Dear Oshkosh Christian School
On August 8, 2007 the Boardof Appeals approved a variance to permit the creation of a sign with a
front yard setback of 15' .
The decision of the Board was filed in the Planning Services Division Office of the Department of
Community Development on August 9, 2007. Per Section 30-6(C)(3) and (4) of the City of Oshkosh
Zoning Ordinance, your variance will expire on February 9, 2008 unless you have started
construction for the activity allowed by the variance. If you fail to begin construction by this date,
you must reapply for a variance if you intend to go ahead with the activity allowed by the variance.
Please be advised that any person or persons aggrieved by. any decision of the Board of Appeals may
commence action in Circuit Court within thirty (30) days after the filing of the decision. Permits
may be issued on approval of the Board, but you should be aware that further action could take
place until as much as 30 days after the date of the decision.
Building permits may be applied for from the Inspection Services Division in Room 205 at the
Oshkosh City Hall between 7:30 - 8:30 AM and 12:30 - 1 :30 PM, Monday thru Friday, or call (920).
236-5050 for an appointment. Please bring all required building plans and information necessary for
review when obtaining your building permit.

Mr. Michael Stratz, 2750 Killarney Ct., Building and Grounds Chairman for the Oshkosh Christian School
was present to answer questions.
Mr. Stratz explained that the landscaped mound was designed specifically for the current sign.
Unfortunately it is difficult to see the sign when driving by because the driver has to turn one way or the
other to see it. Most schools now have reader boards that are more helpful to parents. If the new sign is
moved back 10 feet there will still be a visibility problem even with the sign turned and the mound would
need to be moved as well. If it is moved further south there is a problem with underground utility lines
coming in from the street.
Mr. Cornell asked if the new sign is the same size or larger.
Mr. Stratz said the current sign is 4 ft. x 8 ft. The new one will be configured differently. It will be longer
and have a header with a roof on the top. The top part will be larger but the bottom part will be smaller. The
maximum size the reader board can be is 24 square feet so they decided it would be 4 ft. x 6 ft.
Mr. Cornell asked if the current sign has a 15 ft. setback.
Mr. Stratz said yes. They are proposing that the new sign would not be closer than that. It will fit on the
current landscaped mound.
Mr. Cornell asked ifthe current vegetation would be a problem because ofturning the sign.
Mr. Stratz said only 1 bush will need to be removed.
Mr. Penney mentioned that setting the sign further back would cause safety issues.
Ms. Hentz agreed.

ITEM IV: 3450 VlNLAND STREET
GENERAL DESCRIPTION AND BACKGROUND
Wisconsin Independent Christian Schools-applicant, Oshkosh Christian School-owner,
requests a variance to permit the creation of a sign with a front yard setback of 15'.
Section 30-17 (B)(2)(c) of the Oshkosh Municipal Code: R-l Single Family Residence
District requires a front yard setback of 25' .
The subject 14.55 acre (approx. 633,000+ sq. ft.) property is zoned R-1 Single Family
Residence District and is located on the east side of Vinland Street, north of Freedom
Avenue, south of Christian Avenue, and west of Eichstadt Road. In addition to the school
facility, the property is developed with a baseball field, soccer field, and other open space
features. The general area can be characterized as single-family residential.
ANAL YSIS
In reviewing a variance request, the following questions should be addressed:
When considering an area variance, the question of whether unnecessary hardship
or practical difficulty exists is best explained as "whether compliance with
the strict letter of the restrictions governing area, setbacks, frontage, height,
bulk or density would unreasonably prevent the owner from using the
property for a permitted purpose or would render conformity with such
restrictions unnecessarily burdensome."
Are there any unusual or unique physical limitations of the property, which create
a hardship?
Will granting of a variance result in harm to the public interest?
The applicant is requesting a variance from the Zoning Ordinance to reduce the front yard
setback standard. The proposed plans are to replace the existing west facing, single-sided
illuminated sign with a proposed two-sided illuminated sign (with an attached reader
board) that will face north-south along Vinland Street. The overall height of the sign will
be 6'6" from grade. The identification portion of the sign will be approximately 12'6"x
2'6" and the reader board area of the sign will be 6'x 4'.
According to the applicant, the variance request will not have an adverse effect on
surrounding properties because they currently feature an illuminated sign in the same
location and the property to the west is a campground.
In the applicant's opinion, the special condition related to the subject lot that does not
apply to surrounding lots is the institutional land use of the property. The property owner
relies heavily on the sign (especially the reader board section) to convey information to
students, parents, and staff on upcoming events, meetings, schedules, etc. By moving the
sign back another 10', the applicant feels readability will be greatly affected. A hardship
would ensue if not granted because the school would need to remove several
existing/matured trees and relocate the landscaped area around the sign to place the sign
at 25'. The school is hopeful they can retain as much vegetation/landscaping as possible
with the new project.

Staff views the subject property as unique because it is located on a road with increased
speed (45 mph) in a quasi-rural setting as opposed to a traditional city/urban setting.
Staff believes traffic safety issues could potentially develop from delayed sign
identification (especially the reader board portion) for north/southbound traffic along
V inland Street.
Staff does not anticipate the proposed sign placement will interfere with motorist
vision/traffic attempting to leave the parking lot to merge onto Vinland Street
(approximately 130' from the proposed sign to the south entrance and approximately 90'
to the north entrance). In general, staff believes no harm to the public interest will occur
with the proposed sign placement and feels safety will be adequately addressed.
RECOMMENDATION
Based on the information provided within this report, staff recommends approval of the
variance requested.

1. We would like to replace our existing sign i'n our yard in front of our school}
which currently is a one sided lighted sign which faces the street (WestL
with a 2 sided lighted sign with a reader-board which will face north and
south. The reason we are requesting a variance} is because even though
the current sign has been in front of the building for 15 years} current
setback requirements will require us to move the new sign back 10 feet
further from the street than the current one. We are requesting that we be
allowed to replace our sign using the existing location that has a 15} setback
from the sidewalk} rather than the current requirement of 25'.
2. Since we have a lighted sign there already, we are the only building facing
the street on the block and because there is a campground across the
street; we do not see any adverse effects on surrounding properties.
3. Because we are a school, it would be very helpful to parents and anyone
else driving by to be able to read the sign as clearly as possible. Moving the
sign back further will make it more diffi'cult to read the changeable
information on the reader-board sign.
4. You will note by looking at the pictures of the current sign location; that it
is mounted on a specially build mound, with large fir trees behind it. In
order to comply with the new setback requirement we would have to move
the dirt/rock mound back 10' and cut dOWl1, several large trees. That would
add considerable expense to the project, remove some beautiful trees and
make the sign somewhat harder to read from the road. Even if we moved
the sign to a different location in front of the school, we would still have to
cut down some other trees so that it would be visible from both directions.
We would like to keep as much of the vegetation in front of the school as
