1. This is my opinion, and not Dept. interpretation because of statutory
issues. This is "law" per the statute and ONLY Lawyers can interpret such
language.
It is my understanding that ramps to & from car washes have and continue to
be allowed by the Dept. to heat their DRIVE immediately in front of the
entrance and after the exit, however, not any nearby sidewalks or walk areas
unless they are for egress or ingress. I also know that the same can be
applied to ramps into underground parking levels which typically are very
steep and can cause a danger to the public if the they become icy. NOTE
that most ramps have a sidewalk in front which would NOT be allowed to be
heated unless part of building egress. {It's odd I know....} Concerning
sidewalk used for accessibility purposes, ONLY a 4 ft sidewalk width, the
width required per Comm 69 for accessibility, is allowed to be heated.
2. Some pizza ovens, (ie. Pizza Hut), are direct vent (ie. the whole system
is enclosed to the exterior), thus the oven IS required to have an exhaust
system installed in this specific situation. Most do not have this
requirement. Concerning if this is a contamination issue under the present
code, I will defer to John Spalding, Matrix Chief for COMM 63 & 64
Under our future code, IMC 506 & 507 WOULD REQUIRE a Type II (non-grease)
kitchen hood and exhaust ductwork (See definition of "HOOD" under IMC ch.
2). Also IMC 401.7 would require "odors" to be considered a contaminant
source--I also remind you that the odor "must be irritating or injurious to
health". An inspector must use good judgement in this code section's
application
Note the use of waste energy has no limits for use when applied to
sidewalks.

You are correct in all accounts.
Basically any sidewalk for barrier-free use may be heated. Considerable
judgement is still needed as far as what is the path of travel. We had to
take Harley Davidson to a hearing for a heated sidewalk that included a
large outdoor plaza and part of their driveway--and we won surprizingly.
So genrally, the normal width sidewalk can be heated for barrier free
purposes. The statutues prohibit heaating anything else. The grey area is
what is a normal width sidewalk for the specific project so as not to
discriminate.

Subject: Heated Sidewalks
As we all know heated sidewalks are prohibited by State Statute 101.124.
For the first time I have been approached about installing heated sidewalks
from a parking lot to two entrances for a new building. One entrance is for
the public, the other is for the employees. The architect believes these
are allowed per the exception provided in this state statute: being that
the sidewalks are required for ingress and egress for the handicapped.
Based on this application, every entrance/exit from a new building or
addition could have heated sidewalks since each required exit is required to
be accessible. If this is true, is there a limit as to how far the
sidewalks can lead away from the building. It has been my understanding
that the exit path has to lead the occupants to a public right of way (to
get away from the building.)
It would appear if this scenario is correct, this statute is no longer
meeting its goal.
Please advise.

Talking to Scott yesterday afternoon, he said he was on site yesterday and that he had given you his cell number. Did you
call him when you got to the site?
I advised both Scott and Jasen that you would make time on Friday to inspect I informed both, you needed to witness the
generator/emergency system run and review the emergency lighting to see if there was enough, I also told Scott to call
you this AM to review your results from yesterday's inspection, did he call you yet?
Regarding the Kitchen Counters on the end units, I looked at several of them yesterday and found the counter space from
the edge of the sink to the end of the counter is 27"-28". As indicated in an earlier decision, this office is taking no action
on this particular situation for the 2' receptacle spacing. It has been duly noted and I would not support citation action or
withholding occupancy on this particular issue.
As far as allowing occupancy of the 2nd, 3rd and 4th floors, I would expect compliance with:
Item 1 - open the units to allow inspections.
Item 2 - B, C and D
Item 3 - Energized open wiring must be properly capped or disconnected. As has been office policy for years.
Item 4 - I suspect this was noted in a few areas and should be able to be corrected immediately. If it is pervasive
throughout the floors then it still needs to be corrected as it should have been properly supported as it was
being initially installed.
Item 5 - Please educate me on this. What's involved with compliance, what are the existing conditions?
Item 6 - This can be checked for compliance when approval for the next floor level is requested.
Item 7 - Needs to be done prior to any occupancy approval.
Item 8 - Where?
Item 9 - Is this different than item 3?
Item 10 - The state has inspected this, does this mean you need to inspect it? If so, did you talk to anyone on this
need? Was this done by Suburban? If so, then they should understand this, but if it was done by another
electrical firm, they may not have recognized this need.
I am planning to inspect Friday afternoon, unless Jasen says he is ready earlier or says he won't be ready with what I
relayed to him yesterday. Please, keep me advised of when you will be inspecting and the results.

In reference to the 5/22/03 Inspection Request from the electrical contractor for 2nd, 3rd & 4th floor finals.
#1 All of the apartments on 2nd & 3rd floor were locked, 4th floor was open.
#2 Of the couple of apartments I did inspect the following vio.s were noted:
A) Kitchen countertop receptacles in the end units were still missing the required receptacles. (Joe Hertel said his
tape measure was not accurate to within 3". The receptacle for these units were not even over
the countertop & there is 30" from the edge of the sink to the end of the counter)
B) The box for the dishwasher disconnect is not secured to the building surface or structure. This was previously
discussed with the E.C. on a preliminary final inspection that was conducted on 4/29/03.
C) It appears to me that there is ENT installed in the air plenum for the HVAC (disconnect is mounted below the
unit and is built up with sheet metal as though it is an air return)
D) The micro-rec. was installed on the wires but the box extension and the cover plate were not installed.
#3 There is open wiring above the ceilings in the public areas (by elevators etc.) & energized panels that have the
branch circuits terminated, with open wiring (not deviced, covers, etc.) all over the building.
#4 ENT (5th floor) & PVC support issues (1st floor).
#5 Temporary wiring in the parking garage.
#6 Roof Top receptacles shall be installed within 25' of a RTU.

#7 Transformer(s) shall be bonded to the water service to within 5' of the entrance to the building.
#8 Panels that do not have covers installed
#9 All wiring that can or is energized shall be effectively closed.
#10 An electrical elevator inspection must also be conducted.
NOTE: This is not a complete list. The area that the tenants are to be moving into was not accessible and it did not
appear to me that they are ready and a very extensive correction notice would be required.
