This Agreement is between RAR InvestmenfS~_and
the CITY OF OSHKOSH, a municipal corporatiorl,'10cated in
Winnebago County, Wisconsin, as follows:

WHEREAS, the City of Oshkosh anticipates
reconstruction and realignment of Washburn Street as part of the
State of Wisconsin highway project affecting USH 41 and STH
21; and

WHEREAS, RAR Investments, operating as Racette Ford,
desires to place a sign in an area subject to acquisition by the
City for the Washburn Street project; and

WHEREAS, RAR Investments acknowledges that it might be eligible for relocation expenses
in the event the City does acquire that portion of the property where the proposed sign is to be
constructed and desires to waive those rights in exchange for approval to place the sign within the
proposed relocated right-of-way; and
WHEREAS, the City will undertake efforts to begin official mapping the lands needed to
complete the Washburn Street project as soon as practicable and desires not to impede the
progressive commercial development of this area; and . ," '. .~
WHEREAS, the property subject to this agreement is more particularly described as:
Lot 2 of Certified Survey Map 3545 recorded in Volume One of Certified
Survey Maps at page 3545, in the Winnebago County Registry as
Document No. 950771, in the 16th Ward, City of Oshkosh, Winnebago
County, Wisconsin. (2231 WESTOWNE AVE)
WHEREAS, the parties agree that there is due and sufficient consideration for
this Agreement and are fully advised of all rights under this Agreement;
NOW, THEREFORE, the parties agree as follows:
1. Subject to RAR Investment's compliance with other zoning code provisions,
the City of Oshkosh will issue the appropriate building permit to enable RAR
Investment to construct the proposed sign.
2. RAR Investments foregoes, and fully releases the City of Oshkosh from any
payment obligations for, relocation benefits that may arise from the City's
acquisition of land and improvements occupied by proposed sign for the
Washburn Street project.
