Dear Mr. Rothe:
On February 12, 1985, I inspected portions of your property known
as 507 Washington Avenue at the request of the Oshkosh Welfare Depart-
ment for General Relief purposes.
During the inspection, I noted the following violations of State
and city Codes which shall be corrected:
1. The dwelling is listed with the assessor's office as a duplex,
while in fact, being a three-family dwelling.
2. The second floor North apartment does not have a second exit.
A second exit shall be installed. (Permit Required)
3. There is no rated fire room surrounding the furnace and hot
water heater. A rated fire room shall be installed. (Permit Required)
4. The guardrails on the front porch are not the required height
for multiple family living units. These guardrails shall be raised to
a height of 42 inches above the deck.
5. There is no proper hall lighting in the front hall. Proper
lighting shall be installed in all public access halls in the dwelling.

6. There is an electrical outlet installed face up on the living
room floor. This outlet shall be removed and relocated.
7. The winder stairs to the basement have no handrails. Handrails
shall be installed at a height of 32 inches above the nose of the treads.
8. The water heater in the basement is vented using a downspout
elbow. This elbow shall be replaced with proper venting material.
9. There is a torn screen in the South bedroom window. This screen
shall be replaced.

10. The paneling on the shower stall is loose. The paneli.ng shall
be repaired.
11. This apartment has only one exit.

16. The front entry door is equipped with double action hardware.
The locking hardware shall be of the single action type where a single
push or turn of a knob will open the door.
On March 27, 1985, I will reinspect the property to ascertain
whether or not progress is being made in the correction of the noted
violations. If you have any questions, feel free to contact this office

Therefore) if no contact has been made with the Code
Enforcement Office (236-5045) on or before June 27, 1985
concerning the correction of the ILHR Code violations in
your building, "Vacate notices" will be served on the ten-
ant in the second floor front apartment. These notices
will require the tenant to leave the dwelling unit within
28 days.

Dear Sir:
On August 9, 1985, I inspected portions of your property known
as 507 Washington Ave., a three family dwelling, following
complaints of cockroaches in all three units.
Sec. 16.37(A)5~ of the Minimum Housing Code states that "Every
owner or operator shall be responsible for extermination of
any insects, rodents, or other pests whenever infestation occurs
in more than one dwelling unit in a dwelling..... therefore,
extermination of these cockroaches is your responsibility and
shall be completed within 10 days of this letter.
I am sure you aTe concerned about the health and welfare of
your tenants and will take care of this matter expeditiously.

Dear Mr. Bock:
On September 9,1985, Capt. Robert Vajgrt of the Fire
Inspector's Office and I reinspected portions of your pro-
perty known as 507 Washington Avenue. The inspection was
made to determine whether or not progress was being made in
the correction of the ILHR Code violations and the Minimum
Housing Code violations therein.
During the inspection, we found that very little has
been done to correct the violations noted in my letter dated
March 6, 1985. The ILHR Code violations remain uncorrected
and no permits or plans have been approved. Most of the
Minimum Housing Code violations are also uncorrected.
Therefore, you are hereby notified that the second floor
front apartment shall be vacated within 28 days of this let~
ter. This action is being taken due to the fact that the
dwelling has been under orders since March 6,1985 for ILHR
Code violations and nothing has been done to correct them.
On October 9, 1985, we wi 11 reinspect the property to
assure compliance and Post the apartment in question as "Unfit".

Dear Mr. Bock:
It has come to the attention of this office that you
have rented or are intending to rent apartment A in your
building known as 507 Washington Avenue.
On October 9, 1985, Capt. Robert Vajgrt of the Fire
Inspector's Office and I Posted the abovementioned apart-
ment as IIUnfit for Human Habitation, Occupancy or Use" due
to non-compl iance with Wisconsin ILHR Codes concerning mul-
tiple family occupancies. You were notified in my letter
dated September 10, 1985 of our intent to Post the apart-
ment if the violations had not been corrected.
Rental or advertizing for rental of this apartment is
a violation of Ag 134.D9 (1) of the Wisconsin Administrative
Code. If it is found that you have in fact rented or are
advertizing this apartment for rent, the matter will be re-
ferred to the Wisconsin Department of Agriculture, Trade and
Consumer Protection for prosecution. .
This apartment cannot be rented as of October 9, 1985,
until such time that all ILHR Code violations have been
corrected.

On January 14, 1986, Lt. Francis Mathe made a reinspect ion 'of your
property known as 507 Washington Avenue and found 'that the flPOSTEDfI
upper front apartment is rented at this time.
Also during the inspection it was noted that the exit, required from the
upper frpnt apartment has not been properly completed and, there has
been no work done on the fire rated furnace enclosure in the basement.
Therefore, you are hereby ordered to complete the second exit from the
upper front apartment and install the required fire rated furnace enclo-
sure within the next 28 days.
On February 11, 1986 we will, again, "POSTII the apartment as "Unfit for
Human Habitation" if all Of the required corrections hiave not been
completed in full. Continued rental or advertising for rental of the
apartment is in violation of Ag 134.09 Prohibited Practices of the
Wisconsin Administrative Code.
If the apartment is "POSTEDfI on February 11, 1986, it will requ~re that
the apartment be vacated immediately.

100.20 METHODS OF COMPETITION AND TRADE PRACTICES.
(1) Methods of competition in business and trade practices in
business shall be fair. Unfair methods of competition in busi-
ness and unfair trade practices in business are hereby
prohibited.
(2) The department, after public hearing, may issue general
orders forbidding methods of competition in business or trade
practices in business which are determined by the department to
be unfair. The department, after public hearing, may issue

special order against any person, enjoining such person from

filed it shall be the duty of the department to proceed, after
proper notice and in accordance with its rules, to the hearing
and adjudication of the matters alleged, and a representative
of the department of justice designated by the attorney general
may appear before the department in such proceedings. The depart-
ment of justice shall be entitled to judicial review of the
decisions and orders of the department under chapter 227.
(5) Any person suffering pecuniary loss because of a viola-
tion by any other person of any order issued under this section
may sue for damages therefore in any court of competent jurisdic-
tion and shall recover twice the amount of such pecuniary loss,
together with costs, including a reasonable attorney's fee.
(6) The department may commence an action in circuit court
in the name of the state to restrain by temporary or permanent
injunction the violation of any order issued under this section.
The court may in its discretion, prior to entry of final judgment
make such orders or judgments as may be necessary to restore to
any person any pecuniary loss suffered because of the acts or
practices involved in the action, provided proof thereof is
submitted to the satisfaction of the court. The department may
use its authority in ss. 93.14 and 93.15 to investigate violations
of any order issued under this section.
100.26 PENALTIES. (3) Any person. . . who intentionally
refuses, neglects or fails to obey any regulation or order made
or issued under section. . . 100.20 shall, for each offense, be
fined not less than $25 nor more than $5,000 or imprisoned in the
county jail for not more than one year or both.
100.26(6) The department of justice or any district attorney
may commence an action in the name of the state to recover a
civil forfeiture to the state of not less than $100 nor more than
$10,000 for each violation of an injunction issued under s. 100.18,
100.182, or 100.20(6) or an order issued under s. 100.20.

Upon inspection of your building known as 507 Washington
Avenue, it was noted that the roof is leaking water into the
second floor ceiling fixture. This leak must be repaired in
24 hours or the circuit involved will be tagged and discon-
nected.
It was also noted that there is no exterior light fix-
ture on the West entry of the first flo~r apartment. A fix-
~ure shall be installed by a licensed electrician.

regarding our Rental Rehabilitation Program.
One of the requirements of this program is that you certify
that after the rehabilitation is completed and the property
meets Codes, you will continue to maintain the property at
the same level of Code compliance. Failure on your part to
maintain Code compliance would result in your loan being
made due immediately.
I am recommending that you review the attached information
to be sure that you are willing to comply to all requirements.

at 507 Washington, it was evident that there is some history
