AGREEMENT
CITY OF OSHKOSH AND MIXED MARTIAL ARTS
PARAMEDIC AMBULANCE ST^ND-BY

THIS AGREEMENT made and entered into this ..L..L- day of 2007, by and
between Mixed Martial Arts, PO Box 23, Marsh:fi.eld WI 54449. hereillafter alled UMaTital Arts"~
and the City of Oshko~ a municipal corporation, hereinafter ca.1led "City".
WHERBAS~ Tmpact has requested the City provide a dedicated paramedic ambulance for
stand-by during specified hours of Martial Arts~ and
WHEREAS, the Common Council fot the Cjty of Oshkosh hAs authorized the appropriate
City officials to cnter into suoh an agreement.
IT IS AGREED by and between the parties that the City shall provide one (1) two-person
paramedic ambulance to be present at Sunnyview Expo Center, on August 18, 2007 between the
hours of 7:30 p.m. to 11;00 p.m. The role of this unit shall be to provide Basic Life Support (B18)
and Advance Lif~ Sttpport (ALS) ror emergencies, ifthcy occur. Emergencies requiring a response
beyond the OApl1bilitics of the unit on scene will be supplemented by a respOl'1Se of on-du.ty reaouroeg.
IT IS FURTHER AGREED, that Gladiators shan pay $65.00 per hour for the ambulance.
Billed 'Lime w;n inolude 30 minutos before and after the standby for travel and setu.p. Pre-event
cancellation shall be made by calling 920-236-5271. A three hour minimu.m will be oharged if the
event is not cancelled at least 12 (twelve) hours prior to the scheduled start time.
The City shall invoice Kenny Body, PO :Sox 23, Marshfield WI 54449 following the event, .
with payment to be made within 30 days ofreooipt ofinvoieo.
All patients requiring transport by the Oshkosh Fire Departn,ent ambulance will bc billed for
services rendered according Lo the City's Uiu.a.l and customary procedures and rates for service.
Martial Arts shall indemnify and save harmless the City from and against any and al11osscs,
claims, demands., penalties., fines, causes of action. costs, damages, expenses and liability, including
without limitation any attorney or consultant f'ees, invest1ga.tion fees, court costs and litigation
expenses, and other costs of defense arising out of or in any manner rolated to Martial Arts's
operation of the Event, including but not limited to:
A. AIry personal injury or bodily inj ury (including wrongful death) or property damage
(real or personal);
B. Any lawsuit brought or threatened, settlement reached, or local, sta.te~ or federal
government or agency order, inoluuing, but 'Oot l1m1ted to claims) costs, liahilltics~
or ~x.penses arising under ~eral, stale, or local law;
C. Any violation of laws) orders, regulations, requirements, or demands of any
govemmental a'l1thorities~ and, ,

party.
This agreement shall tenninato upon Impact and City's completion of their obligations herenndcr.
