HomeMy WebLinkAboutMinutes - 10/7/1987 ~1 C9 BOARD OF ZONING APPEALS ~INUTES OCTOBER 7, 1987 PRESENT : Dave Neu, David Nitkowski, Anne Hintz and Kevin McGee STAFF: Chuck Lamine, Principal Planner; Diane Witzke, Recording Secretary Chairperson McGee called the meeting to order. Roll call was taken and a quorum declared present. Due to a four member Board present, Mr. McGee informed the applicants that four affirm- ative votes would be required to approve a request. A split vote would be an auto- matic layover. The minutes of September 16, 1987 were approved as distributed. 1. ELECT CHAIRMAN AND VICE-CHAIRMAN Mr. McGee G requested that the election of officers be heard at the end of the meeting. 1958 OREGON STREET - Charles A. Kohls, agent for Bernice Wellnitz Estate - Mr. Lamine explained the applicant is requesting a variance to convert a single family residence to a two family residence with a 17.32 ft. front yard setback, a 6.24 ft. side yard setback and a 45.5 ft: wide lot; 'whereas the Ordinance requires a 25 ft. minimum front yard setback, a 7.5 ft. minimum side yard setback and a 60 ft. minimum lot width. Mrs. Kohls explained they want to make the property pay for itself. Any changes will be cosmetic changes and not major structural changes. Mr. Lamine stated this property was used as a duplex several years ago. This was prior to when there were restrictions on being a duplex. Mr. Neu asked the age of the house. Mrs. Kohls replied about 70 years old. Mr. Neu asked how long the Kohls have owned the property. Mrs. Kohls replied less than a month. Mr. Nitkowski questioned this is an income property for you? Mrs. Kohls replied yes. Mr. Lamine stated this is going before the Plan Commission next Monday for a lot division. Mr. McGee stated if they do not approve the lot division they would not need the variances. Mr. Lamine replied that is correct. Mr. Lamine stated the Estate has decided to keep that part of the lot vacant for possible future extension of 20th Street. Mr. McGee stated the problem is being created because the public is potentially thinking of using that land. MOtion by Neu to move approval of the variance to convert a single family residence to a two family residence with a 17.32 ft. front yard setback, a 6.24 ft. side yard setback and a 45.5 ft. wide lot. Seconded by Hintz. Motion carried 4-0. If he put on an attached garage he would have more privacy. Mr. McGee asked if this could be used as living space. Mr. Lamine stated he would be exceeding the 7~ ft. setback even if he converted it into living space. Ms. Hintz stated that likelihood would not be great because there would not be any room left to put up a garage. Mr. Jacobson stated he would not want to do that be~ause he needs a garage. Mr. Lam!ne stated the attached garage would provide more of a buffer than a detached garage. Mr. Neu asked the age of the house. Mr. Jacobson stated it was built this year. Ms. Hintz questioned, without a garage? Mr. Jacobson replied yes. Motion by Neu to move approval of a variance to con$truct an .attached garage on a corner lot with a 10 ft. rear yard setback. Seconded by Nitkowski. Motion carried 4-0. Regarding the findings of fact, .Mr. Neu stated it is a corner lot that is substandard in size. There is no other alternative because of ~he small lotan4 there will be no negative impact on the surrounding area.
