HomeMy WebLinkAbout2007-Raze Request Raze Request Name: Kelly and Elizabeth Burnett 524 W New York Ave Oshkosh, WI 54901 Address of violation: 1902 Roosevelt Ave ProblemNiolation: Unsafe / unsanitary conditions and violations of the Minimum Housing code and Property Maintenance Code. Brief history review: On 5/21/07 a complaint was received from the tenant living at 1902 Roosevelt. The tenant requested an inspection of the dwelling unit due to several problems she was having with the plumbing and electrical systems. An inspection was made on 5/22/07 at which time the following conditions were noted and photographed: 1. The service entrance cable was seriously deteriorated and subsequently the power to the house was ordered disconnected until a new cable is installed. 2. The plumbing in the bathroom has a serious leak, which has resulted in damage to the walls and floor, as well as creating a mold problem. It is undetermined the extent of damage that has been done. The leak may effect both the sub floor as well as the floor joists. The areas effected should be gutted. 3. Plumbing has been improperly installed without permits. 4. The electrical service and some of the fixtures have been improperly installed. 5. Windows are deteriorating and need to be painted and re-glazed. 6. No step flashing was installed when the roofwas replaced; as a result, rainwater may be able to penetrate into the building and cause further damage. 7. The shingles on the roof are curling up and warrant replacement. 8. Smoke detectors are not installed in all required locations. 9. The two storm doors are in poor condition and are missing hardware. 10. Holes in walls and ceilings need to be repaired. 11. Openings on the exterior of the building where birds/insects are getting in and nesting need to be effectively sealed. 12. The electricity was disconnected 7/17/07 and the gas has been capped as of 7/19/07 thus further rendering the building uninhabitable. 13. The dead tree outside the property has been infested with bugs, which have also infested the house in the attic area. The tree needs to be taken down. It is for the above-mentioned reasons, specifically the disconnection of the utilities, that the building has been posted "Unfit for Human Habitation Occupancy or Use" as of August 8, 2007. I spoke with Mr. Burnett on 8/17/07 at which time he stated that he did not intend to repair the building and would prefer for the City to proceed with a raze request, tear down the building and have the costs assessed to his property tax bill. City Ordinance and State Statutes state that if a building is old, dilapidated or out of repair and consequently dangerous, unsafe, unsanitary or otherwise unfit for human habitation and unreasonable to repair, order the owner ofthe building to raze the building or, if the building can be made safe by reasonable repairs, order the owner to either make the building safe and sanitary or to raze the building, at the owner's option. Therefore, I am requesting approval to have this structure located at 1902 Roosevelt Ave. razed unless all necessary repairs and are made.
