a Street Opening Permit
Purpose of the project:, The State Building Commission, chaired by Governor James Doyle with members
of the State Senate and State Assembly, authorized a telecommunications project for the University of
Wisconsin _. Oshkosh for the purpose. of enhancing the' educational opportunities for its current and future
students. The project will install many miles of high speed fiber optic cables to expand the campus data
network and enhance data resources in classrooms,hbraries, and student dormitories.
Part of the project requires crossing city streets with new signal ,conduits that will provide paths for the new
high speed fiber optic cables.. The number of street crossmgs has been reduced from four to two and
placement of new signal conduits in city right-of-way from two down to one 25 footsection.

Mr. Steven Gohde, Asst Director of Public Works for the City of Oshkosh, has provided substantial
guidance, for the two proposed street crossings and placement of co~duits under a small portion of sidewalk
in city street right-of-way.
Path #1 is detailed in drawings CIOl, and CI01A. permission is requested to place 12 signal conduits
, under a city sidewalk. along Elmwood Avenue for a distance of about 25 feet to connect to an existing
signal manhole. This manhole serves Polk Library which will become the campus backup data ceI;1ter.
This path is needed to cross OV(lr existing signal and primary conduits to attach to existing signal manhole
S32. "
Path #2 is detailed in drawings C105 and CIOSA: Permission is requested to place six signal conduits
tinder AlgomaBlvd, west of DemPsey Hall, to terminate at Fredrick R. Clow Hall. This cC)Jlduit extension
will provide an upgraded connection to the entire western portion of the campus and allow for a large
quantity of fiber cables to be installed. .
Path #3 isdetailed in drawings CI02 and CI02A: permission is requested to place six signal conduits
under Elmwood Avenue to provide a redundant data network path and allow the campus to continue
functioning should fiber network cables serving the Dempsey Hall data center be destroyed.
