This morning, a citizen came to the Planning Services Division office and reported site
work being done on the property at 544 Jefferson. I wentto the site and observed three
large dump trucks filled with gravel parked on the street and grading and gravelling in
process on the south side of the lot.
Kelly Burnett, the property owner, was present. I advised him that he had to stop work
as he had no permit either for the installation of the gravel drive and parking area at the
rear of the property nor the curb cut that would be necessary in conjunction with the
driveway. I asked him to meet me at the office and he, Todd Muehrer and I met at
approximately 11 am to discuss the situation.
Kelly provided a site plan showing the proposed work, which he claimed Todd had
drawn and given to Kelly's property manager. After doing some investigation, it was
discovered the plan had been drawn by JeffNau of our office. Jeffreported that the
property manager did not reveal there was no existing drive and no curb cut.
I advised Kelly that what he had done would not have been permitted under the zoning
ordinance without variances. I observed that the property had a shared drive with the
property to the north and advised Kelly to explore using that drive for access to the rear
ofthe property as apparently had been the case for years and then to contact Todd on or
before Monday, March 19 at which time he would apprise Todd of his options and make
an appointment to obtain a permit or apply for a variance that week. I further advised
Kelly to inform his tenants the area he had graveled was not a code compliant parking
space and they were not to park there.
