APProvED ~ Variance (s) Required r~ ., J {p /' ~ ~ REVW'V"ED BY: ~ \1, lY\pl1'lL- DATE : ~i06 @~l 111 'l5-~ " STAFF REPORT BOARD OF ZONING APPEALS JULY 6, 1988 ITEM IV: 1708 HICKORY STREET - Faro and 'Serafina Vitale GENERAL DESCRIPTION/13ACKGROt1Nn The applicants are requesting a variance to construct an attached two car garage with a 5 1/2 ft. side yard setback; whereas Section 30- 15(B) (1) (b) Standards for the R-l Single Family Residence District of the City of Oshkosh Zoning Ordinance requires a 7 1/2 ft. side yard setback for attached garages. On May 18, 1988, the Board of Zoning Appeals denied this variance request. The surrounding land use pattern is as follows: the areas to the north, south, east and west are zoned R-l Single Family Residence with single family dwellings. ANALYSIS/RECOMMENDATION FOR FINDINGS OF FACT In reviewing a variance request, the following questions should be addressed. Is there an unusual or unique characteristic about the subject property which creates a ha~dship? Is the hardship self-created? Is the variance being requ'ested the least possible to remove any hardship? will granting of the variance have a considerable adverse impact on the neighboring properties? The applicants are requesting this variance to allow construction of a two car attached garage to replace an existing one car attached garage. The existing one car attached garage meets the required 7 1/2 ft. side yard setback. The requested variance would allow the garage to extend 2 ft. into the required side yard setback. The applicants state that without the variance the garag~ would be too narrow for anything but compact cars. The house is situated on the north end of the lot. The applicants did not construct the house, so the hardship is not self-created. There is no other reasonable alternative for a new attached garage that would meet the required setbacks and be usable for anything but compact cars. The majority of the surrounding single family homes have two car attached garages. It appears that the granting of this variance would not have a negative impact on the area. The variance request is for the least amount of area needed for the garage, and is equal to the 2 ft. allowed for architectural projections into required setbacks. Based on the above, staff recommends approval of the variance as requested. ~ ::t.
