Please see the response below from the DOT. I recommend trying to have the encroachments removed
from the ROW if at all possible. If not then they should at least make sure they are compliant with clearance
codes and not creating any vision obstructions. If this is the case is their some sort of revocable
occupancy/encroachment permit you can issue so we have an easier time having the encroachment
removed in the future?

Our office wouldn't get involved in this situation since this is along a connecting highway and there is no
active project along this segment of Main Street. A long time ago, we used to be more active in dealing with
encroachments in all situations, but that is no longer the case. As you mention, we now typically only get
involved with encroachments along connecting highways within the limits of proposed projects. Our
involvement is triggered by the federal funds involved in the construction projects. The City ends up being
the enforcement agency in these situations since you handle real estate on connecting highways.

The link below is to a property that wants to redo/maintain a portion of the facade and
encroaching overhang of the building. The property fronts on USH 45. I know if the street
were to be reconstructed you would want these removed. Where does the DOT stand when a
property owner wants to just maintain/repair the existing encroachments?
