Dear David:
As the property owner of 221 Oxford, the Oshkosh Police Department feels it
important to notify you of the following information:
Since 2005, Officers of the Oshkosh Police Department have responded to your
address approximately 13 times. Some of these complaints involved juvenile
(', problems, noise problems, drug problems, along battery complaints and
negligent handling of burning materials, which resulted in arrests.
As you may be aware, several neighbors in the 200 block of Oxford Avenue have
expressed concern over the activities taking place at 221 Oxford Avenue.
Therefore, based on this factual information, the Oshkosh Police Department
views the tenants, of 221 Oxford Avenue, and their continued illegal actions, to
be a Public Nuisance.
The City of Oshkosh defines a Public Nuisance under Municipal Code 17-31 as
the following:
A public nuisance is a thing, act, occupation, condition, or use of property,
which shall continue for such length of time as to:
(1) Substantially annoy, injure or endanger the comfort, health,
repose or safety of the public;
(2) In any way render the public insecure in life or in the use of
property;
(3) Greatly offend the public morals or decency;
(4) Unlawfully and substantially interfere with, obstruct or tend to
obstruct or render dangerous for passage any street, alley,
(\, highway, navigable body of water or other public way.

('\ Furthermore, the City of Oshkosh views the tenants, of 221 Oxford Avenue, to
be in violation of Municipal Code 17-34, which states the following:

The following acts, omissions, places, conditions
and things hereby specifically declared to be
public nuisances offending morals and decency,
but such enumeration shall not be construed to
exclude other nuisances offending public morals
and decency coming within the definition of
Section 17-32;
Premises Where Habitual Violations of Laws Have Occurred
Any place or premises within the City where City ordinance or State
Laws relating to public health, safety, peace, morals or welfare are
openly, continuously, repeatedly and intentionally violated.
I have discussed the continued violations of the law, at your property, with the
City of Oshkosh Attorney and, it is our intention to end the criminal activity at 221
Oxford Avenue. Presently, it is' not our intention to cite the landowner;
however, I want to make it very clear David that citing you is one of our legal
options if you fail to take action against your tenants. Knowing that this activity
has taken place, the law places the responsibility on you, as the landowner, to
immediately remedy the situation.
The Oshkosh Police Department believes that it is in your best interest to take
the appropriate action allowed by law to prevent future activities at 221 Oxford
Avenue.
Your cooperation and efforts are greatly appreciated. If the Oshkosh Police
Department can be of any further assistance, please do not hesitate to call.
