CERTIFICATE OF OCCUPANCY
An Occupancy Permit Inspection was conducted and approved to determine
compliance with the State of Wisconsin Building Code for use of the Classrooms
as a Pre-School located at 1313 Elmwood Ave.
This space shall be used as a Pre-School / 4 year old Kindergarten and is
located in the R1-C Single Family Central Residence District.
LIMITATIONS:
Maximum number of persons: 29 occupants
Compliance with Conditions of Approval for the Certificate of Occupancy issued
by the Planning Services Division shall be maintained.
Certificate of Occupancy shall be required prior to occupancy, should additional
building(s) be erected, or should any buildings mentioned above be altered or
moved. The use of land, or buildings, shall not be changed until a Certificate of
Occupancy is issued for that occupancy. All conditions noted above must be

This letter is intended to serve as an architectural code review to allow the west portion of the
existing building at 1313 Elmwood Avenue in Oshkosh, Wisconsin to be approved as a daycare
facility for 4-year oIds.
The existing west portion of the building consists of l-classroom., 2-toilet rooms, an office,
kitchen and mechanical room. The east portion of the building is used for art storage. The art
storage area was previously approved as a storage area and will remain as a storage area;
therefore no code review for this area will be completed. The west portion of the building was
previously approved under Chapter 54 of the Wisconsin building code as a general use area
and will be required to meet the current Wisconsin Enrolled Commercial Building Code-2002
for change of occupancy to type E occupancy, which allows 4-year old daycare.
. Occupancy: E-Educational per Section 305.2, and 5-1
. Construction Type : VB Combustible, Unprotected construction
. This west portion of the building is not sprinklered. The east portion is sprinklered.
. The west portion is I-story, 2,310 SF. The east portion is I-story w / mezzanine 3,640 SF.
Total building is 5,950 SF.
o Code allows 1-story, 9,500 SF for E occupancy.
o Code allows I-story, 9,000 SF for 5-1 occupancy.
. Per 302.3.3 a 3-hour occupancy separation is required between E and 5-1.
o A 12" CMU wall separates the 2 occupancies and meets this requirement.
. Fire Department access is available on one-side of the building and all sides of the
building are within 150' of the fire lane.
. . Accessibility for existing buildings per Section 3408.3 is met.
. A drinking fountain is available, but disposable cups will be required.
. (1) toilet and (1) lavatory exist for each sex. (1) of each is required per code.
o Toilet rooms are accessible and include grab bars. Sinks will need knee
protection at exposed piping.
o Privacy locks exist on toilet room doors and have keyed access to meet daycare
requirements. Keys must be accessible to staff at all times.

. There is a required mop sink. In the mechanical room.
. There are adequate fire extinguishers.
. There are exit lights at each exit door which remain lit at all times.
. Common path of travel not to exceed 75' is met.
. Maximum travel distance not to exceed 200' is met.
· (2) Exits on opposite ends of the building meet exiting requirements, including required
exit width, door width and swing direction.
. Occupancy of the building will be restricted to 30 as part of the approved program.
Therefore classroom exiting meets code requirements and the exit corridor will not need
to be rated.
. Smoke detection and manual fire alarm systems are not required per Section 907.2.3, but
do exist in the existing facility and therefore are required to be tested weekly and testing
documented.
. The existing kitchen does not include a stove at this time. Any stove added at a later
date would need to meet required ventilation codes. If meals are provided, the local
agency would need to review and approve the meal program.
The west area of the existing building was currently updated through painting, cleaning
and minor maintenance. No additions or alterations have occurred. Therefore, the east area
of the building, originally approved for storage, will remain as storage and will not require
code review. The west area of the building currently meets the requirements for a type E"
Educational use, which includes 4-year old daycare. (Note: 2 minor items noted above in
bold are required to be addressed for full compliance)
This is an architectural building review only, existing Electrical, Plumbing and HV AC
requirements are assumed to have been met through prior approvals.

One more note,
The program as stated in the zoning approval lists max. class time as 2 1/2 hours. An outdoor play area is not
required. If kids are there for more than 3-hours, HHS will require an enclosed outdoor play area. This area would
be to the west of the classrooms and would be fenced in. The building would still be within the fire department
150' requirement, but the fenced enclosure would prevent direct access to the west face of the building unless
they can get through the fence. Is this something you would like addressed in the letter?

Hi Ken,
Thanks for all of your work on sorting this out.
The Paine has a conditional use permit to operate the 1313 Elmwood property as an "Arts Center" and this
program falls within that use. I was told by the City Planning Department that our ability to operate this program is
the same as a church's ability to operate a day care.
This gets a little confusing, though, but we're not really operating a day care. The program will be an arts-based
educational program for 4-year-olds with 2 1/2 hour sessions (not "day" care). However, the school district/state
funding requires that the facilities running the programs be licensed as day cares.
The letter below confirms the City Planning Department's allowance of the program.
So, we should be all set from this standpoint.

This e-mail shall act as a written statement regarding the ability to establish an arts-based educational program,
as described within the e-mail string below at the Paine Art Center and Gardens at 1410 Algoma Blvd and 1313
Elmwood Avenue.
The properties (#s 12-0068-0000 & 12-0180-0000) is currently zoned R-1C: Single Family Central Residence
District that allows, with conditional use approval, an art center. Resolution 91-399: Conditional Use
Permit allows the art center use and accessory uses customarily incidental and accessory to that use. Please
See Section 30-18 in the City of Oshkosh Municipal Code (website www.ci.oshkosh.wLus)forfulllist of uses
permitted and conditional within the R-!C District.

The "arts-based educational program" is anticipated to be managed in collaboration with Arts for Kids and
includes instruction and education of a limited number of children within the existing Paine Art Center campus.
The City of Oshkosh Community Development Department considers this use and the associated space within
the Paine Art Center campus as accessory and incidental to the principal Art Center uses on the site.

Dear David:
I am writing to inform you about a new educational program at the Paine Art Center and Gardens
and to request your assurance that the program is acceptable in relation to the organization's
Conditional Use Permit to operate as an Arts Center.
In August of2007, the Paine will launch a new arts-based educational program for 4-year-old
children. The program will be operated in our facility at 1313 Elmwood. This building has an
existing large parking lot and an existing 2,000 sq. ft. educational center to readily accommodate
the program. The Paine does not intend to make any changes to the exterior of the building or
surrounding property to accommodate the program. The program will serve a maximum of
twenty (20) children per two-and-a-halfhour session with a maximum of two (2) sessions per
weekday; for a maximum of five (5) hours of instruction and forty (40) children served per day.
The program is incidental to and consistent with the purpose of the Paine Art Center and Gardens
as established by founders Nathan and Jessie Paine in 1946. The Paine's Deed of Gift states that
the organization operate "as a charitable foundation of the highest educational and cultural value
for the benefit not only of the people of the City of Oshkosh, Wisconsin and its educational
institutions - but also for all interested persons and educational institutions." This program is also
consistent with the organization's incorporation in 1946 as 501(c)(3) non-profit educational
institution.
The Paine seeks to maximize its distinctive combination of resources to inspire a wide range of
innovative educational programs creating multiple opportunities for exploration and learning.
This program will serve 4-year-old children and engage them in educational activities related to
the art, architecture, and gardens of the Paine. The program will be operated by Arts for Kids, a

specialty child care center with expertise in arts instruction for preschool age children. Funding is
provided by the State of Wisconsin and administered by the Oshkosh Area School District.
Importantly, this collaboration enables the Paine to offer this high-quality arts educational
experience to four-year-old children for free. The children will not have to pay any fees to
participate.
The Paine Art Center and Gardens believes this program is consistent with the organization's
Conditional Use Permit from the City of Oshkosh to operate as an Arts Center. As the Paine's
building at 1313 Elmwood has already existed as an educational center and the size of the facility
and amenities can easily accommodate this program, we believe that the operation of this program
will not significantly change our activity and impact with the neighborhood.
