CITY OF OSHKOSH, WISCONSIN
RESOLUTION
PURPOSE:
DECLARE EMERGENCY UNDER S62.15(1b), STATS.
WAIVE BIDS & AUTHORIZE REPAIRS
FINAL CLARIFIER #2/WASTEWATER TREAMENT PLANT
INITIATED BY:
DEPARTMENT OF PUBLIC WORKS
WHEREAS, the final clarifier # 2 at the wastewater treatment plant is undergoin~l
its annual inspection; and
WHEREAS, during the cleaning process the top skimmer arm caught on the
skimmer box, which indicates that the equipment is out of plumb and that there is a
potential problem with the sludge removal support mechanism; and
WHEREAS, maintenance records indicated that this equipment was checked for
plumb along with the other final clarifiers within the last year and all was in order; and
WHEREAS, upon further investigation, the center column support structure is
corroded and needs to be replaced; a repair that needs to occur quickly to avoid cold
weather damage to the concrete portions of the structure if this unit is out of service for an
extended period; and
WHEREAS, this represents a vital link in the Plant's ability to properly treat
wastewater according to the State of Wisconsin requirements; and
WHEREAS, because the lead time for the center column that needs to be replaced
is four to six weeks from order date, the type and emergency nature, which this repair
requires, does not lend itself to the development of appropriate plans and specifications
used in the traditional bidding process; and
WHEREAS, Section 62.15(1b), of the Wisconsin Statutes, and Section 12-10(0) 2",
of the City of Oshkosh Municipal Code, authorizes the waiving of bidding requirements for
the repair and reconstruction of public facilities when the Board of Public Works (City
Manager) determines by resolution that damage or threatened damage creates an
emergency in which the public health or welfare of the city is endangered; and
WHEREAS, funds for this purpose are available in the Sewer Utility accounts;
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works (City
Manager, or designee) that the corrosion of center support structure in the final clarifier #2
at the Wastewater Treatment Plant creates an emergency requiring immediate repair.

BE IT FURTHER RESOLVED that the proper city officials are authorized and
directed to waive bids and enter into purchase order with an appropriate contractor to
complete all necessary repairs.
Money for this purpose is appropriated from
Acct No. 551-1946-6426-00000 - Sewer Utility - Maintenance Expense
BE IT FURTHER RESOLVED that, once the repairs have been completed and the
emergency no longer exists, the Common Council of the City of Oshkosh be asked to
approve an appropriate motion pursuant to section 62.15(1 b), of the Wisconsin Statutes,
declaring an end to the emergency.
