Dear Sirs:
On March 14,2007 the Board of Appeals approved a variance to permit a parking lot with a 19'
front yard setback, an 8' rear yard setback, and side yard setbacks of 0' (west) and 8' (east) with
the following conditions:
(a) Conditional use permit is granted by the Common Council.
(b) Fence style to be approved the Department of Community Development.
(c) Fence to be located on the outside of the landscape buffer alon~ the north and east
lot lines with the approval of the neighbor to the east at 510 W 6t Ave.
(d) Landscaping to include plantings between the parking lot and the right-of-way.
The decision of the Board was filed in the Planning Services Division Office of the Department
of Community Development on March 15,2007. Per Section 30-6(C)(3) and (4) of the City of
Oshkosh Zoning Ordinance, your variance will expire on September 15, 2007 unless you have
started construction for the activity allowed by the variance. If you fail to begin construction by
this date, you must reapply for a variance if you intend to go ahead with the activity allowed by
the variance.
Please be advised that any person or persons aggrieved by any decision of the Board of Appeals
may commence action in Circuit Court within thirty (30) days after the filing of the decision.
Permits may be issued on approval of the Board, but you should be aware that further
action could take place until as much as 30 days after the date of the decision.
Building permits may be applied for from the Inspection Services Division in Room 205 at the
Oshkosh City Hall between 7:30 - 8:30 AM and 12:30 - 1 :30 PM, Monday thru Friday, or call
(920) 236-5050 for an appointment. Please bring all required building plans and information
necessary for review when obtaining your building permit.

1 .THE DECLARANT
1.01 The Declarant is 522 W. 6thAvenue, LLC, a Wisconsin Limited Liability: Company,
having its principal place of business at 522W. 6th Avenue, Oshkosh, Wiscon~in 54902
(hereinafter referred to as "522 W. 6th Avenue").
2 THE RECITALS
2.01 The date of this Agreement is August~, 2007.
2.02 522W. 6th Avenue, LLC, a Wisconsin Limited Liability Company, is the owner of the
real property known as Parcel Identification Number 906-00510000 described as
follows:
Lots 19 and 20 of Block 96 in the plat of the ORIGINAL THIRD
WARD, in the Sixth Ward, City of Oshkosh,. WinnebagoCounty,
Wisconsin, per Leach's Map of 1894.
2.03 522 W.6th Avenue, LLC, a Wisconsin Limited Liability Company, is also the owner
.ofthe real property known as Parcel Identification Number 906-00520000 described 'as
follows:
Lot 21 of Block 96 in the plat of the ORIGINAL THIRD WARD, in the
Sixth Ward, City. of Oshkosh, Winnebago County, Wisconsin, along
vacated Wisconsin Central, Ltd., right-of-way, between West Fifth and
Sixth Avenues. .
2.04 The improvements now located on Parcel Number 906..00510000, are immediately
adjacent to the common property line betWeen the two parcels above described and open
to and have access from parcel 906-00520000.
2.05 Parcel 906-00520000 was. previously operated as a' rail;oad track onto which the
improvements located on Parcel Number 906-00510000 opened. Becalise . of the
configuration for access, the Declarant desires to create an easement for access between
the building now located on Parcel Number 906-0051 0000 and the Parcel Number 906- ,
00510000.
2.06 The Declarant desires to recognize the use that it and its predecessors in title have made
of the parcel to provide access for ingress and egress to Parcel 906-00510000 and to
provide for the maintenance and repair ofthe driveway and parking areas to be located
on Parcel Number 906-00520000.

3 THEDECLARATION
Declaration of Easement: 522 W. 6th Avenue; LLC is the owner of Parcel Nuinber906-
00510000 and hereby declares a perpetual, exclusive easement for ingress and egress on
arid over and across Parcel Number 906-00520000. The easement rights granted
hereunder shall include therightto park a reasonable number of vehicles on said parcel
and to provide for ingress and ingress' to each of the openings on the building.' as they
currently exist. Theeasementrightsgranted hereunder shall extend to the owners of the
parcels, their respective guests, invitees, tenants, heirs, successors and ,assigns and is
intended to run with the land. Eas.ement rights granted hereunder shall includethe fight
to construct, maintain, repair, or replace a driveway and parking area as agreed uponby
, the parties. Once constructed, the size and location of the driveway and parking area
shall not be changed without the mutual agreement of the respective owners 0 fthe
parcels.
'Conditional Use Permit: The Declarantacknowledges that the City of Oshkosh has
granted a Conditional Use Permit permitting the Use of Parcel Number906-00520000
as adrivewayandparkinglot. TheoWIiersofParcel Number906-Q0510000shall, in
, all respects, comply with all the terms of the Conditional Use Permit.
Common Use of Driveway and Parking Area: The respective owners ,of each parcel shall
have the right to utilize the driveway and parking area for purposes of ingress and egress
in parking._ Neither party shall utilize the common area in a way that impedes the other's
use of the common area. The parties' shall be equally responsible for the maintenance,
repair and replacement ofthecommon driveway and parking area and shall bear, on an
, equal basis" any and all, costs and expenses necessaiy therefore. ,Each party shall
reimburse the other for expenses incurred for maintenance, repairor replacement ofthe
common driveway ,and parking' lot within 30 days after receipt ora request, for
reimbursement provided, however, neither party shall enter into a contract agreement
or otherwise make commitment for the repair, maintenance or replacement of the
common driveway or parking area in an amount in excess of$250.00 except, upon the
prior written approval of the other. ,Each party shall maintain, on their own respective
property, a general, commerciallhlbility policy of insurance which 'insures ,against
liability arising out of the ownership of the property and use thereof by the parties,
invitees of each party and other 'party utilizing the cOn1mon driveway and parking area.
Damage: Each party shall be solely responsible for any damage to the CO,Inmon
driveway or parking area caused solely by such party or others exercising easement
rights granted to such party. , All such damage shall be promptly repaired by the
responsible party.
Reasonable Use: Eachparty shall exerciseits easement rights in a reasonable manner
so as to avoid anylinnecessary interference with the use of the common driveway and
parking area by the other party. In addition, eachpartyshall refrain from parking upon
the jointly used portions of the common driveway and parking lot or otherwise
unreasonably obstructing the common driveway.

Other Use: No party shall acquire any prescriptive right or adverse possession property
interest in the property area by reason ofthat party's use, all ofwhichispennisSive.

Miscellaneous:
A. Binding Agreement. This Agreement shall be binding upon and inure to the
. benefit of the respective Declarant, its successors and assigns, heirs and personal
representatives, except as otherwise expressly provided herein.
B.Waivers. Change or Modification. This Agreement may be changed onlyby
an Agreement inwriting and signed by the party against whom enforcement of
any waiver, change, modification or discharge is sought.
C. Applicable Law. This agreement shall be construed pursuant to, and in
accordance with, the laws of the State of Wisconsin.

In aC90rdance with recent state legislation, all service laterals are required to be locatable. The City of Oshkosh
has chosen to use marker balls as a means of locating sanitary sewer and storm sewer l~s. Therefore, the
stonn sewer lateral is required to have a 3M ScotchMark Model 1408-XR general markerball, or equal placed at the
main connection, and another located two feet off.the right-of-way (in the right-of-way).
