HomeMy WebLinkAboutRaze Request - 8/23/07 ~ Raze Request Name: Kelly and Elizabeth Burnett 524 W New York Ave Oshkosh, WI 54901 Address of violation: 141 W South Park Ave ProblemNiolation: Unsafe conditions and violations of the Minimum Housing code and Property Maintenance Code. Brief history review: On 8/9/07 a complaint was received from the tenant living at 141 W South Park Ave. The tenant requested an inspection of the dwelling unit, stating that he thought it was unsafe structurally. An inspection was made on 8/1 0/07 at which time the following conditions were noted and photographed: 1. There is a significant amount of fire damage to the floor system. The main beam, several joists and sections of the subfloor have been damaged. Joists have been notched and bored in a manner that they are no longer structurally sound. Shoring has been installed to support the floor in the bathroom. 2. New stairs have been constructed on the side entrance without permit. The stairs have not been constructed in compliance with the Uniform Dwelling Code. A minimum 3' x 3' landing has not been provided and there are no guardrails/handrai1s. 3. Deadbolts have not been provided for all entry doors. 4. Screens are not provided for all windows. 5. The railings to the front entry are unstable and will not support the required 200 pounds of force in any direction. 6. Windows have chipping paint, missing glazing and broken panes of glass. A few windows are painted shut and subsequently unusable. 7. The dryer is not vented to the exterior of the building. 8. Several outlets are improperly wired. 9. The rear door has been screwed shut. 10. Significant plumbing work has been done without permit or inspections. 11. Flooring by laundry area is not complete. It is for the above-mentioned reasons, specifically the concern that the building is no longer structurally safe due to the fire damage, that the building has been posted "Unfit for Human Habitation Occupancy or Use" as of August 20,2007. I spoke with Mr. Burnett on 8/17/07 at which time he stated that he did not intend to repair the building and would prefer for the City to proceed with a raze request, tear down the building and have the costs assessed to his property tax bill. City Ordinance and State Statutes state that if a building is old, dilapidated or out of repair and consequently dangerous, unsafe, unsanitary or otherwise unfit for human habitation and unreasonable to repair, order the owner ofthe building to raze the building or, if the building can be made safe by reasonable repairs, order the owner to either make the building safe and sanitary or to raze the building, at the owner's option. Therefore, I am requesting approval to have this structure located at 141 W South Park Ave. razed unless all necessary repairs and are made.
