ITEM IU$~Charles Kohls, Applicant/ Owner GENERAL DESCRIPTION AND BACKGROUND Charles Kohls, applicant/owner requests a variance to allow for a 5' wide step to extend into the front yard of the property whereas Section 30-35 (B) (2) (a) allows for entrance platforms and steps to extend into require setback areas for the minimum distance need~d to comply with code requirements, 36" by 36". The general area is characterized by residential uses, and is zoned R-5 Multiple Family Dwelling District. . ANALYSIS AND RECOMMENDATION In reviewing a variance request, the following questions should be addressed: Is there an unusual or unique characteristic about the subject property which creates a hardship? Is the hardship self-created? Is the variance being requested the least possible needed to remove any hardship? Will granting of the variance have a considerable adverse impact on the neighboring properties? The applicant is proposing to replace an existing set of steps with steps that are 5' wide. The new steps will simply be replacing an existing set of steps which under current code can only be 36" wide. "Replacing steps with the same 5' width is reasonable and appropriate for safety purposes. The hardship is not self-created, and it would not appear that granting the variance will have a considerable adverse impact on the neighboring properties.
