Greetings to all;
Everyone is being copied on this to give some insight on what needs to be accomplished.
This property was recently Razed and Removed per a City Order. As a result several costs were incurred that must be
billed to the property owner (and eventually assessed as a special assessment against the property as I doubt the owner
will pay.)
Please process all your bills/charges for work done on this property as you would normally. However, please forward
copies to me (room 205, City Hall) so I have a summary in our file. Reason being: we are now getting calls from
prospective developers about the total of these various bills/charges. Obviously an interested party wants to ensure they
don't get hit with any unforeseen charges after a purchase. With this in mind, please process any charges your
Division/Dept. may have incurred expeditiously.
Bob Horton: in the past there would have been charges for grass cutting, debris pickup, boarding/securing the building,
providing a generator and pump to dewater the basement, abandoning the sanitary sewer in 4th Ave. (other?)
Jack Reichenberger: Your Division was going to disconnect the water lateral from the main in W 4th Ave. Has this been
done? Do we normally charge for this?
Lynn/Warren: I advised John Blazel to finalize his bill yesterday.
Don: You will have the bills for the Razing, well abandonment and STS costs.

The following is a summary of what has been established for abandoning the water and sewer for this property. As you
may recall, part of the complication is that the laterals run through 633 W 4th Ave and there is no recorded easement that
would allow entering onto this property to abandon at the property line. Research has revealed these laterals only serve
the property on W 5th Ave, so there is no concern these serve the house at 633 W 4th Ave.
Water Lateral- Jack's Division will abandon the water lateral later this year by disconnecting from the main. The stop box
being shut off will serve as a temp. means of compliance for the time being.
Sewer Lateral - After speaking with Dave Patek, he agrees with the following proposal:
Have the Foust (demo contractor) hire a plumbing contractor to cap the sewer lateral at the Manhole on the property at
644 W 5th Ave and remove the manhole as part of the demolition project.
Streets will then cap the same lateral at the manhole in W 4th Ave when Bob's Division has the ability to schedule time for
this. Dave prefers to have the City do this as a means of ensuring it is done properly and in a manner acceptable to the
City.
Both Divisions should keep track of their expenses and forward them to be charged against the property as a special
assessment. I would suggest including a notation indicating that they are costs associated with the demolition of the
structure at 644 W 5th Ave. Please include a copy to me for our file. This allows us to advise prospective buyers of any
outstanding costs associated with the demolition.

We are getting bids to demo. Can we remove the asphalt parking lot that is south of this building. It is about
the same size (a bit larger) than the building itself. It is in terrible shape (cracked and heaved) and would not be
useable for a new development. It would not meet the present day setback standards for a new development
and would have to be removed by a future developer anyway.
What are your thoughts?

I don't anticipate that it will require a hearing. I intend to send it to the Judge with a letter
indicating that he should sign it ifno objection is received within 5 days. No one appeared at the
default motion hearing where we obtained the enclosed judgment. Therefore, I don't anticipate
that anyone is going to abate the nuisance nor contest this matter in the future.

The above-entitled matter; having come before the Honorable Bruce K. Schmidt, Circuit
Court Judge, on a motion for judgment and the court having reviewed the documents on file
herein and being fully advised in the premises, therefore makes and files the following findings
of fact and conclusions of law constituting its decision in this action.

FINDINGS OF FACT
1. That the allegations of the Complaint are proven and true.
2. That the premises at 644 West 5th Avenue in the.City of Oshkosh, is more particularly
described as follows:
Lot Two (2) according to CERTIFIED SURVEY MAP filed in Volume 1 of
Survey Maps on Page 3419 as Document No. 936111; being part of Lot 4 and part of
Lot 21, per Leach's Map of1894 of the South West ~ of Section Twenty-three (23),
Township Eighteen (18) North, of Range Sixteen (16) East, in the Sixth Ward, City of
Oshkosh, Winnebago County, Wisconsin.
3. That due notice of the pendency of this action was duly filed, after the filing of the
Complaint, on October 6,2006, and more than 20 days prior to the trialofthis action, in the
office of the Register of Deeds for Winnebago County, Wisconsin, in the manner and form
required by law.
CONCLUSIONS OF LAW
1. That the premises at 644 West 5th Avenue in the City of Oshkosh as more particularly
qescribed in the Findings of Fact, constitute a public nuisance pursuant to Section 66.0413(2),
Stats.
2. That the Summons and Complaint in the above-entitled action was duly and
personally served on Carol Sinense, Personal Representative for the Estate of Ralph A. Fischer
and the Estate of Margaretta P. Fischer, on October 30,2006. That the personal representative
did not file an answer for either defendant and both defendants are in default.
3. That M & I Bank admitted service of the Summons and Complaint on October 25,
2006 and did not file an answer.
4. That Wisconsin Public Service Corporation admitted service of the Summons and
Complaint on October 26,2006 and did not file an answer.
5. That Winnebago County admitted service on October 27,2006 and did file anAnswer
disputing the allegations in the Summons and Complaint. However, the County has stipulated to
judgment.
6. That the current owner and any subsequent owners of the premises shall remedy the
conditions that create the public nuisance and make such repairs and alternations as are necessary
in order to eliminate the public nuisance.
7. That the owner and any subsequent owners of the premises shall have 30 days by
which the defect 'shall be remedied and the repairs and alterations completed.

8. That if the nuisance is not abated and the building repaired within 30 days, the City of
Oshkosh Building Inspector shall be authorized to take such actions as are necessary to raze the
building.
NOW, ON MOTION OF JOHN M. BLAZEL, ATTORNEY FOR THE
PETITIONER it is ordered, that an order be entered requiring the nuisance to be abated pursuant
to the demand in the Complaint and in accordance with the above findings and conclusions.
JUDGMENT FOR ABATEMENT OF PUBLIC NUISANCE
AND JUDGMENT TO RAZE PROPERTY
2. Thatthe public nuisance be abated by making appropriate repairs and alterations
within 30 days.
3. That if the nuisance is not abated and the building repaired within 30 days, the City of
. Oshkosh Building Inspector shall be authorized to take such actions as are necessary to raze the
building pursuant to Section 66.0413, Stats.
4. That pursuant to Section 66.0413, Stats., the cost of securing the building may be
charged in full or in part against the real estate upon which the public nuisance is located, and if
that cost is so charged, it is a lien upon the real estate and may be assessed and collected as a
special tax. Any portion of the cost charged against the real estate that is not reimbursed under
Section 632.103(2) from funds withheld from insurance settlement may be assessed and
collected as a special tax.
5. That the City be awarded court costs/recording costs in the amount of$155.00,
recording of Lis Pendens of$11.00, title work in the amount of$50.00, service fees in the
amount of$87.00, together with statutory attorney's fees of $100.00, for a total of $403.00. Said
amounts may be a lien upon the real estate and may be assessed and collected as a special tax.
6. That any occupants shall vacate the premises within 30 days, if the nuisance has not
been abated and the defects remedied and repairs and alterations completed. That the City may
apply for a Writ to have the sheriff remove any occupants.

Defendants.
Now comes the petitioner, the City of Oshkosh, by its attorney, John M. Blazel ofSpoehr, Smits
& Blazel, LLC and states and alleges as follows:
1. That the City of Oshkosh is a Wisconsin Municipal Corporation with its primary
offices at 215 Church Avenue, P.O. Box 1130, Oshkosh, WI 54903.
2. That the defendant, Estate of Ralph A. Fischer, is an estate whose Personal
Representative is Carol A. Sinense, who resides at 642 Penbrook Way, Hartland, WI 53029.
3. That the defendant, Estate of Margaretta P. Fischer, is an estate whose Personal
Representative is Carol A. Sinense, who resides at 642 Penbrook Way, Hartland, WI 53029.
4. That the defendant, Winnebago County is a body politic with its address at 415
Jackson Street, P.O. Box 2808, Oshkosh, WI 54903-2808 and it has an interest in the property by
virtue of delinquent real estate taxes for the years from 1999 through 2005 owing to the
Winnebago County Treasurer's Office.
5. That the defendant, M & I Bank is a banking corporation with its address at 770 N.
Water Street, Milwaukee, WI 53201-2035 and it has an interest in the property by virtue of the
following:
A. A mortgage dated July 16, 1991 and recorded on July 16, 1991 as
Document Number 771379.
B. A mortgage dated November 13, 1992 and recorded November 20, 1992
as Document Number 817439.
C. An assignment of rents and profits dated February 19, 2001 and recorded
March 8, 2001 as document Number 1120838.
6. That the defendant, Wisconsin Public Service, is a corporation with its registered
office located at 700 N. Adams Street, Green Bay, WI 54307-9001 and it has an interest in the
property by virtue of a judgment against Margaretta P. Fischer in Case No.: 03 SC 152.
7. That the Director of Inspection Services, Allyn Dannhoff, signed an Order to Abate
the Nuisance at 644 West 5th Avenue in the City of Oshkosh. (See attached Exhibit A).
8. That the Order was served on all parties to this action.
9. That the premises at 644 West 5th Avenue has become damaged, deteriorated,
dilapidated and blighted to such an extent that the building offends the aesthetic character ofthe
neighborhood and produces blight and deterioration by reason of such condition.
10. The specific conditions causing the blight or deterioration are as follows:
A. Deteriorated siding and siding applications
B. Deteriorated roofing
C. Deteriorated windows and screens
D. Cracked and peeling paint
E. Other conditions representative of lack of maintenance
F. Deteriorating masonry and joints
11. That the premises at 644 W. 5th Avenue in the City of Oshkosh are more particularly
described as follows:

repairs and alterations as may be required.
C. For the Order to set forth a reasonable period oftime by which the defects shall be
remedied and the repairs and alterations completed.
D. For the Order to state that, in the alternative, ifthe building is not repaired within the
time fixed by the Court, receiver will be appointed or the building inspector or other designated
officer will be authorized to proceed to raze the building.
E. For such costs, fees and expenses as shall be allowed pursuant to Section 66.0413,
Stats. or otherwise by law.
F. For such other and further relief as may be just and equitable.

and provided. The City of Oshkosh will petition the county circuit court to declare this property
a nuisance and obtain a court order directing the owner to remedy the defect and make such
repairs and alterations as may be required. Furthermore, the City will seek court authorization
to raze and remove the affected structure(s) and restore the site to a dust free condition if the
court order is not complied with within the time fixed by the court. Additionally, the costs of
such razing and removal shall be charged against the property, shall be a lien thereon, and shall
be assessed and collected as a special tax.

We had previously forwarded a request to proceed with a Nuisance Abatement Action due to
building & property maintenance issues on this property in October 2004. However, I believe we
suspended action on this because the County was going to foreclose due to back taxes. The County
did not foreclose due to concerns there might be contamination issues. We did issue an Emergency
Abatement Notice to secure the property, which the City executed last winter/spring. This has been
an ongoing case since 2001.
The listed owners are deceased. The last contact I had was Carol Sinense, Daughter. Based on
phone conversations, I believe she represents the estate.

We have been having a number of calls at the above address reference juveniles going into the unsecured building. It

On 08-06-04 at 12:31pm, the reporting party, Paul Daly of 648 W. 5th Av, 426-9832, had called the Police Dept. to
report that three juveniles had just parked their bikes outside the above location, that being the Pied Piper Child
Care facility at 644 W. 5th Av and went inside the abandoned building. The reporting person stated the kids were
still inside at this time.
Officers were dispatched at 12:34pm and I arrived on scene at 12:36pm., parked on W. 5th, and observed three
young kids walking out the front door on the south side of the building, which is an abandoned building.
Apparently, the door was unable to be secured. It appeared they were going to go north from that location and I
then had back up cars come to the 4th Av side of the building.
I did walk up the drive and made contact with all three parties. They were verbally identified as '"
~ ' and a L . All three boys were cooperative and said they were just checking out the
inside the building there. They had not done any damage, although it was difficult to tell because there was a
large amount of damage and the building was abandoned and unsafe.
We did make contact with the inspector's office to notify them of the unsafe conditions of the building and try to
get ahold of a property owner to get it boarded up. All three parties were run, none were on file and there were
no wants. I did make contact witl l mom on her cell phone a-, and informed her about the

The kids were told they had no business being on the property, that it was trespassing, and that they should not

Officers responded to 644 W. 5th Avenue, the old Pied Piper Child Care building where witnesses, Mr. Daly and
Mr. Daly were visiting his brother, had seen from the one residence on 5th some kids in the building at 644 W. 5th
and it appeared that there was a fire as smoke was blowing out the windows and that the kids were still inside.
When officers arrived, I saw the. nd , identified by
theirselves, photographs were taken of them at the time, and they stated yeah, they were inside, they had set off
a fire extinguisher and just looking around. He didn't think anyone owned the place, it seemed to be empty to
them but a lot of junk inside.
When asked, they stated that they do not know anyone who owns this building or anyone that would be able to
give them permission to go into this building. The witnesses stated that there was another guy and a girl, the guy
in a gray sweatshirt and a girl similar of age in her mid-teens went around the other side and then came through
and let these two kids in. But .- and - . were both very adamant about the fact that they are the ones
that went in and the other two people just stood in the doorway and said dude, we're not suppose to be in here
and then left before officers arrived.
With this information, it was decided that the two boys would be getting summons for trespass to a locked
building/dwelling or room and they were walked over to my squad car, patted down for any weapons and
placed in the back seat of my car. While patting the youngsters down, I found a hard object in r front left
pocket. I retrieved it and found it to be, what is known as pot pipe, drug paraphernalia. It had residue in it. I
smelled the residue which is known to me as burnt marijuana.

Allyn,
Please find enclosed the six Computer Aided Dispatch (CAD) logs and two "long
formed" complaints regarding police calls to the property at 644 W. 5th Ave (old Pied
Piper Child Care).
The typed complaints (complaint number #04-32354 & #04-21341) involve juveniles
and that is why various sections are blacked out. Two juvies were cited under city
ordinance for entry into the building in complaint #04-32354.
The CAD logs are documents that show various information regarding the call.
These calls were "short formed" meaning that there was not enough cause or
information to call in a "long form" dictated report.

YOU ARE HEREBY NOTIFIED that the City of Oshkosh, Department of Community Development,
has determined that a public nuisance exists and that there is great and immediate danger to the
public health and safety on the premises owned by you and known as 644 W 5th Ave in the City of
Oshkosh, Winnebago County, Wisconsin. Said property has been determined to be a public
nuisance, as defined in Sees. 17-31 through 17-44, the Municipal Code of the City of Oshkosh.
Based upon the following violations:
1. Broken windows, causing glass to fall onto the surrounding ground and project and hang
unsecured from window frames.
2. Unsecured doors and windows allowing unauthorized access to the building and posing
an attractive nuisance to the neighborhood.
3. Accumulation of junk, debris, broken glass and building materials on the premises.
Inspection on January 17th, 2005 by the City Inspection Services Division confirms continued
violation of the aforementioned code sections.
Therefore, you are hereby notified that if such nuisance is not removed or abated within 24 hours
of delivery of this notice, the City of Oshkosh shall enter upon the premises and cause such
nuisance to be removed or abated. The costs of such removal or abatement will be billed to the
owner of the property and upon nonpayment will be collected as a special tax upon the property
pursuant to ss. 66.0627 Wis. Stats.
Your attention is directed to Sec. 17-38(B) of the Municipal Code of the City of Oshkosh, pertaining
to remedy from the department's order.

On Friday, February 25, Chief Erickson took the Order to Abate Nuisance for the above property and
was going to have it posted. He said he would get a copy of the report to me stating they had it
posted, but that may take a few days. You may want to check in the next day or so to see if it is
done.
I will send a copy to Mrs. Fischer at her nursing home, and also to her daughter, just to cover our
bases.

Spoke to Carol Sinense this morning. She received the notice on 3/1/05. I filled her in on the situation, advised her the
County is not taking this for back taxes due to their concern for the potential of contamination. Informed her, I plan to have
City Crews clean up the property and secure the building as early as next week if I do not hear from her regarding any
plans to do the same. Told her if we do the work, it will be billed as a special charge against the property and if not paid, it
would be a lien that would accrue interest and be taken at the time of sale.
She advised me she would get back to me no later than this Friday to indicate if they will address the issues or defer to
have the City address them.

where the city incurred costs will be placed as a special charge/assessment against the property.

Bob and his staff are boarding up the building and cleaning up the grounds at 644 W 5th Ave. Notices were served last fall
and this winter. Owners did not respond. As a result I had Bob arrange to perform the work. If you desire him to charge
the costs in a different manner, please advise.

Attached are copies of Nuisance Abatement Orders for this property. We previously issued the same
orders in December 2002. At that time we received assurance from the family's attorney that
compliance would be provided. Enclosed in this packet of information is a copy of his e-mail
correspondence indicating such and providing dates for compliance. To date, compliance has not
been provided. Initially some work was done to clean up junk, debris and storm felled trees, but
there has been no notable progress in the past year.
Attached are two history packets of information starting with past Correction Notices leading to the
December 2002 Abatement Notices and ultimately the present Correction Notice and Abatement
Notices. You may want to refer this case to John Blazel, as I strongly suspect we will need to secure
a court order allowing the City to abate the nuisances.
Enough copies of the present Nuisance Abatement Notices (one for junk, debris, brush and one for
the condition of the building and shed) have been provided for service. Please take the necessary
measures to have these delivered, unless you believe John Blazel should prepare and forward these
notices.

ProblemlViolation of: 17-36A & B; Failure to maintain premises
and building on the premises.
Brief History Review: Orders issued October 8,2001 and again on May
21, 2002 to clear the premises of debris, some storm related, household
garbage and auto parts. Order also included that the yard be maintained
and the grass kept mowed. Citations were issued on June 27, 2002 for
failure to comply with orders. The owner subsequently defaulted by
failure to appear and fines for three violations were assessed at $728.00
per citation. There has been some contact with the owners daughter but
very little has been done to correct violations. Continued complaints
resulted in an inspection on November 20,2002. The grass had not been
cut, garbage was strewn along the South side of the building. The large
tree felled by the June 2001 storm was still on the premises. A closer
inspection of the building itself revealed exterior deterioration to the
roofing, siding, windows etc, the building being generally rundown.
The building was being rented as a single family dwelling during the
May 2002 inspection. The property was also being used as a storage
area for a tree service which now appears to have ceased.

within thirty (30) days from the date of service of this order upon you.
YOU ARE FURTHER NOTIFIED that this order is served upon you pursuant to the
terms and provisions of Section 66.0413 Subsection (2) of the Wisconsin Statutes and in
such case made and provided. The City of Oshkosh will petition the county circuit court
to declare this property a nuisance and obtain a court order directing the owner to remedy
the defect and make such repairs and alterations as may be required. Furthermore, the
city will seek court authorization to raze and remove the affected structure(s) and restore
the site to a dust free condition if the court order is not complied with within the time
fixed by the court. Additionally, the costs of such razing and removal shall be charged
against the property, shall be a lien thereon, and shall be assessed and collected as a
special tax.
YOU ARE FURTHER ORDERED AND NOTIFIED that should you fail to comply with
this order to remove any personal property or fixtures in the above described structure( s)
in accordance with Sec 66.0413(1 )(i), Wis. Stats., within 30 days from the date of service
of this order upon you the City of Oshkosh may store the same, or may sell it, or if it has
no appreciable value may destroy the same. In case the property is stored and the amount
paid for storage shall be a lien against such property and against the real estate and shall
be assessed and collected as a special tax against the real estate if the real estate is owned

YOU ARE HEREBY NOTIFIED that the City of Oshkosh, Department of Community Development,
Division of Inspection Services has determined that a public nuisance exists on the premises owned
by you and known as 644 W 5th Ave in the City of Oshkosh, Winnebago County, Wisconsin. Said
property has been determined to be a public nuisance, as defined in Sees. 17-31 through 17-44,
the Municipal Code of the City of Oshkosh. Based upon the following violations:
1. Grass and weeds in excess of 8" of growth.
2. Improperly stored firewood.
3. Felled/damaged trees, including that laying on the building roof.
4. Brush piles.
5. Accumulation of junk, debris, broken glass, building materials, tires, furniture,
deteriorated play equipment and other materials on the premises.
6. Storage of trailers
7. Deteriorating, unmaintained fence.
Inspection on November 20, 2002 by the City Inspection Services Division confirms continued
violation of the aforementioned code sections.
Therefore, you are hereby notified that if such nuisance is not removed or abated within 15 days of
delivery of this notice, the City of Oshkosh shall enter upon the premises and cause such nuisance
to be removed or abated. The costs of such removal or abatement will be billed to the owner of the
property and upon nonpayment will be collected as a special tax upon the property pursuant to ss.
66.0627 Wis. Stats.

A police officer stopped by to share information on 644 W 5th. The gas, electric and water have been turned off. The
police accompanied Public Service in order to verify that the upstairs tenant was no longer living there. They were not able
to find conclusive evidence either that there was or was not someone living there.
The last piece of mail they found was dated November 27, 2002, the food in the refrigerator appeared to be 2-3 months
old. However, there was a mattress and clothing still in the apartment.
The officer stated the police would be happy to accompany you if there is a need to go into the building.

Dear Mr. Dannhoff:
This is to confirm our telephone conversation of February 10,2003, in which the participants were you,
Carol Sinense on behalf of her mother, Margaretta Fischer and myself. It is my understanding that you
have agreed on behalf of the City of Oshkosh to hold in abeyance any action to seek to have the above-
referenced property declared a nuisance or engage in the seeking of any additional remedies identified in
your Notice, dated December 17, 2002.
The reason that you have agreed to withhold the filing of an action is based upon the terms of our
settlement proposal. First, as soon as practicable, the "east-side" service door will be closed offwith a
deadbolt or other secure mechanism. Second, on or before May 01,2003, the exterior property will be
cleared and made more presentable. Third, on or before June 30, 2003, the last of the exterior painting
(that is, to the "dormer" area) will be completed.
Thank you for your assistance in this matter. Hopefully, now that you know how to contact a
representative of Ms. Fischer, it will no longer be necessary to engage in the predicate to legal action.
As we explained, Ms. Fischer was unable to respond because of a medical condition. Her daughter, Ms.
Sinense can be contacted through me.

Have you been able to discuss this property with your client?
There is miscellaneous junk, debris, brush, cut up tree chunks that need to be removed from the property. The building
needs to be secured/boarded up. The trailer in the pictures must be removed as this type of parking is not allowed in this
zoning district.
I suspect the property would sell faster if the shed and buildings were razed. J\t this time the property is not listed for sale.
I was under the impression sale of this property would be actively pursued.
