An Occupancy Permit for an accessory arts-based educational program is hereby
issued forthePai(1e Arts Center & Gardens 1410 Algoma Blvd and arI~~'~-
Elmwood Avenue,~Oshkosh, Wisconsin, 54901, as described within submitted'
documents on file with the City of Oshkosh Department of Community
Development.
The zoning classification for the above referenced properties (Parcel #s 12-0068-
0000 & 12-0180-0000) is R-1 C: Single Family Central Residence and Resolution
91-399 permits the Art Center Use and accessory uses customarily incidental to that
use.
The arts-based educational program is reported to be managed in collaboration
outside agencies and includes instruction and education of a limited number of
children within the existing Paine Art Center campus. The City of Oshkosh
Community Development Department considers this use and the associated space
within the Paine Art Center campus as accessory and incidental to the principal Art
Center uses on the site.
A new and/or additional Certificate of Occupancy is required prior to occupancy,
should additional building area be utilized, should additional building(s) be erected
or should any buildings be altered or moved. The use of land or buildings shall not
be changed until a Certificate of Occupancy is issued for said use(s). All conditions

This e-mail shall act as a written statement regarding the ability to establish an arts-based educational program,

The properties (#s 12-0068-0000 & 12-0180-0000) is currently zoned R-1C: Single Family Central Residence

I am writing to inform you about a new educational program at the Paine Art Center and Gardens
and to request your assurance that the program is acceptable in relation to the organization's
Conditional Use Permit to operate as an Arts Center.

In August of 2007, the Paine will launch a new arts-based educational program for 4-year-old
children. The program will be operated in our facility at 1313 Elmwood. This building has an
existing large parking lot and an existing 2,000 sq. ft. educational center to readily accommodate
the program. The Paine does not intend to make any changes to the exterior of the building or
surrounding property to accommodate the program. The program will serve a maximum of
twenty (20) children per two-and-a-halfhour session with a maximum of two (2) sessions per
weekday; for a maximum of five (5) hours of instruction and forty (40) children served per day.
The program is incidental to and consistent with the purpose of the Paine Art Center and Gardens
as established by founders Nathan and Jessie Paine in 1946. The Paine's Deed of Gift states that
the organization operate "as a charitable foundation of the highest educational and cultural value
for the benefit not only of the people of the City of Oshkosh, Wisconsin and its educational
institutions - but also for all interested persons and educational institutions." This program is also
consistent with the organization's incorporation in 1946 as 501(c)(3) non-profit educational
jpstitution.
The Paine seeks to maximize its distinctive combination ofresources to inspire a wide range of
innovative educational programs creating multiple opportunities for exploration and learning.
This program will serve 4-year-old children and engage them in educational activities related to
the art, architecture, and gardens of the Paine. The program will be operated by Arts for Kids, a
specialty child care center with expertise in arts instruction for preschool age children. Funding is
provided by the State of Wisconsin and administered by the Oshkosh Area School District.
Importantly, this collaboration enables the Paine to offer this high-quality arts educational
experience to four-year-old children for free. The children will not have to pay any fees to
participate.
The Paine Art Center and Gardens believes this program is consistent with the organization's
Conditional Use Permit from the City of Oshkosh to operate as an Arts Center. As the Paine's
building at 1313 Elmwood has already existed as an educational center and the size of the facility
and amenities can easily accommodate this program, we believe that the operation of this program
will not significantly change our activity and impact with the neighborhood.

Dear Mr. Burich:
On behalf of the Paine Art Center and Gardens, I am writing this letter to provide
additional information about the organization's plans for the arts-based
educational program serving 4-year-old children in the community.
The primary function of the new program will be arts instruction for preschool
children. The learning activities will primarily relate to the arts dimensions and
resources of the Paine, and some activities will relate to the gardens of the Paine.

The structure of the program meets the criteria for the Oshkosh Area School
District's Ready 4 Learning initiative. The program will address the Ready 4
Learning curriculum standards through arts instruction. The curriculum
standards are general and easily adaptable to arts learning activities.
The Paine, in partnership with Arts for Kids, pursued participation in the Ready 4
Learning initiative for two key reasons: The Ready 4 Learning status qualifies our
arts-based program for public funding, which enables us to offer the program to
children for free; and, the Ready 4 Learning status ensures a high-quality program
that addresses relevant and important curriculum standards for 4-year-old children.
The program will not be operated by the Oshkosh Area School District or members
of its staff. The program will be operated by Arts for Kids and its staff, and the
Paine's staff will be frequent resources and participants. The Paine's Curator of Art,
Curator of Horticulture, and Art Educator will all assist the program.
The arts-based educational program for 4-year-olds is accessory and incidental to
the operation of the Paine Art Center and Gardens. The program is specifically
planned to complement the purposes and to utilize the resources of the Paine Art
Center and Gardens. This specialized program would not be able to operate
independently of the Paine Art Center and Gardens.

Center and Gardens, 1 am a member or the Paine's Board of Trustees, and I serve as a member or
the Paine'.s Education Committee, which provides a setting for the Oshkosh Area School District to
help develop and improve edncational programming that best addresses the purposes of the Paine
and the need'! 0 r the community.

The Paine is a vital instructional resource for the youth of Oshkosh. As a board member of the Paine
Arts Center and Gardens and an administrator of the Qshkosh Area School District, larn particularly
enthusiastic about the new arts-based pre-kindergarten Ptogmm.
